STATE OF MICHIGAN MICHIGAN TAX TRIBUNAL Milgrom Revocable Living Trust, MTT Docket No. 26-002914 Petitioner, v City of Huntington Woods, Respondent. ATTACHMENT TO RESPONDENT'S ENTIRE TRIBUNAL PROPERTY TAX ANSWER 22. Affirmative Defenses and Supporting Facts Respondent was not properly served with the Petition bearing the assigned docket number as required by TTR 235(1). The Petition was received by the Tribunal on July 30, 2026, without a docket number. A Proof of Service bearing the docket number was subsequently filed on August 7, 2026; however, the Tribunal's Notice of Docket Number was not issued until September 24, 2026. That Notice specifically provides that the docket number must be noted on the Petition and that the Petition must be served with the noted docket number, even if previously served, and further provides that Respondent's 28-day period to answer runs from the date of service of the Petition with the noted docket number. Respondent was nevertheless placed in default by Order issued September 30, 2026. Respondent has now filed its Answer and respectfully requests that the default be set aside. Respondent further asserts that this matter is appropriate for transfer to the Small Claims Division. The appeal concerns a single residential parcel and Petitioner’s challenge to the property’s 2026 true cash value, assessed/state equalized value, and taxable value. Respondent respectfully requests that the Tribunal transfer this matter to the Small Claims Division for further proceedings. WHEREFORE, Respondent respectfully requests that the Tribunal affirm the 2026 assessment as determined by Respondent, deny Petitioner’s requested relief; set aside Respondent’s default, transfer this matter to the Small Claims Division, and grant such other and further relief as the Tribunal deems just and appropriate.
