GRAND RIVER AVE., LANSING, MI 48906 Justine M Seath, MICHIGAN TAX TRIBUNAL Petitioner, SMALL CLAIMS DIVISION v MTT Docket No. 26-000535 Sparta Township, Presiding Judge Respondent. Patricia L. Halm REISSUED ORDER OF DISMISSAL1 The Tribunal has reviewed the file in the above-captioned case and finds that: Petitioner failed to file an Affidavit for Disabled Veterans Exemption with the assessing officer for the local assessing unit between January 1 and December 31 of the tax year(s) at issue, as required by MCL 211.7b. As such, and inasmuch as the Tribunal has no equitable power to waive or otherwise disregard statutory filing requirements and deadlines, it has no authority to hear the appeal or grant the relief requested. See Sixarp LLC v Byron Twp, __ Mich __; __ NW3d __ (2025). Therefore, IT IS ORDERED that this case is DISMISSED. This order resolves all pending claims in this matter and closes this case. APPEAL RIGHTS If you disagree with the final decision in this case, you may file a motion for reconsideration with the Tribunal or a claim of appeal with the Michigan Court of Appeals. A motion for reconsideration must be filed with the Tribunal with the required filing fee within 21 days from the date of entry of the final decision. Because the final decision closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing system; it must be filed by mail or personal service. The fee for the filing of such motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless the Small Claims decision relates to the valuation of property and the property had a principal residence exemption of at least 50% at the time the petition was filed or the 1 The Tribunal finds it necessary to reissue an Order of Dismissal due to a processing error by the Tribunal which resulted in the parties not appropriately being served with the Order of Dismissal that was issued on April 10, 2026. As such, the parties have the full 21 days to file a motion for reconsideration with the Tribunal or a claim of Appeal with the Michigan Court of Appeals, as provided in this order.

MTT Docket No. 26-000535 Page 2 of 2 decision relates to the grant or denial of a poverty or disabled veterans exemption and, if so, there is no filing fee. You are required to serve a copy of the motion on the opposing party by mail or personal service or by email if the opposing party agrees to electronic service, and proof demonstrating that service must be submitted with the motion. Responses to motions for reconsideration are prohibited and there are no oral arguments unless otherwise ordered by the Tribunal. Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If the claim is filed more than 21 days after the entry of the final decision, it is an “appeal by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the record on appeal. Cliff Turner — -— - From: State-Tax-Commission <State-Tax-Commission@michigan.gov> Sent: Wednesday, March 11, 2026 5:27 PM To: Cliff Turner Subject: RE: Veterans Exemption Good afternoon: MCL 211.7b allows for the Disabled Veteran's Exemption to be granted for the current year only by the statement *...January 1 and before December 31 of the calendar year for which the exemption is claimed.” However, MCL 211.53b was revised in 2023 to allow the July and December Board of Review authority to grant a disabled veterans exemption as a qualified error for current and one year prior for any of the following reasons: 1) An error made by the local tax collecting unit in the processing of a timely filed exemption affidavit. 2) A delay in the determination by the United States Department of Veterans Affairs that a veteran is permanently and totally disabled as a result of military service and entitled to veteran's benefits at the 100% rate. The above indicates that the law does not allow anyone to go back and grant an exemption for any prior years except for those reasons that fall under MCL. 211.53b. Unfortunately, because the veteran did not file for the exemption in 2025 there is no way to be able to go back and grant the exemption. The only suggestion would be to have the veteran try and appeal to the Michigan Tax Tribunal but there is no guarantee. Let me know if you have any further questions.
