ENTIRE TRIBUNAL SPECIAL ASSESSMENT PETITION Parcel No. 016-08-400-008-02 ATTACHMENT TO ENTIRE TRIBUNAL SPECIAL ASSESSMENT PETITION PROPERTY PARCEL NO. 016-08-400-008-02 Number 12 of Petition: Petitioner requests the following relief REQUESTED RELIEF WHEREFORE, Petitioner respectfully requests the following relief: 1. A fair and reasonable application of the Ambulance Assessment in relation to the benefit received, in this case the amount charged for the single parcel/unit Petitioner owns in Burns Township being $130 per year. That the special Ambulance Assessment be applied to Petitioner as the owner of a single parcel as it has historically been assessed, rather than the individual number of campsites which SSESA is clearly using as a money grab to try and shore up their own financial mismanagement. . In a letter dated September 11, 2025 from Kyle A. O’Meara, Senior Associate at Fahey Schultz Burzych Rhodes, to Tim DeLau, Board Chairperson of the Southwest Shiawassee Emergency Services Alliances (“SSESA™) he states “As you may recall, in 2023, SSESA asked the Township to voluntarily renegotiate its services agreement with SSESA to, among other things, adjust its unit charge criteria to charge campgrounds within the Township at half a unit per campsite. Prior to this service agreement adjustment, campgrounds would qualify as commercial property that would be charged a unit per five full (sic) full-time employees.” (Exhibit 2) This renegotiation clearly targeted campgrounds to saddle them with an unsustainable share of the Ambulance Assessment, without providing any additional benefit to the Parcel or Petitioner. The Petitioner has not had an ambulance called to its campground in the last two (2) years, however SSESA through its renegotiated contract with the Township (not with the Petitioner), as long as they are allowed to get away with this, would increase the Petitioner’s Ambulance
Page 4
ENTIRE TRIBUNAL SPECIAL ASSESSMENT PETITION Parcel No. 016-08-400-008-02 Agreement between Burns Township and SSESA dated March 1, 2021 (Exhibit 3), referring to a commercial property with fewer than 5 full-time employees. This adjustment would result in the petitioner's special assessment being $130.00, rather than $15,600.00 (approximately 7% of the entire township’s special Ambulance Assessment for a single parcel of property). 5. SSESA previously sent a Seasonal Campground Memo to Burns Township dated September 5, 2024 (“Seasonal Campground Memo”)(Exhibit 4). Page 2, paragraph 3 of the Seasonal Campground Memo states “When adopting a Special Assessment a municipality must balance the benefit and the burden so that a property remains in balance and not unfairly assessed compared to the benefit it receives.” In this case, there is no balance between the benefit and the burden and the Petitioner is clearly being unfairly assessed compared to the benefit received. The Petitioner’s Ambulance Assessment has increased nearly 12,000% however, the Petitioner and its parcel have received no benefit at all. There have been no ambulance runs to the Petitioner’s campground for the past two years and in prior years there have only been minimal ambulance runs to the campground. This is clearly an unfair assessment against the Petitioner’s parcel compared to the benefit received which is nothing. Petitioner should not be charged 12,000% higher than other property owners in the Township to cover SSESA’s costs. 6. That Petitioner recover its costs, including attorney fees and employee labor costs, incurred in obtaining this judgement. 7. That this Tribunal grant any other relief warranted by equity and good conscience. Number 13 of Petition: Specific facts upon which Petitioner relies to support the relief requested: STATEMENT OF FACTS
Page 5

Prior to 2024, Petitioner’s property was assessed as a single unit, not separately as individual campsites. Increasing the Ambulance Assessment by nearly 12,000% on a single parcel is not fairly assessed compared to the benefit the Petitioner receives. There is no information or data which can show that the Petitioner has received any additional benefit, let alone a nearly 12,000% benefit from the services provided by SSESA, especially considering that there have been no ambulance runs to the Petitioner’s campground in the last two (2) years. While Petitioner is willing to pay its fair share of the Ambulance Assessment, Petitioner should be charged as a single parcel/unit for purposes of the Ambulance Assessment as it has historically been charged pursuant to the original agreement between Burns Township and SSESA (and to which the Petitioner was not a party). MCL 41.801(6) provides that special assessments must be spread on the taxable value of the property assessed based on the special benefit to the property, and not based on police and fire protection provided in a prior year. The modification of a definition within the contract between Burns Township and SSESA during the contract term in order to increase the Ambulance Assessment funds specifically charged to campground owners does not apportion the Ambulance Assessment on the taxable value of the property based on a special benefit to the property; rather it is solely an arbitrary charge by an ambulance service provider in an attempt to charge specific property owners more of the Ambulance Assessment than others and more than their fair share. In Kadzban v City of Grandville, 442 Mich 495, 502, 502 NW2d 299 (1993), the Court ruled that a taxpayer has the right to appeal the creation of a special assessment. The court specified that special assessments would be deemed invalid if the challenging party could demonstrate a "substantial or unreasonable disproportionality” between the assessed amount and the increase in land value resulting from the improvements. Dixon Rd. Group
Page 6
ENTIRE TRIBUNAL SPECIAL ASSESSMENT PETITION Parcel No. 016-08-400-008-02 12. 13. 14. Here there is a "substantial or unreasonable disproportionality” between the assessed amount and the increase in land value resulting from the improvements. Firstly there are no improvements and secondly there have been no ambulance runs to the Petitioner's property. This disproportional Ambulance Assessment is a taking without due process of law. Any assessment not properly imposed may be construed as a tax, subject to specific validity requirements. See Kadzban v City of Grandville, 442 Mich 495, 502 NW2d 299 (1993), and Fluckey v Plymouth, 358 Mich 447, 100 NW2d 486 (1960). Here the Ambulance Assessment is not properly imposed and therefore subject to specific validity requirements. To be considered validly imposed, a special assessment must benefit the assessed properties proportionally to the benefits received. See Kane v. Williamstown Twp., 301 Mich. App. 582, 586, 836 N.W.2d 868, 870-71 (2013). Here the Ambulance Assessment does not benefit the Petitioner’s assessed campground property proportionally to the benefits received. In fact the Petitioner property owner has not received any benefit from the Ambulance Assessment and therefore it must be considered invalidly imposed on Petitioner’s property. A special assessment cannot be supported by evidence that does not include an increase in the market value of the assessed property. The determination of the increased market value after improvement is crucial to assessing whether the benefits derived from the special assessment are proportional to the incurred costs. See Dixon Rd. Grp., 426 Mich. 390, 393, 395 N.W.2d 211, 212 (1986). Further, the Court in Dixon found that, despite the tribunal's factual findings being supported by competent, material, and substantial evidence, the large disproportionality between the cost and the benefit, as a matter of law, they could not uphold the special assessment. In 1997 Mich. Tax LEXIS 8, the Michigan Tax Tribunal stated “...as concern the claim of arbitrary assessment of Petitioner’s [mobile home] park vis-a-vis a commercial campground in the same township, suffice to say that the two operations are not identical or even similar.” Ultimately holding that the Petitioner [a mobile home park] could be treated as a residential site with each unit bearing the burden of the special assessment but, in turn providing that a campground is not to be treated as residential property. Here the Petitioner is a seasonal campground, it is not a mobile home park and should not be treated as so under Michigan law. Therefore, Petitioner’s property should not be assessed based on the number of campsites but rather should be charged as a single parcel of property as has traditionally been done in the past. Finally, Section MCL 125.2302 defines Seasonal Mobile Home Park, explicitly excluding licensed campgrounds. However, Burns Township and SSESA attempt to manipulate this definition for its purposes, seeking to reinterpret the statute in a way that contradicts its clear language and erroneously applying the Ambulance Assessment to seasonal campgrounds as if it were a seasonal mobile home park, in direct opposition of the clear language of the statute. For all of the reasons stated, Petitioner requests the relief in Section 12 above. Respectfully submitted, Date: November 4, 2025 Cc Se = Brian M. ASSESSMENT DISTRICT DESCRIBED BELOW:
NOTICE IS HEREBY GIVEN that the Township Board of Burns Township, Shiawassee County, Michigan
(“Township”), will hold a public hearing on October 6, 2025, at 7:00 p.m., located at the Burns Township Hall
(10355 Bath Rd, Byron, MI 48418) to hear objections and public comments related to increasing ongoing existing
annual special assessments for ambulance services within the Township. Such increases are due to the request of
the Township's emergency service provider the Southwest Shiawassee Emergency Services Alliance ("SSESA").
The proposed cost increase will generally impose annual assessments on each unit (as defined by SSESA; e.g., a
single-family home) in the amount of $130 per unit per year (increased from the previous amount of $120 per
unit per year). Assessment cost information and documents (i.e., assessment roll) are available upon request to
the Township Clerk during ordinary business hours.
PLEASE TAKE FURTHER NOTICE Burns Township has
an existing special assessment district
for
ambulance service within the Township under Act 33 of 1951 (“Act 33”). MCL 41.801
et seq. The districts
boundaries are:
ALL NON-VACANT PARCELS WITHIN BURNS TOWNSHIP.
Additionally, this assessment is charged according to each “unit.” A “unit” is contractually defined by SSESA as
follows: (1) a single-family residence; (2) a mobile home being used as a dwelling; (3) a residential apartment in
a multi-family structure; (4) a commercial business property with 0 to 5 full-time employees (with an additional
“unit” being placed on the property for each multiple of five full-time employees); and (5) two camping sites
within a campground shall constitute a “unit” (e.g. one campsite is % of a “unit™).
PLEASE TAKE FURTHER NOTICE that the owner or any person having an interest in property within the
special assessment district may file a written appeal with the Michigan Tax Tribunal within thirty (30) days after
confirmation of the special assessment roll. Appearance and protest at the public hearing on the special assessment

of interest or his or her agent may (1) appear in person at the hearing to protest the special assessment, or (2) file
his or her appearance or protest by letter before the close of the hearing using the address below.
The Township Board shall maintain a record of parties who appear to protest at the hearing. If the hearing is
terminated or adjourned for the day before
a party is provided the opportunity to be heard,
a party whose
appearance was recorded shall be considered to have protested the special assessment in person. Burns Township
will make accommodations for individuals with disabilities. Persons needing accommodation should contact the

Dear Mr. Delau (CC: Attorney Gormley):
Re:
~~ MTT Appeals & Burns Township
Please accept this letter on behalf of Burns Township (“Township”). Most importantly, the
Township greatly appreciates the service from Southwest Shiawassee Emergency Services Alliance
("SSESA”) and its officers and employees. It is the Townships hope that this letter does not come
off as antagonistic, but rather as identifying an important issue that SSESA and the Township can
work to solve in the best interests of both entities.
As you may recall,
in 2023, SSESA asked the Township to voluntarily renegotiate
its service
agreement with SSESA to, among other things, adjust its unit charge criteria to charge campgrounds
within the Township at half a unit per campsite. Prior to this service agreement adjustment,
campgrounds would qualify as commercial property that would be charged a unit per five full full-
time employees. See service agreements attached as Exhibit A.
The Township had no obligation to amend its service agreement for this change, but in good faith
the Township desired to make such changes to help with the financial stability of SSESA. Notably,
the unit criteria change with campgrounds would require the Township to owe significantly more
funds to SSESA each year—helping SSESA's financial position.Page 14
Although the Township agreed that campgrounds require more service than other land uses, as previously alluded to SSESA, the Township was concerned that the new unit criteria could lead to campgrounds appealing their special assessments. Accordingly, the October 2, 2023 First Amendment to Emergency/Ambulance Service Agreement (“New Agreement”) was explicitly negotiated by the Township and SSESA to include Section 4 that indicates: (1) the Township only needs to provide the higher revenues for campgrounds if it can successfully impose higher special assessments; (2) the Township would be entitled to a refund or credit of campground special assessment revenue if a campground special assessment is successfully challenged in the Michigan Tax Tribunal (“MTT”) (including by any settlements); and (3) if the Township cannot levy higher special assessments to meet the new campground unit criteria that SSESA and the Township will operate under the original unit criteria in the original agreement. In essence, this language was added to protect the Township in the event of special assessment appeals related to the new campground special assessment unit criteria. This was in return for the Township agreeing to the new unit calculations that it had no obligation to agree to (as the prior agreement did not provide for such change and SSESA was required to provide the Township service under the prior unit criteria). As you know, the Township imposes special assessments on cligible properties within the Township in accordance with the unit criteria in the service contract The first year imposing the new unit criteria for campgrounds led to two appeals in the Michigan Tax Tribunal against the Township (John D. Atkinson — 23-003803-TT & Walnut Hills Family Campground — 24-000773-TT). The Township, through use of legal counsel, was able to successfully defend against both appeals by filing motions for summary disposition. But note, one party filed a motion for reconsideration that necessitated a response. Further, although both parties did not utilize their appellate rights, they could have done so in the Court of Appeals or other courts of competent jurisdiction. It is my understanding that SSESA contributed around $2,000 to the Township to in-part compensate it for the defense of the above appeals. Although the Township appreciated the financial contribution, actual costs to defend the appeals were over $15,000. SSESA may argue that a robust defense is not necessary to succeed at the MTT; however: (I) these two cases did not even have trials, which would add costs; (2) the MTT is a specialized administrative court and the Township believes it is best practice to be represented by attorneys familiar with the process and routinely practice in the MTT; (3) if the Township actively defends against these cases, it desires to put forth a full effort; and (4) at least one campground was also represented by counsel. s you may likely know, the Township has two new tax appeals related to special assessments on
Page 15
fees. Moreover, the New Agreement (as well as the old agreement) does not require the Township to defend against MTT appeals. Notably, the New Agreement would provide for SSESA to refund the Township funds that it provided under the new campground unit criteria if it either loses an MTT appeal or simply settles one. Given this, the Township has not utilized our firm for an active defense against the appeals and has simply relied upon assistance from its assessor. Therefore, the Township believes it is in SSESA’s best interests to consider the three options below and let the Township know how it would like to proceed. The Township desires to inform SSESA of these three options to be transparent versus simply taking no action on the appeals and requiring SSESA to refund revenues (if any). I. SSESA appears and assumes the defense of the special assessments to try to preserve as many special assessment revenues as possible. 2. SSESA realizes the risk that the special assessment appeals could be successful without as comprehensive of a defense from the Township and plans accordingly to possibly have to refund the Township for funds it has paid based on the collection of the special assessments. 3. The parties could discuss if there is a possible way of calculating unit criteria that may not lead to as many appeals or a manner of cost-sharing to defend against such appeals in the future. The Township respectfully looks forward to any response from SSESA on this important issue. Should the Township not hear from SSESA, its default position may be to simply let the appeals play out with a minimal defense (or settlement) requiring refunds from SSESA of any lost revenue under the New Agreement. SEASONAL. C pi! TO: Burns Township FROM: SSESA DATED: September 5, 2024 Generally, ambulance services in rural communities requires a mixture of both the participating municipalities contributing financial support to station, provision and man the ambulances throughout the service district in a “ready to service” manner and the collection of user fees from those who actually use the ambulance, No rural community can afford to provide 24/7 advanced life support ambulance services within its community, with a reasonable response time, based solely on user fees. This is why Byron Ambulance Service failed years ago and SSESA took over coverage for the Township. Similarly, no Fire Department can be based solely on user fees. SSESA is an Emergency Services Authority, created under the Emergency Services Act, Public Act 57 of 1988. SSESA provides both firefighting services and/or ambulance services to a number of municipal bodies in Southwest Shiawassee County, SSESA has three founding municipal bodies and contracts with a number of additional municipal bodies for firefighting and/or ambulance services. SSESA charges the communities that it provides ambulance service to an annual per “unit” charge of $110 often consider a “ready 10 service fee.” That charge will increase to $120 per unit annually beginning January 1, 2025. Ttis up to the contracting municipality to determine how to fund SSESA’s annual fee. In addition to the annual fee paid by the municipal bodies under contract for a “ready to service” 24/7 ambulance coverage service, SSESA charges the end user of the ambulance a fee for any actual services received, otherwise known as a “user fee,” The user fee is based upon a schedule adopted by SSESA and is often paid by the user's insurance company. SSESA is able to staff and support a 24/7 ambulance in this rural community based on a combination of these two fees.
Page 37
Per SSESA’s Agreement for 24/7 Ambulance Services with its local units of goverment, the incorporating and contracting municipalities are billed per “unit” annually, as stated above. For billing purposes, a “unit” is defined, by the SSESA contract, as any of the following in the Township: (1) a single family dwelling, (2) an individual apartment or unit in an apartment building or duplex, (3) a mobile home in a mobile home park, (4) every 0-5 employees for a business, or (5) Seasonal Campgrounds are charged at the rate .5 unit per site to adjust for seasonal aspect of a campground in Michigan, There are several ambulance services operating in Shiawassee County and the immediate surrounding areas and they are all paid to provide coverage to different local municipal Jurisdictions. Generally, the per unit charges varies depending on the community and the ambulance service, SSESA’s per unit charge is not the highest nor is it the lowest per unit ambulance service charge in Shiawassee County. SSESA has entered into a written contract with Burns Township to provide Township residents and business with 24/7 ambulance coverage, based on the above annual per unit price, It appears that Burns Township has determined to fund its contractual obligation to SSESA by levying a special assessment in the Township, likely per its authority under MCL 333.20948 (2) (b). Burns Towmship appears to have adopted a special assessment to Township property owners to fund the SSESA contractual obligation on an annual per unit formula very similar to the formula that SSESA charges to the individual contracting municipality. When adopting a Special Assessment a municipality must balance the benefit and the burden so that a property remains in balance and not unfairly assessed compared to the benefit it receives. In adopting the .5 per unit charge for Seasonal Campgrounds, SSESA considered (1) that these Seasonal Campgrounds are akin to mini- villages/cities (population centers) that are only open approximately % a year and (2) balancing the costs between full time residents and part-time campers equitably. First, SSESA considered the following runs in the campgrounds over the last 3.5 years in an attempt to balance the burden and the benefit throughout these population centers equitably: 7751 Bath Rd (Eagles Cove) (362 units)
Page 38
Township, based on (1) SSESA’s per unit formula, (2) a counting of % units {554/2} for
the Seasonal Campgrounds, and (3) available Township data on the number of units.
If one runs the data on a per unit basis the average runs of ambulance services across the
entire Township in 2023 itis .12 {208/ 1650} runs per unit. Meanwhile Seasonal
Campgrounds alone are .014 {4/ (554/2)} runs per unit. This is statistically insignificant
difference of approximately 11% between runs in the Township as a whole {.12} and
runs in the two Seasonal Campgrounds {,014} in 2023, Taking the same data analysis
and applying it to the 2022 data demonstrates that in 2022 the Township at a whole had
-10 runs per unit {174/1650} and the Seasonal Campgrounds again had .02 {6/(554/2)}
runs per unit, for an even smaller statistically insignificant difference in run volume of
-08 runs per unit or approximately two (2%) percent. In short, for the purpose of this
Special Assessment, the Township fairly balance the benefit and the burden between the
full-time Township residents and seasonal campers very equitably, with a statistically
insignificant difference on average between 2022 and 2023 of approximately six and one-
half (6.5%) of each other for the same benefit of having a 24/7 on call ambulance service
available in case of an emergency. Burns Township is very rural and it is going be
almost impossible to get any closer stati stically than what the Township is proposing in
this Special Assessment across 23,040.1 acres of land or 36 square miles of Township
"jurisdiction.
Second, if one examines the argument from a population center standpoint, there
basically are 3 population centers in the Township at least part of the year: Eagle Cover
Campground, Walnut Hills Campground, and the Village of Byron, The Village of
Byron has a population based on the 2020 census of 545 people and 270 units resulting in
a total unit charge of $29,700.
That equates to about 2 residents per unit in the Village
of Byron according to the census data.
If we break that out per person, we are looking at
annual charge of $54.50 per person for the Village of Byron residents to have an
ambulance 24/7 on standby in case of an emergency in the Village.
If we contrast the Village of Byron to Eagle’s Cove Campground/RV Resort, which was
determined by Township records to only have 362! sites available, Eagle Cove is charged
$19,910 for 2024 [($110 x 362) x .5]

If we use the same ratio as the Village of Byron
and assume 2 people per site that would be a population of 724 for ¥; the year, If we
break that out per person it is $27.50, half what the population of Byron pays, If we
apply that $27.50 charge into the formula it comes out to $55 per person per year,
virtually the same as the Village of Byron.
This is a very conservative figure since it assumes 2 people per campsite, which is not
supported by any census data. SSESA would submit that in reality many campers often
have more than 2 users, as they have children or other adults with them, especially on the
weekends,Page 41
person. SSESA submits that the Township's special assessment and SSESA’s unit formula fairly balance the burden and benefit between population centers in the Township to provide 24/7 ambulance service, Likewise for Walnut Hills they have 1922 sites according to Township records and were charged $10,560 [(§110 x 192) x .5} for 2024. That works out to the same per person ratio as Eagle’s Cove at $27.50 per person adjusted to $55 for half the year, If Walnut When reviewing the numbers of camp sites in both of these campgrounds, they clearly
