Appeal to the Tax Tribunal, State of Michigan

Department of Licensing and Regulatory Affairs

lam Carlene M Walz , owner of the residential property at 109

W Washington Ave.,

Jackson., Michigan 49201, Jackson County. The subject property is

a condominiumin the.

Building at the above address.

The building was built in about 1804 and has for much of

its history been a corset factory. The building was repurposediin early 2000 and was ready

for occupancy in 2004. As the units were sold and built out for occupancy the owners

were given a 12 year abatement on their property tax.. When

purchased this property in

2003 there were five years remaining on the tax abatement which inured to my benefit. The

only tax levied was that on my share of the land and the empty condo unit.

Nevertheless, the tax assessor continued to set the Assessed valuation on the property

and the Taxable value. When

| purchased the property in December of 2023, the Assessed

valuation on the condominium was 134,600.

1 purchased the condominium for $310,000,

The following year the assed valuation was 153,900. At the time

| did not take any action to

appeal that raised assessment for the reason that it appeared to me to be inline with the

price

| paid for the property. The only reason given by the assessor for the increase was

“Market Adjustment.”

However the current increase in 2026 ‘was for 11,100 more. Again the reason was

market

adjustment”.

On this occasion

| filed fora hearing because nothing in our building

supported such an increase and certainly not my Unit.

1 realize that these increases have

not caused me to pay any increase in the tax levied because of the existing abatement.

However,

| believe that If

| wait until 2029 to complain , the review board will surely ask me

where was

| in the years that the assessments were climbing.

Just an aside more of the residents were wanting to request a hearing with Board of Review

but the short notice prevented a timely request.: My notice arrived less that a week before

the deadline

. Unlike some of our residents,

| was not in the South or other location on a

spring break.

Our condominium building is very unigue.

There are no comparable buildings in downtown

Page 5

assessed taxes. These taxes and fees tend to keep the purchase prices flat.

Currently we

have several units on the market; tots of interest but sellers and buyers are negotiating in

the downward direction.

In my case

| firmly believe that once my tax abatement ends,

| will

not be able to sell for any increase over what

| paid.

| could be wrong about that, but the

fact remains there are plenty of reasons that the Tax assessor cannot in this case just apply

an increase made up of nothing but a set percentage increase and call it

a market

adjustment.

| ask the Board of Review to look at my purchase price as the actual cash

value, the market value. There was no reason given for.ignoring my purchase price. The

reason given for the denial of relief was “insufficient evidence”. : The evidence is allin their

records, along with the facts

| presented, and the laws about assessing property .

.

Ireceived a Board of Review decision without the names of the reviewers listed and without

signatures.

At the hearing only the Assessor interacted with me.

Please consider my request that you deny the current proposed increase and send itback

to the City Assessor to adjust for Market price, in other words

; ho increase.

2. the assessment of this Condominium development is not to be determined in the same

manner or by the same measurement as individual residential property or even a typical

Condominium development. This development is made-up of 25 units ina 122 year old

Albert Kahn Building. The costs attendant to operations and repairs are substantial and

spread over 25 units. Aside from the HOA fees, the association must maintain the reserve

fund for necessary major repairs in addition to more routine repairs, which are paid by the

owners by special assessments over and above monthly fees. These costs are reasonable

under the circumstances, but have the effect of keeping the market price from increasing.

it is a great place to live, but not an investment where market value is always climbing. That

only occurred after the 2008 recession.

3. There are limits to what an owner can-do to increase market value of an individual unit.

The owner is more likely to be focused on maintaining the condition of the property in order

to maintain the current market value.

4.

recognize that currently | have a tax abatement untit 2029. However,, after the two large

| thought it was crucial that

the Board of Review after 2029 would ask me where was

| while the assessments were

increasing and

| had remained silent.

| have a vested interest, albeit a delayed one, in

protesting the tax increasing with no basis in fact, Simply applying an allowed percentage.

5.

| purchased this property in Dec 2023 for 310,000.00.

It is highly unlikely that

| would get

as much if

| were to selt now. There some units on the Market currently so pricing is a wait

and see the demand. The Assessor should use the best evidence of assessed value from

my sale which is relatively fresh.

:

My request of the Board of review is to forego the proposed increase in that it does not

reflect Market value.

Not less than 14 days before the first meeting of the Board of Review, the assessment notice shall be mailed to the property owner.

Property taxes are calculated based on the Taxable Value {Line 1). State Equalized Value is the Assessed Value multiplied by the

Equalization Factor, if any. State Equalized Value must approximate 50% of market value.

The Taxable Value number entered in the “Change from Prior Year to Current Year” Column, does not indicate a change in your taxes.

The change in your tax bill is estimated above Line 1.

IF THERE WAS A TRANSFER OF OWNERSHIP on your property in 2023, your 2024 Taxable Value will be the same as your 2024 State

Equalized Value.

IF THERE WAS NOT A TRANSFER OF OWNERSHIP on your property in 2023, your 2024 Taxable Value is calculated by multiplying your

2023 Taxable Value by 1.05 (Inflation Rate Multiplier for the current year). Physical changes in your property may also increase or

decrease you Taxable Value. Your 2024 Taxable Value cannot be higher than your 2024 State Equalized Value.

The Taxable Value, the Assessed Value, the State Equalized Value, the Property Classification, or the Transfer of Ownership may

be appealed by filing a protest with the Local Board of Review. Protests are made to the Board of Review by completing a Board

of Review Petition Form. A Petition Form may be obtained directly from the local unit or from the Michigan Department of

Treasury's website at www.michigan.govitaxes. Click on the “Property Taxes” box, select “Forms and Instructions,” then click

on “Board of Review” to obtain a “Petition to the Board of Review,” Form 618 (L-4035).

The denial of an exemption from the local school operating tax for “qualified agricultural properties” may be appealed to the local Board of

Review. The denial of an exemption from the local school operating tax for a “homeowner's principal residence” may be appealed to the

Michigan Tax Tribunal by the filing of a petition within 35 days of issuance of this notice. The petition must be a form approved by the

Michigan Tax Tribunal, which are available at www.michigan.gov/ taxtrib.

Filing a protest with the Board of Review is necessary to protect your right to further appeal valuation and exemption disputes to the

Michigan Tax Tribunal and classification appeals to the State Tax Commission. Properties classified Commercial Real, Industrial Real or

Developmental Real may be appealed to the regular March Board of Review or to the Michigan Tax Tribunal by filing a petition by May 31.

Commercial Personal, Industrial Personal, or Utility Personal Property may be appealed to the regular March Board of Review or to the

Michigan Tax Tribunal by filing a petition by May 31

if a personal property statement was filed with the local unit prior to the

commencement of the Board of Review as provided by MCL 211.19, except as otherwise provided by MCL 211.9m, 211.9n and 211.90.

To claim a PRE, complete the “Principal Residence Exemption Affidavit” (Form 2368) and file it with your township or city of the year of the

claim. A valid affidavit filed on or before June 1 allows an owner to receive a PRE on the current year summer and winter tax levy and

subsequent tax levies so long as it remains the uwiist's principal residence. A valid affidavit filed after June 1 and on or before November
