Christine L Metsger,

Petitioner, MICHIGAN TAX TRIBUNAL

 SMALL CLAIMS DIVISION

v

 MTT Docket No. 25-003846

Township Of Bear Lake,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

Petitioner failed to protest the assessment to Respondent’s March Board of Review, as

required by MCL 205.735a. As such, and inasmuch as the Tribunal has no equitable

power to waive or otherwise disregard statutory filing requirements and deadlines, it has

no authority to hear the appeal or grant the relief requested. See Sixarp, LLC v Byron

Twp, __Mich__; __NW3d__ (2025).

Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Section 5: Explain the Reason for this Appeal

| purchased the subject property in the spring of 2023. My loan required that, in addition to the principal and interest, my taxes and

insurance would be escrowed by the lender. This additional amount was added to my monthly mortgage payment, to be dispensed,

when due, by the morigage company. Since purchasing the above referenced property,

1 have not personally paid either property

taxes or insurance because of this arrangement.

| was unaware that the valuation of my properly had been increased until

| received notification in October 2025 from LoanCare (the

mortgage company) that my monthly payment had been increased from $855.80 to $1,116.30. This increase is catastrophic for me,

as

1 rely solely on my Social Security benefits of $2,039. per month to cover all costs of living.

| spoke today with Molly Whetstone and she was very helpful in explaining to me that | should have received notice that my properly

had been reassed. To my knowledge,

| did not receive such notice. As stated above,

was unaware of this change uniil

| was

advised of it by my lender.

The house at 12150 Lynn St., Bear Lake, that | purchased and five in is a 127-year-old structure that was used for many years by

previous owners as a rental.

| chose this house because it was the only property

| could afford after my husband died on March 31,

2023. As with most older homes, It has a lot of defered maintenance that

| am attempting to address as

| can afford to do so. It is not

la showplace, to say the least.

| have been very careful to budget for my expenses, as there is no wiggle room to be cavalier with my

income. This unexpected addition to my monthly expenses will put me ina position where

1 must cut almost all of my $300 per month

food budget to comply with this increase to the property tax.

Thank you for your time and attention to this matter.
