ORDER GRANTING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

CONSENT JUDGMENT

The Tribunal has reviewed the Stipulation and finds that it comports with the mandates

of State law.1 As a result, the Tribunal shall enter the parties’ Stipulation. Therefore,

otherwise indicated, bear interest from the date of payment to the date of judgment and

the judgment shall bear interest to the date of its payment. A sum determined by the

 MTT Docket No. 24-004105

Township Of Prairieville,

ORDER DENYING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

The Tribunal has reviewed the case file and the stipulation, filed on December 11, 2024,

and finds that: a consent judgment can only be entered if a stipulation is filed after the

filing of a petition and answer. See TTR 249 and 281. Because no answer has been

filed in this case, the stipulation cannot be entered at this time and must be denied.

IT IS ORDERED that the Parties’ Joint Stipulation for Entry of Consent Judgment is

DENIED.

IT IS FURTHER ORDERED that a hearing in this case shall be scheduled in the normal

course.

IT IS FURTHER ORDERED that because this Stipulation for Entry of Consent

Judgment is no longer pending before the Tribunal, a new stipulation is required for any

future settlement. However, if the new stipulation is filed within 14 days of the issuance

of this Order, no additional filing fee is required.

MTT Docket No. 24-004105

ORDER OF PARTIAL DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that Petitioner

is appealing assessments for future tax years. The Tribunal has no authority to

consider assessments until they have been established by the March Board of Review

and assessments for future tax years have not yet been established. Therefore,

IT IS ORDERED that Petitioner’s assessment appeal is PARTIALLY DISMISSED. The

appeal shall continue for the 2024 tax year(s) only.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Re:

Taxable Value Uncapping for 2024 for Parcel 12-490-011-00 & 12-490-011-10

To whom it concerns,

The intent of this letter is fo serve notice that the taxable value (TV) is being uncapped for the referenced parcel as a result

of a lady bird deed dated May 18, 2023 that was triggered as a result of the passing away of the owner on December 15,

2023 and a Property Transfer Affidavit not being filed to alert the assessor of the transfer of the remainder. The result of

this action is a transfer of ownership and therefore results in the TV uncapping for the year following transfer (2024) in

this case. There are affidavits enclosed to this effect.

If you disagree with this decision, appeals need to be filed within 35 days of receiving this letter and are limited to

whether or not a transfer occurred and the uncapping valid — valuations arguments will not be heard. Appeal forms are

available at: http:/www.michigan.gov/taxtrib/0.4677.7-187-38254---.00.html, and need to be directed to:

Michigan Tax Tribunal

Po Box 30232

Lansing, MI 48909
