MICHIGAN Tax TRIBUNAL

11-11-2024

In tight of new evidence,

| wish to withdraw my complaint in docket number 24-0035365-TT

In the case of Benjamin Evans Petitioner v Township of Richmond Respondent.

Unfortunately, on the notice 2024 Board of review decision, note of how to file an appeat gave an

incorrect web address to the farm required for the appeal, of which forwards to a generic landing

page, which causes me to incorrectly chose the form. After doing research when receiving the

Townships reply,

| have since located the correct form and will be re-filing the case to keep it moving

forward to correct the gross error asserted by the township

Sincerely

We

Guidance regarding Form 1019,

Notice of Assessment, Taxable Valuation, and Property Classification

Not less than 14 days before the first meeting of the Board of Review, the assessment notice shall be mailed to the property owner.

Property taxes are calculated based on the Taxable Value (Line 1). State Equalized Value is the Assessed Value multiplied by the

Equalization Factor, if any. State Equalized Value must approximate 50% of market value.

The Taxable Value number entered in the “Change from Prior Year to Current Year” Column, does not indicate a change in your taxes.

The change in your tax bill is estimated above Line 1.

State Equalized Value is the Assessed Value multiplied by the Equalization Factor, if any. State Equalized Value must approximate 50%

of market value.

IF THERE WAS A TRANSFER OF OWNERSHIP on your property in 2022, your 2023 Taxable Value will be the same as your 2023 State

Equalized Value.

IF THERE WAS NOT A TRANSFER OF OWNERSHIP on your property in 2022, your 2023 Taxable Value is calculated by multiplying

your 2022 Taxable Value by 1.05 (Inflation Rate Multiplier for the current year). Physical changes in your property may also increase or

decrease you Taxable Value. Your 2023 Taxable Value cannot be higher than your 2023 State Equalized Value.

The Taxable Value, the Assessed Value, the State Equalized Value, the Property Classification, or the Transfer of Ownership may

be appealed by filing a protest with the Local Board of Review. Protests are made to the Board of Review by completing a Board

of Review Petition Form. A Petition Form may be obtained directly from the local unit or from the Michigan Department of

Treasury's website at www.michigan.gov/taxes. Click on the “Property Taxes” box, select “Forms and Instructions,” then click

on “Board of Review" to obtain a “Petition to the Board of Review,” Form 618 (L.-4035).

The denial of an exemption from the local school operating tax for “qualified agricultural properties” may be appealed to the local Board of

Review. The denial of an exemption from the local school operating tax for a “homeowner's principal residence” may be appealed to the

Michigan Tax Tribunal by the filing of a petition within 35 days of issuance of this notice. The petition must be a form approved by the

Michigan Tax Tribunal, which are available at www.michigan.gov/ taxtrib.

Filing a protest with the Board of Review is necessary to protect your right to further appeal valuation and exemption disputes to the

Michigan Tax Tribunal and classification appeals to the State Tax Commission. Properties classified Commercial Real, Industrial Real or

Developmental Real may be appealed to the regular March Board of Review or to the Michigan Tax Tribunal by filing a petition by May

31. Commercial Personal, Industrial Personal, or Utility Personal Property may be appealed to the regular March Board of Review or to

the Michigan Tax Tribunal by filing a petition by May 31

if a personal property statement was filed with the local unit prior to the

commencement of the Board of Review as provided by MCL 211.19, except as otherwise provided by MCL 211.9m, 211.9n and 211.80.

The petition must be a form approved by the Michigan Tax Tribunal, which are available at www.michigan.gov/taxtrib.

To claim a PRE, complete the “Principal Residence Exemption Affidavit” (Form 2368) and file it with your township or city of the year of

the claim. A valid affidavit filed on or before June

1 allows an owner to receive a PRE on the current year summer and winter tax levy and

subsequent tax levies so long as it remains the owner's principal residence. A valid affidavit filed after June

1 and on or before. November

1 allows an owner to receive a PRE on the current winter tax levy and subsequent tax levies so long as it remains the owner's principal

residence.

Section 5: Explain the Reason for this Appeal

The township assessor violated MCL 211 in ber assessment of the properly. She failed to establish multiple

neighborhoods

as required under the Michigan state tax

[commission guidelines. The Michigan state tax commission guidelines specifically state that neighborhoods of properies of similar value and conditions need to be established

to create economical corrections factors that represent accurate true cash values of the properties she was assessing.

The township assessor instead lumped the entire township of 55.8 square miles into one sales study despite the township having drastically different conditions in the township.

The township assessor openly admitted during our phone conversation on March 5 to the tax rolls being inaccurate and a complate mess, and openly admitted that she failed to

do any properly inspections in the past year to correct the tax rolis. If you inspact the township assessor ECF analysis sheet for 2024, you will note that the majority of structures

are classilied as default, during our phone conversation she stated my property would be classified as custom 2-story premium. Which

| cannot say is true or false but would say

it is probable. However, if you research the vast majority of the default properties that also make up tie vast majority of the ECF calculation are single story antiquated

construction houses under 1000 square feet. Which all would have different purchasing demographics and different market conditions than the property

| have.

The inaccuracies in the tax rolis, and the not using muliiple sales studies that reflected the different classes of house caused the township assessor to develop an economical

correction factor (ECF) unrealistic for my property. This is easily demonstrated by looking at her own sales study used to develop the EGF she used for the entire lownship, Her

ECF was 1.409, if you separate her sales study and only look at properties under 100,000 dollars it would create an ECF of 1.251. Looking at all properties above 250,000

doliars the ECF drastically decreases to 1.077 and if you further look at only 400,000 dollars and above it further decreases it to 0.93. Which literate the drastic differences in

the market that was ignored by the township assessor in the execution of her duties.

Furthermore, if you look at the math on her appraisal of my properly it also doesn't make sense. She stated both my taxable and assessed value of the property was 354,800

which would put my true cash value as 709,800. However, her depreciated appraisal of my properly was 432,673. So, if you look a! 432,673x1.408 it gives you a value of

609,636.26 which is 99,963.33 dollars less than whal her numbers show as my true cash value. So, some ware outside of her own calculation of my appraisal of the property

she is adding just shy of 100,000 dollars to the true cash value of the property.

[Adding to the discrepancy, the property has sold 2 times in the past 18 months of the township assessors

evatuation of the property.

In August 2023 the propery sold for

510,000 dollars at an arm's length sale, it sold in July of 2022 for 470,000 dofiars also arm's length sale. The veteran's administration as part of my foan did an actual property

inspaction and developed an appraisal of the property of 480,000 dollars using similar properties that sold in the area for comparison.

| find very unlikely that the average of

486,000 dollars of 3 different parties and the federal government appraisal would all be in the same spectrum, but the township assessor could ethically assume the true cash

value of the property to be 223,600 dollars greater ihan the value of the 4 separate parties ang their professional hired real-estate representation.
