2599, Page 2 INSTRUCTIONS Overview In addition to the Principal Residence Exemption from local school operating taxes, the legislature has passed a separate exemption for fannland. Some people may have to file this form in addition to their Principal Residence Exemption Affidavit, Read the instructions carefully to determine if you need to file this form. Do You Need To File? If your property is already exempt as a principal residence, you do not need to file this form, Ifyou own vacant land classified as agricultural, itis automatically exempt and you donot need to file a form to claim your exemption. If you have a residence or other buildings on the property, your assessor may ask you to complete this form to determine if all the property qualifies. Il your property is not classified agricultural, but more than 50 percent of the acreage is devoted to an agricultural use, you must file this form by May 1, to claim your exemption, Qualifications Only the owner can claim au exemption. An owner generally is the person who holds the legal title to the property. An owner includes the buyer on a land contract, the holder of a life lease and the grantor of property placed in a revocable trust or qualified personal residence trust (QPRT). An owner may be an individual, or a legal business entity of any type. For property classified agricultural, qualified agricultural property is: 1. vacant land; 2. all farm-related structures; Farm-related buildings do not include those used for commercial storage, commercial processing, commercial distribution, commercial marketing, commercial shipping, or any other commercial or industrial use, 3. any residences on the property if they are occupied by a person who is employed in or who is actively involved in the farming operation and who has not filed a Principal Residence Exemption Affidavit (Form 2368) for another residence. Property that is not classified as agricultural still qualifies for this exemption if more than 50 percent of the acreage is devoted to an agricultural use. "Agricultural use” means the production of plants and animals useful to humans, including (orages and sod crops; grains, feed crops, and field crops; dairy and dairy products; poultry and poultry products; livestock, including breeding and grazing of cattle, swine, captive cervidae, and Section 1. Identification Filea separate claim for each qualified parcel. Complete all items for the property that you wish to claim. If the farmland is located in a village, list the township where the farmland is located. Every township and city identifies parcels of property with a property identification number (PIN) that ranges from 10 to 25 numbers. It usually includes hyphens and sometimes includes letters. This number is on your tax bill and on your property tax assessment notice. Find this number and eater it in the spaces indicated. If you cannot find this number, call your township or city assessor. Your property number is vitall Without it your township or city cannot adjust your property taxes accurately. Section 2. Farmland Answer each question in section 2 as it relates to the parcel identified by the PIN in section I. Item 2a: If you answer "no," your property does not qualify and you do not need Lo file this form. Items 2b - 2d: If you answer "yes" to any of these questions. you must enter a percentage in section 3. Section 3. Multi-purpose Property You may claim an exemption only for the portion of taxes related to the property used for agricultural purposes. Compute your percentage as follows. Value of qualified agricultural property < 100 Value of total property Your local assessor can help you determine the percentage that qualifies. Appeals Your local assessor has the authority to approve or deny claims for farmland (Qualified Agricultural) exemptions. If you disagree with your assessor, you may appeal the decision to the local board of review. A board of review decision may be appealed to the Michigan Tax Tribunal. Interest and Penalty If it is determined that you made a claim for property that is not qualified agricultural lands, you will be subject to the additional

Andrew & Jen Schutte live on and actively manage a farm (AJS Farms) since 2020. To establish AJS Farms as an officially recognized and protected commercial farming operation by the state of Michigan, on December 19, 2023 an inspector from the Michigan Department of Agriculture and Rural Development (MDARD) evaluated AJS Farms, passing the farming operation on all points without issue. Exhibit 1 On 12/04/2023 Andrew & Jen Schutte purchased 11355 168th Ave, Grand Haven, MI 49417, this enabled us to establish another bee yard (commercial honey bee hive locations need to be at least two miles apart to prevent the bees from competing and ensure there's enough pollen in the area) in addition to creating another orchard of fruit trees (commonly planted near the bee hives). The necessary paperwork establishing the property as meeting the agricultural exemption requirements was filed before the May 1st deadline claiming agriculture exemption. Exhibits 2, 3 & 4 In 2024 the 100% agriculture exemption for the 2025 tax year was granted. The 2025 notice of assessment was received by mail and the agriculture exemption was removed, effective the 2026 tax year. Exhibit 5 After several email exchanges with Ashley Larrison, it was communicated the exemption was removed due to an Ottawa County audit, as honey bees were not explicitly cited in the definitions of MCL 324.36101 section 36101: (b) "Agricultural use" means the production of plants and animals useful to humans, including forages and sod crops; grains, feed crops, and field crops; dairy and dairy products; poultry and poultry products; livestock, including breeding and grazing of cattle, swine, captive cervidae, and similar animals; berries; herbs; flowers; seeds; grasses; nursery stock; fruits; vegetables; maple syrup production; Christmas trees; and other similar uses and activities. Key points: e The specified qualification is “plants and animals useful to humans”, per the MDARD AJS Farms inspection report (Exhibit 1) honey bees (apiary) are a regulated farming activity under the states definition. e The list starts with “including” and provides a wide range of agriculture items e Elsewhere in Michigan law honeybees are included in the definition list under livestock, example is MCL - Section 286.905: (g) "Livestock" means any cattle, sheep, goat, swine, poultry, captive cervidae, ratites, or equine animals used for food, fiber, feed, or other agricultural based consumer products, wild or domesticated game, or other nonplant life including fish or bees. Additionally we added a chicken coop and chickens to the property to both expand our egg laying flock but also to ensure the requirement were more than satisfied as stated in Under MCL 211.7dd:
Page 10
Referencing the STATE TAX COMMISSION QUALIFIED AGRICULTURAL PROPERTY EXEMPTION GUIDELINES as provided by Ashley Larrison, it states: Q: How does Property Qualify for the Exemption? A: In order to qualify for the exemption, owners of parcels that are not classified agricultural must file an affidavit, Form 2599, claiming the exemption with the local assessor by May 1. An assessor will use the status of the land on May 1st in making their determination for qualification. In situations where the land may not be actively farmed on May 1, the parcel may still be eligible for the exemption. For example, the land may be intentionally left fallow or the growing season for a crop in some parts of the State may begin after May 1, etc. The fruit trees and chickens were present on May 1st (unsure if they were visible from the road), however the honeybees arrived on May 12th (they spend the winter months in Florida). In summary, based on my understanding of the law, the combination of commercially keeping honey bees, an orchard and keeping a flock of egg laying chickens, the property in question qualifies for the agriculture exemption, and should be granted for the 2026 tax year and persist while the qualified agricultural activities continue. Pictures of agriculture activities taking place at 11355 168th Ave, Grand Haven, MI 49417: 24 bee hives, each producing about 100 Ibs of honey in the ~8 months they are in Michigan

At the time of review on December 19, 2023, | was able to meet with Mr. Schutte and Ms. Steere of AJS Farms, LLC, and concluded that: e The Animal Care Plan written by AJS Farms, LLC, outlined appropriate practices regarding nutrition, transportation, environment, facilities and equipment, and health care and medical procedures for all equine located on the property. This plan was found to be in conformance with the management practices outlined in the Care of Farm Animals GAAMPs. o Additionally, | was able to observe that the horses on site had appropriate access to food, water, shelter, and area to exercise. Based on my review, this current livestock operation, is meeting and conforming to the details found in the Care of Farm Animals GAAMPs. Generally Accepted Agricultural and Management Practices for Farm Markets (commonly referred to as the Farm Markets GAAMPs). At the time of review on December 19, 2023, | was able to meet with Mr. Schuite and Ms. Steere of AJS Farms, LLC, and concluded that: + Per an email from Mr. Schutte on February 23, 2024, the transaction space utilized for the farm market on Mr. Schutte’s property is less than 120 ft? and, therefore, does not need to meet the 165 ft. setback distances from any non-farm residence. This was found to be in conformance with the setback distance outlined in the Farm Markets Generally Accepted Agricultural Management Practices (GAAMPs). « Additionally, an email sent from Mr. Schutte on February 13, 2024, stated that greater than 50% of the average gross sales of farm products sold (farm merchandise, honey, and eggs) were from the honey produced by seasonal honeybees on site and from eggs produced by the chickens on site. This also conforms with the Farm Markets GAAMPs. Based on my review, this current Farm Market, is meeting and conforming to the details found in the Farm Markets GAAMPs. ’ Based on the above review, this Farm Market is meeting the Care of Farm Animals and the Farm Markets GAAMPs at this time.

Under MCL 211.7dd, qualified agricultural property includes not only the property, but also related buildings on that property that are devoted primarily to agricultural use. A parcel of property is devoted primarily to agricultural use if more than 50% of its acreage is devoted to agricultural use. Additionally, “related buildings” include a residence occupied by a person actively involved in agricultural use and has not claimed a principal residence exemption on other property. MCL 324.36101 defines “agricultural use” as the production of plants and animals useful to humans. AJS Farms, LLC (“AJS”) is involved in the commercial honey and fruit business and is expanding its operations to the subject property (the “Property”™). AJS’s use of the Property for honeybees/honey harvesting and fruit trees/fruit harvesting constitutes an “agricultural use” under MCL 324.36101 as honey are fruit are useful to humans. Furthermore, 100% of the unoccupied portion of the Property is devoted primarily to the agricultural use as the honeybees’ foraging area extends at least two miles from their hive. The residence located on the Property also qualifies as agricultural property as a related building. The occupant is responsible for maintaining the grounds, including the fruit trees, which are used by the honeybees for foraging. The occupant also has not claimed a principal residence exemption on another property. As the residence is occupied by a person who is actively involved in agricultural use and who has not claimed a principal residence exemption on another property, the residence constitutes qualified agricultural property. In suminary, AJS is entitled to a 100% Qualified Agricultural Exemption because 100% of the acreage of the Property is primarily devoted to an agricultural use, and the residence is/will be occupied by a person(s) actively involved in that agricultural use and has not claimed a principal residence exemption on another property.
