ORDER DENYING PETITIONER’S MOTION TO HOLD CASE IN ABEYANCE

ORDER OF DISMISSAL

On June 30, 2026, Petitioner filed a motion requesting that the Tribunal hold this case in

abeyance pending resolution of Docket No. 25-003802 and 26-000133, which are

currently pending before the Tribunal.1 In the motion, Petitioner states that the parties

and property at issue in the cases are the same, and resolution of Docket No. 25-

003802 and 26-000133 will most likely help resolve this case.

On July 21, 2025, Respondent filed a response to the motion. In the response,

Respondent states that this appeal pertains to alleged arithmetic errors or mistakes in

the 2024 and 2025 tax bills and Petitioner failed to state or provide any explanation as

to how a Final Opinion and Judgment in Docket no. 25-003802, which involves a State

Tax Commission (STC) determination of omitted property for the 2020-2022 tax years,

will resolve this case.

The Tribunal has considered the motion, the response, and the case file and finds that

the petition filed in this case states that “this appeal is limited solely to correcting

arithmetic errors or mistakes in the Contested Tax Bills and is not a valuation appeal,”

but goes on to state that “the Contested Tax Bills indicate mistaken calculations of

taxable value for the subject property of $14,442,223 for 2024 and $14,889,932 for

2025.” Thus, despite Petitioner’s attempt to frame the issue in this case as an appeal of

a contested tax bill, it is evident that it is actually disputing Respondent’s taxable value

(TV) calculation for the 2024 and 2025 tax year, which is plainly a valuation issue.

MCL 205.735a(6) specifically states that “an appeal of a contested tax bill . . . is limited

solely to correcting arithmetic errors or mistakes and is not a basis of appeal as to

disputes of valuation of the property, the property's exempt status, or the property's

equalized value resulting from equalization of its assessment by the county board of

1 Petitioner erroneously references the instant docket in paragraphs 5 through 8 and 10 of its motion, and

appears to be referring to Docket No. 26-000958, which is a pending valuation appeal for the subject

property for the 2026 tax year.

commissioners or the state tax commission.”2 Further, the documentation submitted

with the petition, which includes correspondence from the Oakland County Treasurer

dated December 19, 2025, indicates that the revised values are not the result of an

“arithmetic error or mistake.” Rather, the December Board of Review changed the

property’s values on December 9, 2025, which change resulted in issuance of the

revised tax bills in dispute. The change is likely the result of the State Tax Commission

Order referenced in Docket No. 25-003802, as per that order, the property’s 2022 TV

was increased to $13,099,522, which would result in revised TVs as follows:

$13,754,488 for 2023, $14,442,212 for 2024, and $14,889,920 for 2025.

Though the TVs listed in the tax bills for 2024 and 2025 differ slightly from those

calculated by the Tribunal for purposes of this order, Petitioner cannot collaterally attack

the December BOR decision by way of a

RESPONDENT’S RESPONSE TO PETITIONER’S

MOTION TO HOLD CASE IN ABEYANCE

Respondent, City of Southfield, by and through its attorneys, Hallahan & Associates, P.C.,

states the following in response to Petitioner’s Motion to Hold Case in Abeyance:

1.

Respondent admits the allegations in Paragraph 1 as to subject parcel and parcel

location. Respondent denies the remainder of the allegations set forth in Paragraph 1 for the reason

that the same are untrue. Per Petitioner’s Petition, only the 2024 and 2025 tax years are identified

to be at issue and the above captioned appeal was “limited solely to correcting arithmetic errors or

mistakes in the Contested Tax Bills and is not a valuation appeal.”1

1 Petitioner’s Petition at Paragraphs 16 & 18.

Page 2

2

2.

Respondent neither admits nor denies the allegations in Paragraph 2 as MTT docket

nos. 25-003802 and 26-000133 speak for themselves.

3.

Respondent neither admits nor denies the allegations in Paragraph 2 as MTT docket

nos. 25-003802 and 26-000133 speak for themselves.

4.

Respondent neither admits nor denies the allegations in Paragraph 4 as the

Prehearing General Call and Order of Procedure speaks for itself.

5.

Respondent neither admits nor denies the allegations in Paragraph 5 as MTT docket

nos. 25-003802 and 26-000133 speak for themselves.

6.

Respondent admits that a Final Opinion and Judgment in the above captioned

appeal would resolve the above captioned appeal (subject to any appellate proceedings).

Respondent denies that the issuance of a Final Opinion and Judgment in MTT 25-003802 is likely

to resolve the above captioned appeal or the parties’ desire to proceed with the above captioned

appeal as said matters pertain to not only different tax years but claims. Nor does the above

captioned appeal concern a sequential tax year. MTT docket no. 25-003802 pertains to an appeal

of the State Tax Commission’s (hereinafter STC) determination that certain property had been

omitted from the subject property’s 2020-2022 assessments. As noted above, the above captioned

appeal pertains to alleged “arithmetic errors or mistakes” in the subject property’s 2024-2025 tax

bills. Petitioner has failed to state or provide any explanation as to how a Final Opinion and

Judgment in MTT docket no. 25-003802 will help the parties reach a resolution regarding the

alleged arithmetic errors in the subject property’s 2024-2025 tax bills denoted to be at issue in the

above captioned appeal.

7.

Respondent denies the allegations in Paragraph 7 for the reasons set forth above.

Page 3

3

8.

Respondent denies the allegations in Paragraph 8 for the reasons set forth above.

To the contrary, holding the above captioned appeal in abeyance pending a case that—based on

the claims set forth in Petitioner’s Petitions—bears no relevancy to the above captioned appeal

will only cause unreasonable and substantial delay to the above captioned appeal.

9.

Respondent admits

Motion to Hold Case in Abeyance

Petitioner, by and through its counsel, states the following in support of its Motion to Hold

Case in Abeyance:

1.

This case concerns the tax year 2026 valuation and assessment of real property

parcel no. 76-24-20-326-228, located in Southfield in Oakland County, Michigan.

2.

There are two cases currently pending before the Tax Tribunal regarding the subject

property’s assessed and taxable values for tax years 2020, 2021, 2022 (MTT Docket No. 25-

003802-TT) and tax years 2024 and 2025 (MTT Docket No. 26-000133-TT).

3.

The parties and subject property in this case are identical to those at issue in Docket

Nos. 25-003802 and 26-000133.

Page 2

2

76035665.1

4.

This case has been placed on the May 17-28, 2027 Prehearing General Call

and Order of Procedure, with valuation disclosures and prehearing statements scheduled to

be exchanged on January 19, 2027.

5.

However, as of the filing of this Motion, the litigation in Docket Nos. 25-003802

and 26-000133 has only just begun, with discovery still open, motions for summary disposition

not filed, and valuation disclosures and prehearing statements not exchanged yet.

6.

The resolution of Docket Nos. 25-003802 and 26-000133 will most likely help

resolve this case; Final Opinions and Judgments from the Tribunal in Docket Nos. 25-003802 and

26-000133 could impact this case and the parties’ desire to proceed with this case.

7.

Thus, it could potentially be a waste of the Tax Tribunal’s and parties’ time and

resources to proceed with this case when Docket Nos. 25-003802 and 26-000133 remain pending.

8.

To proceed with this case before a resolution regarding Docket Nos. 25-003802 and

26-000133 have been reached would likely not constitute an efficient administration of justice.

9.

Proceeding with this case will require the parties and the Tribunal to expend

substantial resources which may ultimately be unnecessary. Placing this case in abeyance at this

juncture before substantial time and resources have been spent - including, but not limited to, the

preparation of prehearing statements and valuation disclosures - is in the interest of efficiency to

all parties involved and judicial economy.

10.

As evidenced above, there is good cause for granting this Motion to hold this case

in abeyance pending the resolution of Docket Nos. 25-003802 and 26-000133.

WHEREFORE, Petitioner respectfully requests the Tribunal grant this motion and enter an

Order holding this case in abeyance pending the resolution of Docket Nos. 25-003802 and 26-

000133.

Petition

Petitioner, Denso International America, Inc. (“Denso”), by and through its attorneys,

Honigman LLP, for its Petition against Respondent, City of Southfield, states as follows:

1.

Southfield, MI 48033.

2.

The subject real property, parcel no. 76-24-20-326-228, is located at 24777 Denso

Drive, Southfield, MI 48033 in Oakland County (“subject property”).

3.

Denso, an automotive parts manufacturer with a global presence, has used the

subject property directly off Telegraph Road near I-696 as its technical campus since purchasing

it in 2005.

4.

Denso is a party in interest under MCL 205.735a as Denso owns the subject

property and is the taxpayer responsible for property tax assessments on the subject property.

5.

The subject property is classified commercial-improved.

6.

The subject property is presently used for commercial uses.

7.

On information and belief, the subject property was designed for commercial uses.

8.

The subject property is in the Southfield Public School District and Oakland County

Intermediate School District.

9.

Respondent City of Southfield assesses and collects property taxes on the subject

property.

10.

This matter involves issues relating to tax bill calculation mistakes only.

11.

There was no transfer of ownership.

12.

There was no addition.

13.

There was no new construction.

14.

There was no omitted property.

15.

There was no previously exempt property.

16.

The calculations in the tax bills for tax years 2024 and 2025 accordingly appear to

be based on mistakes. (The “Contested Tax Bills” are attached as Appendix A.)

17.

This contested tax bill appeal is filed within 60 days of the dates reflected on the

tax bills, December 17, 2025, December 19, 2025, and December 22, 2025. Appendix A.

18.

This appeal is limited solely to correcting arithmetic errors or mistakes in the

Contested Tax Bills and is not a valuation appeal.

19.

The Tax Tribunal’s jurisdiction is invoked under MCL 205.735a(6).

20.

The original taxable values for the subject property were $11,565,421 for 2024 and

$11,923,549 for 2025.

Page 3

3

63610163.1

21.

The Contested Tax Bills indicate mistaken calculations of taxable value for the

subject property of $14,442,223 for 2024 and $14,889,932 for 2025.

22.

The mistaken calculations of taxable value for 2024 and 2025 in the Contested Tax

Bills result in mistaken calculations of property tax and interest.

23.

The mistakes result in unlawful double taxation of property that was already

subjected to taxation in tax year 2024 and 2025.

24.

The taxable value amounts in contention are $2,876,802 for tax year 2024 and

$2,966,383 for tax year 2025.

25.

The Tax Tribunal has “exclusive and original” jurisdiction over “a proceeding for

direct review of a final decision, finding, ruling, determination, or order of an agency relating to

assessment, valuation, rates, special assessments, allocation, or equalization, under the property

tax laws of this state.” MCL 205.731(a).

The Tribunal may review the subject property’s taxable value calculations de novo.
