ORDER CORRECTING DOCKET

The Tribunal has considered the file in this case and finds that, based on the Small

Claims petition filed by Petitioner on June 29, 2026, and the supporting documentation,

the correct petitioner in this case is Landmark Community Church and not Barry W.

David. In that regard, on May 14, 2026, Petitioner filed a case information sheet listing

Mr. David as Petitioner. That filing was incorrect both because it is not a Tribunal

petition and because Mr. David does not own the subject property.

On June 24, 2026, the Tribunal entered an order placing Petitioner in default because

the case information sheet is not a petition as required by Tribunal rules.1 However,

that order was partially incorrect because it stated that Petitioner was required to file a

Small Claims petition. Instead, this case is eligible to proceed in whichever division

Petitioner elects.2 If Petitioner wishes that this case proceed in the Entire Tribunal

division instead of the Small Claims division, it shall file a Motion to Amend Petition, an

amended petition, proof of service of the amended petition in conformity with TTR

227(6), and submit the additional petition filing fee owed under TTR 223(2)(a)(ii)(B).

Based on the foregoing, an order correcting the docket is appropriate. Therefore,

IT IS ORDERED that the docket shall be CORRECTED to reflect Landmark Community

Church as the proper Petitioner in this case. The May 14, 2026 case information sheet

serves as Mr. David’s appearance as Petitioner’s authorized representative.
