FINAL OPINION AND JUDGMENT

ORDER CORRECTING DOCKET

The Tribunal issued a Proposed Opinion and Judgment (POJ) on October 9, 2025. The

POJ states, in pertinent part, “[t]he parties have 20 days from the ‘Entered’ date below

to notify the Tribunal in writing, by mail or by electronic filing, if they do not agree with

the POJ and to state in writing why they do not agree with the POJ (i.e., file exceptions

to the POJ).”

Neither party filed exceptions to the POJ.

The Administrative Law Judge (ALJ) considered the testimony and evidence submitted

and made specific findings of fact and conclusions of law. The ALJ’s determination is

supported by the testimony and evidence and applicable statutory and case law.

Given the above, the Tribunal adopts the POJ as the Tribunal’s final decision in this

case.1 The Tribunal also incorporates by reference the Findings of Fact and

Conclusions of Law contained in the POJ in this Final Opinion and Judgment. As a

result:

reflect the special assessment as finally shown in this Final Opinion and Judgment

within 20 days of the entry of this Final Opinion and Judgment.

IT IS FURTHER ORDERED that the officer charged with collecting or refunding the

affected special assessment shall collect the assessment and any applicable interest or

issue a refund within 28 days of entry of this Final Opinion and Judgment.

This Final Opinion and Judgment resolves the last pending claim and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

ISSUES AND APPLICABLE LAW

The issue in this matter is as follows:

MTT Docket No. 24-003600

1. Whether the benefit from the special assessment is proportional to the cost of the

improvement.

The Michigan Supreme Court has held:

A special assessment is a levy upon property within a specified district.

Although it resembles a tax, a special assessment is not a tax. In contrast

to a tax, a special assessment is imposed to defray the costs of specific

local improvements, rather than to raise revenue for general governmental

purposes . . . . In other words, a special assessment can be seen as

remunerative; it is a specific levy designed to recover the costs of

improvements that confer local and peculiar benefits upon property within

a defined area.1

Special assessments “are permissible only when the improvements result in an

increase in the value of the land specially assessed,”2 and to be valid “‘there must be

some proportionality between the amount of the special assessment and the benefits

derived therefrom.’”3 The Court of Appeals has held that “[t]he essential question is not

whether there was any change in market value, but rather whether the market value of

the assessed property was increased as a result of the improvement.”4 Further,

Common sense dictates that in order to determine whether the market

value of an assessed property has been increased as a result of an

improvement, the relevant comparison is not between the market value of

the assessed property after the improvement and the market value of the

assessed property before the improvement, but rather it is between the

market value of the assessed property with the improvement and the

market value of the assessed property without the improvement.5

It is well settled, however, that municipal decisions regarding special assessments are

presumed valid and should generally be upheld.6

When reviewing the validity of special assessments, it is not the task of

courts to determine whether there is ‘a rigid dollar-for-dollar balance

between the amount of the special assessment and the amount of the

benefit . . . .’ Rather, a special assessment will be declared invalid only

when the party challenging the assessment demonstrates that ‘there is a

substantial or unreasonable disproportionality between the amount

assessed and

Section 4: Explain Your Answer to this Appeal

The subject parcel of real property is located in Richland Township, Kalamazoo County, Michigan and has frontage

and access off of Sterling Avenue. The Respondent has created a special assessment district pursuant to the

provisions of Public Act 188 of 1954, as amended, for the purposes of funding proposed road improvements, repairs,

and maintenance on Sterling Avenue. The subject property was included in the district as having frontage on Sterling

Avenue. lt is included with the other properties that have frontage on Sterling Avenue. The Township followed proper

procedure to establish the special assessment and approved the special assessment roll on June 18, 2024 (see

attached Resolution confirming the special assessment roll). The subject property is within the special assessment

district and received an assessment. The Township acted within its lawful discretion setting the special assessment

roll and assessment on the subject parcel which amount is the relative portion of the whole sum to be levied against

all parcels of land in the special assessment district as the benefit to the parcel of land bears to the total benefit of all

parcels in the special assessment district. The subject real property receives a special benefit different than owners

of the public in general as

it has access and frontage off of Sterling Avenue.

It is my intention to

place the parcel into a legally binding conservation easement upon my death to prevent any

future housing developments and to maintain a “nature preserve” in perpetuity.

The parcel is not located nor is it a parcel in the adjacent registered plat of “Tanglewood

The primary parcel access is M43 Highway, not Sterling Avenue. This is verified by the “draft

| am appealing the SAD & special tax assessment of $5,511.64 per parcel for repaving Sterling

Avenue (a private neighborhood road).

The township indicated that this parcel is located at the dead end of Sterling Avenue and, therefore,

has “frontage” on Sterling Avenue so it must be included in this project.

| object for the following reasons:

1a

The parcel will not receive a “direct and unique benefit” from the project, the property will

not be “enhanced” by the road improvement, and it will not “impact or increase the market

value” of the land - which are all requirements to be met for a special tax assessment.

The parcel is a “vacant” 45 acres of land with no buildings that is located adjacent to

sterling Avenue.

(See AflachmenT #3)

| purchased this land in 2002 from a local farmer to prevent a housing development and the

land has remained woodlands, marsh and prairie grasses ever since.
