Unless Respondent was defaulted, this case is ready to be scheduled for a Small

Claims hearing and will be scheduled in the normal course of scheduling. You will

receive a Notice of Hearing from the Tribunal by e-mail if you have identified an email

address in the petition or other documentation. The Notice of Hearing will inform you of

conducted by telephone). Please read the Notice of Hearing as it includes important

information.

EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy

to the opposing party at least 21 days before the hearing date even if the documents

had been submitted to the local Board of Review or the Michigan Department of

Treasury. If the documents are not timely submitted to the Tribunal and served on the

opposing party, the documents may be excluded. Documents may be filed with the

Tribunal by mail or through the Tribunal’s e-filing system. Documents may be sent to the

submitting a Request for Redactions. The Request for Redactions form will be

available on the Entire Tribunal and Small Claims pages of our website.

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

MEDIATION: Parties have the option of handling this case through mediation.

Mediation is a voluntary process where a mediator facilitates communication between

the parties, assists in identifying issues, and helps explore solutions to promote a

mutually acceptable settlement. This process may be an alternative to a hearing with a

judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

If you have any questions, please contact the Tribunal by phone at (517) 335-9760 or

email taxtrib@michigan.gov.

Re: Uncapping of Taxable Value- Parcel 52-25-19-183-010- 24020 Condon Ave, Oak

Park, MI

Dear Property Owner,

Our office was recently notified of a transfer of ownership of the above-mentioned

property. On the delayed filed Property Transfer affidavit,

it was indicated that the

property was commonly controlled. After reviewing the information received

it was

determined that this transfer was not an exempt transfer and the property's taxable

value must be uncapped for the 2019 assessment year.

Enclosed is the Assessor Affidavit regarding “uncapping” of the Taxable Value for the

years 2019 through 2025. You will receive a revised tax bill from the Oakland County

Treasurer for the following year(s): 2019 through 2024. The City of Oak Park Treasurer

will be issuing a revised summer tax bill for 2025. The winter tax bill will be calculated

correctly. Below is the estimated amount of additional taxes that will be billed for each

year. These estimates do not include any interest or penalties that may apply.

Tax Years: 2019 - $1392, 2020 - $1412, 2021

- $1417, 2022 - § 1432, 2023 - $1491

2024 - $1601, 2025 - $1679

If you disagree with the above determination, you have 35 days from the date of this

notice to appeal the decision to the Michigan Tax Tribunal. Full instructions on how to

file an appeal are found on their website at www.michigan.gov/taxtrio

The taxable value of the property was adjusted under MCL 211.27b(1) because the owner did not timely file a Property Transfer Affidavit as required by MCL

211.27a(10). After reviewing the documents submitted by the owner, it was determined that the property was not commonly controlled, as the extent of ownership

Section 5: Explain the Reason for this Appeal

These LLC's have 2 members, myself, Thomas J Berta, and my partner, George Nestor.

We purchased these homes in our LLC's 6 to 13 years ago. We applied for an equity line

loan about 5 years ago through our bank, First State Bank.

First State Bank said that

we needed to quit claim the houses into Thomas Berta or George Nestor and then quit

claim the homes back into the LLC's. This is what we did. We have income tax filing

proof that we paid taxes on these 3 homes every year since we purchased the homes

approximaetley 6 to 13 years ago. We do not feel this was a change in ownership and

the City of Oak Park should not have uncapped the taxes on these homes.
