Motion to Withdraw as Attorneys for Petitioner

Williams Williams Rattner & Plunkett, PC (“WWRP”), states as follows for its Motion to

Withdraw as Attorneys for Petitioner.

1.

During January 2026, WWRP entered its Appearance as attorneys for Petitioner.

Since that time, there has been a breakdown in the attorney-client relationship. Petitioner has been

non-responsive to WWRP. Also, Petitioner has failed in other obligations to WWRP.

Accordingly, WWRP cannot effectively represent Petitioner. These factors establish good cause

for WWRP to withdraw as Petitioner’s attorneys.

2.

WWRP’s withdrawal will not adversely affect Petitioner. The Tribunal recently

placed this appeal in abeyance. Petitioner has ample time to secure new counsel before it must

comply with any deadlines.

Page 2

2

3.

Petitioner has been advised that WWRP’s withdrawal was forthcoming and is being

served with this Motion, as demonstrated in the concurrently-filed Proof of Service.

WHEREFORE, WWRP respectfully requests that this honorable Tribunal enter an Order

granting WWRP’s request to withdraw as counsel for Petitioner.

MOTION TO HOLD APPEAL IN ABEYANCE PENDING

MTT DOCKET NO. 24-002240

Respondent, Clinton Township, by and through its counsel, states the following in support

of the above captioned Motions:

1.

The 2024 appeal of the parcel involved in this case, 16-11-01-126-010, is currently

pending before the Tribunal under Docket 24-002240. In that case, the parties submitted valuation

disclosures on August 4, 2025 and the hearing dates are set for March 16-17, 2026. Accordingly,

a Final Opinion and Judgment will likely not be rendered before Summer 2026 at the earliest.

2.

This case, involving the same parcels, arose out of a motion to amend the 2025 tax

year filed on May 29, 2025. The Order Granting Petitioner’s Motion to Amend, Severing 2025

Tax Year and Assigning it to Docket 25-002524 was entered on June 25, 2025.

Page 2

2

3.

This case is ready to be placed on a Prehearing General Call that will set the date

for the submission of Prehearing Statements and Valuation Disclosures.

4.

As such, it is functionally impossible for the 2024 iteration of the case to be resolved

prior to the date for the submission of prehearing statements and valuation disclosures in this

matter.1

5.

In light of the above, good cause exists to hold this case in abeyance pending the

outcome of the 2024 case. This is for several reasons. First, any reduction in value achieved in the

2024 appeal will carry forward to this case as there was no uncapping event relative to the 2025

tax year. Proceeding with subsequent years appeals when any TV reduction would carry forward

is not in the interest of the efficient administration of justice. Second, the existing dates in both

cases make it such that they will proceed at the same time, in different stages, overlapping only as

to the parcels at issue.2 That will burden both the parties as to the administration of the case and

the Tribunal as to overseeing consecutive appeals. That is not in the interest of the efficient

administration of justice.

6.

There is also no good cause to combine the cases. While Petitioner chose to appraise

the 2025 tax year in its submission in the 2024 case, no motion to consolidate, or to otherwise hear

the cases together has been filed. As there was only one tax year in the 2024 case Respondent

limited its discovery to the year at issue, and not the 2025 tax year. Moreover, combining the cases

at this sense will not result

ORDER GRANTING RESPONDENT’S MOTION TO HOLD CASE IN ABEYANCE

On December 19, 2025, Respondent filed a motion requesting that the Tribunal hold

this case in abeyance pending resolution of MTT Docket No. 24-002240, which is

currently pending before the Entire Tribunal division.1 In the motion, Respondent states

that resolution of the 2024 appeal concerning the same parcel and legal issues prior to

adjudicating this case shall assist the efficient administration of justice. Respondent

states that the hearing in the prior case is scheduled for March 2026.

Petitioner has not filed a response to the motion.

The Tribunal has considered the motion and the case file and finds that Respondent

has shown good cause to grant the motion. Placing this case in abeyance pending

resolution of Docket No. 24-002240 will facilitate the efficient administration of justice,

as that resolution may have a direct bearing on the outcome of the instant appeal.

Therefore,

IT IS ORDERED that Respondent’s Motion to Hold Case in Abeyance is GRANTED.

IT IS FURTHER ORDERED that the parties shall notify the Tribunal in writing within 28

days of the final resolution of Docket No. 24-002240 as to the need for further

proceedings in this matter.

ORDER HOLDING PETITIONER IN DEFAULT

The Tribunal has reviewed the file in this case and finds that the Tribunal entered an

order severing the 2025 tax year from Docket No. 24-002240 on June 25, 2025. The

order required Petitioner to file a petition for the 2025 tax year within 21 days of entry of

the order. Petitioner has had ample time to comply but has failed to respond or file the

required petition. Petitioner is subject to default as a result, and its failure to comply

with Tribunal orders and rules has established a history of deliberate delay that would

justify the dismissal of this case for failure to timely comply with this order.1 Therefore,

IT IS ORDERED that Petitioner is held in DEFAULT.

IT IS FURTHER ORDERED that Petitioner must file a petition pertaining to the 2025 tax

year within 14 days of entry of this order. The petition shall note the docket number

assigned by the Tribunal for the 2025 tax year and if filed utilizing the Tribunal’s e-filing

system, must be filed on the assigned 2025 docket number as a “Severed Petition.”

Failure to comply with this order will result in the dismissal of this case.

ORDER GRANTING PETITIONER’S MOTION TO AMEND

ORDER SEVERING 2025 TAX YEAR AND ASSIGNING IT

DOCKET NUMBER 25-002524

On May 29, 2025, Petitioner filed a motion requesting that the Tribunal permit it to

amend the petition filed in this case to include the 2025 tax year.

On June 19, 2025, Respondent filed a response in opposition to the motion. In the

response, Respondent states that valuation disclosures and prehearing statements are

scheduled to be exchanged on August 4, 2025, and that this does not allow “sufficient

time for Respondent to conduct discovery or prepare a valuation disclosure relevant to
