GRAND RIVER AVE., LANSING, MI 48906 Jamie Blumenthal, MICHIGAN TAX TRIBUNAL Petitioner, SMALL CLAIMS DIVISION v MTT Docket No. 25-003352 City of Southfield, Presiding Judge Respondent. Patricia L. Halm ORDER VACATING NOVEMBER 14, 2025 ORDER HOLDING RESPONDENT IN DEFAULT ORDER GRANTING RESPONDENT’S MOTION TO DISMISS On November 25, 2025, Respondent filed a motion requesting that the Tribunal dismiss the appeal in the above-captioned case. In the motion, Respondent states that its March Board of Review (BOR) was not able to consider the appeal because it contained the wrong parcel number (Parcel No. 76-24-25-203-004) and because neither Petitioner nor an authorized representative appeared at the BOR. On December 2, 2025, Petitioner filed a response indicating that the Tribunal has authority under its rules to allow an amended petition. Petitioner contends that the correct parcel number is 76-24-25-206-004. Petitioner further contends that Respondent is not prejudiced and is inappropriately seeking dismissal where it is not warranted. The Tribunal has considered the motion, the response, and the case file and finds that it has no authority over Petitioner’s appeal. A protest to the March BOR is a prerequisite to invoking the Tribunal’s jurisdiction over residential properties under MCL 205.735a. While a protest was filed with the March BOR in regard to Parcel No. 76-24-25-203-004, Respondent was unable to consider the protest and issue a final decision. The petition filed in this matter indicates that Petitioner is appealing the state equalized and taxable values for that same parcel of property, and the petition further indicates that the property is classified as residential. Petitioner contends that the Tribunal has the power to order an amended petition to correct the parcel number. However, the Tribunal only has such power in matters in which it has jurisdiction.1 In this case, the March BOR did not issue a decision relative to either parcel and as such, the Tribunal lacks jurisdiction to hear Petitioner’s appeal. Petitioner also contends that the BOR should have considered the petition despite the typographical error. The Michigan Supreme Court recently reaffirmed that the Tribunal lacks any equitable authority to assume jurisdiction in cases presenting potential due- 1 MCL 205.732(c).

Further, and as a result of the foregoing, Respondent’s default shall be vacated. Therefore, IT IS ORDERED that the November 14, 2025 Order Holding Respondent in Default is VACATED. IT IS FURTHER ORDERED that Respondent’s Motion to Dismiss is GRANTED. This order resolves all pending claims in this matter and closes this case. APPEAL RIGHTS If you disagree with the final decision in this case, you may file a motion for reconsideration with the Tribunal or a claim of appeal with the Michigan Court of Appeals. A motion for reconsideration must be filed with the Tribunal with the required filing fee within 21 days from the date of entry of the final decision. Because the final decision closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing system; it must be filed by mail or personal service. The fee for the filing of such motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless the Small Claims decision relates to the valuation of property and the property had a principal residence exemption of at least 50% at the time the petition was filed or the decision relates to the grant or denial of a poverty or disabled veterans exemption and, if so, there is no filing fee. You are required to serve a copy of the motion on the opposing party by mail or personal service or by email if the opposing party agrees to electronic service, and proof demonstrating that service must be submitted with the

BE RECEIVED DEC 04 2025 STATE OF MICHIGAN "mH MICHIGAN TAX TRIBUNAL SMALL CLAIMS DIVISION Jamie Blumenthal Petitioner, MTT Docket No.: 25-003352 Parcel No.: 76-24-25-206-004 (Correct Parcel) Vs. City of Southfield, Respondent. Stephen Polter Justin Prybylski Polter Law Group Assessor, Southfield 2600 W Big Beaver, Ste L100 26000 Evergreen Rd. Troy, MI 48084 Southfield, MI 48076 248-213-6800 248-796-5240 Spolter@polterlaw.com iprybylski@cityofsouthfield.com PETITIONER’S RESPONSE IN OPPOSITION TO RESPONDENT’S MOTION TO DISMISS Petitioner, Jamie Blumenthal, through counsel, submits this Response opposing Respondent City of Southfield’s Motion to Dismiss. Respondent seeks dismissal solely on the basis that Petitioner’s original Small Claims petition referenced an incorrect parcel identification number differing by one digit from the correct parcel number. For the reasons set forth below, Respondent’s Motion should be denied, and this matter should proceed on the merits. I. INTRODUCTION Respondent’s Motion to Dismiss rests entirely on a minor clerical error in the Parcel Identification Number listed in Petitioner’s original filing. The correct parcel number is 76-24- 25-206-604, but the petition inadvertently listed 76-24-25-203-004. This error was purely
Page 2
IL STATEMENT OF FACTS 1. Petitioner timely filed a Small Claims petition challenging the assessment for the tax year at issue, as even Respondent, in its motion, concedes. 2. The petition clearly identified Petitioner by name and stated the basis for the assessment dispute. 3. Due to an inadvertent clerical mistake, the Parcel Identification Number was listed as 76- 24-25-203-004 instead of 76-24-25-206-004, differing by only one digit. 4. The City of Southfield was fully aware of the property owned by Petitioner and the subject of the assessment challenge, as the Petitioner owns only one parcel within the city under their name. 5. Respondent has alleged no prejudice, confusion, or inability to identify the correct parcel. 6. Respondent moves for dismissal solely based on this single-digit error in the P.LN, II. ARGUMENT A. The Petition Substantially Complied with MTT Filing Requirements Michigan jurisprudence distinguishes between “mandatory” requirements and “directory” or procedural requirements. Minor clerical defects—particularly those not affecting substantive rights—do not deprive the Tribunal of jurisdiction. The Tribunal has repeatedly recognized that substantial compliance is sufficient where the petition clearly identifies the taxpayer, the nature of the appeal, and the intended property. A one-digit error in the parcel number does not defeat substantial compliance, particularly where Respondent had no difficulty identifying the Petitioner or the nature of the appeal. B. The Tribunal Has Authority to Allow Amendments and Correct Non-Jurisdictional Defects Under the Tribunal’s Rules of Practice (including MTTR 215 for Small Claims matters), the Tribunal may accept amendments that correct clerical or technical defects. Such authority routinely applies to: + Incorrect parcel numbers
Page 3
Petitioner respectfully requests that the Tribunal accept the corrected parcel number 76-24-25- - 206-004 as an amendment nunc pro tunc. C. Respondent Suffered No Prejudice and Had Actual Notice of the Appeal Dismissal is inappropriate when: 1. Respondent was not misled, 2. Respondent could easily determine the subject property, and 3. No prejudice resulted. All three conditions are met here: + Petitioner owns only one residential property in Southfield with this parcel number. «The City’s assessor’s office could immediately identify the correct parcel associated with Petitioner’s name. « Respondent articulates no harm, confusion, or inability to prepare its defense. Case law and Tribunal practice both support the principle that actual notice cures technical defects. D. Dismissal Would Result in an Unjust Forfeiture of Petitioner's Statutory Right to Appeal Michigan law strongly favors allowing taxpayers to have their assessments heard on the merits. Dismissing an appeal due to an immaterial clerical defect would produce an inequitable outcome inconsistent with the intent of the property tax appeal process. The Tribunal, sitting in equity, should avoid a result that denies Petitioner access to review merely because of a harmless typographical error. IV. CONCLUSION For the foregoing reasons, Petitioner respectfully requests that the Tribunal: 1. DENY Respondent’s Motion to Dismiss; 2. Accept the corrected

Alternate Dispute Resolution Options INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this case through an informal settlement conference. An informal settlement conference is a meeting between the parties and/or their representatives to discuss the issues in a case in an effort to settle the case. This process may be an alternative to a hearing with a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent Judgment. Visit the Tribunal’s ADR webpage for more information. NOTE: The parties may not request an informal settlement conference to discuss an appeal of a principal residence exemption that was denied by either the Michigan Department of Treasury or a County. Also, state taxes levied by the Michigan Department of Treasury, such as income taxes, are not subject to the informal settlement conference process. MEDIATION: Parties have the option of handling this case through mediation. Mediation is a voluntary process where a mediator facilitates communication between the parties, assists in identifying issues, and helps explore solutions to promote a mutually acceptable settlement. This process may be an alternative to a hearing with a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent Judgment. Visit the Tribunal’s ADR webpage for more information. If you have any questions, please contact the Tribunal by phone at (517) 335-9760 or email

SXM LLC, 2D2M LLC (25-002623/2701) corrected severed petition, pursuant to Otdet of Default (enclosed). Cured. Tribunal also appears to require Petitioner to remit separate $125 payment for ostensible separate severed petition/parcel, however, see enclosed proof of original payment(s) with original petition submission on or about May 27, 2025. You'll notice that although I may have erroneously filed as multi contiguous parcel (now corrected), I did not merely remit $125 + $25 pursuant to MTT Rules, but rather in fee remittance I treated these as two separate submissions and in fact paid 2 x $125. Therefore, the Tribunal’s order including the fee requirement should be reconsidered and rendered moot, as the at least the fees were originally propertly remitted. If, however, Tribunal is still unconvinced, I would appreciate it stating/noticing along with its basis therefor and allowing Petitioner an additional fourteen (“14”) days within which to cure/remit same.
