ORDER GRANTING PETITIONER’S MOTION FOR RECONSIDERATION

CORRECTED ORDER OF DISMISSAL

On August 25, 2026, Petitioner filed a motion requesting that the Tribunal reconsider the

Order of Dismissal entered in this case on August 11, 2026. In the motion, Petitioner

states that the dismissal of this case as a duplicate appeal of MTT Docket No. 26-

001370 was in error. MTT Docket No. 26-001370 involves the valuation of the subject

property; however, this appeal is regarding the classification of the subject property.

The Tribunal has considered the motion and the case file and finds that Petitioner has

demonstrated a palpable error relative to the Order of Dismissal that misled the Tribunal

and the parties and that would have resulted in a different disposition if the error was

corrected.1 Specifically, MTT Docket No. 26-001370 and this case, while involving the

same subject property, address distinctly different legal issues and thus are not

duplicative in nature.

However, it is well established that the Tribunal has no authority over classification

appeals, which are within the jurisdiction of the State Tax Commission pursuant to MCL

211.34c(6).2 As such, the Tribunal finds that dismissal of this case remains appropriate

given the lack of jurisdiction over this matter.

Therefore,

IT IS ORDERED that Petitioner’s Motion for Reconsideration is GRANTED.

IT IS FURTHER ORDERED that the Order of Dismissal is CORRECTED.

 MTT Docket No. 26-001372

Township Of Cohoctah,

ORDER OF DISMISSAL

The Tribunal has considered the file in this case and finds that:

The issue in this case is already pending in another case and, as such, this appeal is

duplicative and shall be dismissed.

Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

Page 2

MTT Docket No. 26-001372

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Cohoctah Township Board of Review

10518 Antcliff Road

Fowlerville, MI 48836

Re: Appeal of Taxable/Assessed Value and Tax Classification

Property Address: 7260 Owosso Road, Fowlerville, M1 48836

Parcel ID: 4702-30-300-013

Dear Members of the Board of Review,

| am writing to formally appeal the 2026 assessed and taxable value along with the property tax

classification of commercial assigned to the property located at 7260 Owosso Road, Fowlerville.

According to the assessment notice, the property's assessed and taxable value is listed as $159,400,

implying a True Cash Value of approximately $318,800 under Michigan's 50% assessment standard.

The property was purchased on May 16, 2024, for $125,000. Because this purchase occurred recently

and reflects open market conditions, it provides a reliable indication of the property’s True Cash Value.

Based on this purchase price, the appraisal and signed consent judgment dated 9/8/2025 the true cash

value should reflect $125,000. To support this appeal,

| have attached the transfer affidavit, appraisal and

signed consent judgment.

In addition, the property is currently zoned residential but tax as commercial.

The tax classification should reflect the current zoning classification.

Under Michigan law (MCL 211.27a) and Board of Review guidelines, the Board must consider all

available evidence of market value, including comparable sales, when determining the True Cash Value

of property. Recent sales of similar properties in the neighborhood support a lower valuation than

currently assessed.

For these reasons, we respectfully request that the Board of Review adjust the assessed value of the

property to $62,500, reflecting a True Cash Value of approximately $125,000, consistent with market

conditions and already agreed to by the consent judgment dated 9/8/2025.

Thank you for your time and consideration of this appeal. Please feel free to contact us if additional

information is needed.

Sincerely,

7

Sincerely,

7
