April 14, 2026 Via Electronic Mail Greg Marini 3850 Smokey Ridge Road Traverse City, Michigan 49686 Searay400ec@gmail.com 616-558-0581 Dear Mr. Marini: RE: Peninsula Township FOIA Response – Partial Grant, Partial Denial Our office represents Peninsula Township (the “Township”), and we are writing on behalf of the Peninsula Township FOIA Coordinator. This letter is in response to your Michigan Freedom of Information Act (“FOIA”) request for records received by the Township on April 6, 2026. MCL 15.235(1) (“A written request made by . . . electronic mail . . . is not received by a public body’s FOIA coordinator until 1 business day after the electronic transmission is made”). The Township understands that you have technically submitted this request twice. While the Township initially responded to your first submission of this request via email, this correspondence serves as a formal FOIA response to both FOIA requests. You requested: 1. Full CAMA Building Detail Worksheets: The complete itemized cost-calculation sheets for the 2024 and 2025/2026 tax years. This must include the "base math" prior to multipliers, specifically the manual page rates, square foot base rates, and line-item "plus adjustments" or "refinements" used for the Class B/C valuation. 2. Specific Manual Reference Pages: Copies of the specific pages from the State Tax Commission (STC) Assessor’s Manual referenced to determine the base costs for this property. The "Top-Level" Property Base Cards you provided are only part of the initial request from yesterday. Without the "Building Cost Detailed
Page 2
2 Worksheet", i.e., the internal math the township used for calculations of my property assessment, I cannot verify the details of your assessment. 3. Neighborhood ECF and Land Studies: The 2024 and 2025 Economic Condition Factor (ECF) analysis and Land Value studies for my specific neighborhood code. 4. Component Audit: The specific line-item breakdown for the Additions/Adjustments applied in the 2024 and 2025/2026 tax years. Your request is granted, in part, as to existing, non-exempt public records within the Township’s possession falling within the scope of the request that are sufficiently described to allow the Township to locate responsive records. The Township has already provided you with certain records that are responsive to your request, but they have additionally been attached herein for your reference as a part of this FOIA Response. As for the partial denial, part of your request is denied because certain records requested in your FOIA request do not exist. MCL 15.235(5)(b). Specifically, the requested records related to request #2 and request #4 do not exist under the description provided by you or under any other name reasonably known to the Township. See Id. Enclosed, please find a Certificate of No Public Records to that effect that details what specific requested records do not exist. (Enclosure #1). The Township is dedicated to ensuring that you receive all the records that are responsive to your request and the Township strictly complies with the pro-disclosure nature of the FOIA. The Township is unable to produce the specific manual pages within request #2 because the Township does not know what specific manual pages are used when determining the base costs for the property. The software utilized by the Township incorporates the pricing components of the 2025 Michigan Assessor’s Manual. This eliminates the need for assessors to draw upon page-by-page analysis and hand computed mathematics. As a result, the Township has no knowledge of the specific pages of the manual the pricing components come from because the formula is integrated into the software. The Michigan Assessor’s Manual can be accessed free of charge on the State Tax Commission’s website, at the following link: https://www.michigan.gov/treasury/local/stc/accordion/pubs/michigan-assessor-manuals Further, in regard to request #2, the FOIA does not apply to software, and thus the Township’s software is not a public record within the scope of the FOIA. The FOIA defines software in the following manner:
Page 3
3 "Software" means a set of statements or instructions that when incorporated in a machine usable medium is capable of causing a machine or device having information processing capabilities to indicate, perform, or achieve a particular function, task, or result. Software does not include computer-stored information or data, or a field name if disclosure of that field name does not violate a software license. MCL 15.232(j). MCL 15.232(i) further states that a “[p]ublic record does not include computer software.” In this case, the Township is using a set of statements regarding your property to have a machine process that information to complete the task of determining the base costs of your property. Thus, under the plain meaning of the statute, the Township does not possess or maintain a public record that can be disclosed to you under request #2. Similarly, regarding request #4, the Township does not possess or maintain a document that has the specific line-item breakdown for the additions applied in the 2024, and 2025/2026 tax years. Although the Township does not have an existing public record that contains the specific line-item breakdown of additions applied in 2024 and 2025/2026 tax years, that information may be found from the record cards and valuation statements that have been provided to you (and attached herein), or from materials that are currently available on the Township’s website. You can access the Township’s EFC Analysis for 2026 Assessments and Land Value Analysis for 2026 Assessments at the following link: https://www.peninsulatownship.com/assessing1.html (see the last two bullet points on the list of forms). Please note that under the FOIA, the Township is not required to make a compilation, summary, or report of information, nor does it require the Township to create a new public record to satisfy a FOIA request under request #4, which further supports denying your request for a line-item breakdown for the additions applied in the 2024, and 2025/2026 tax years. MCL 15.233 (4) and (5). As stated above, that information is located across different records that have been provided to you or may be found online. The Township has compiled, reviewed, and prepared the records within the Township’s possession that are responsive to your FOIA Request at no cost to you, and they have been attached herein as Enclosure #2. Please note that the Township reserves the right to charge FOIA fees for future requests as provided in MCL 15.234.
Page 4
4 To the extent your request has been denied, you are entitled under MCL 15.240 to appeal to the Peninsula Township Board or commence an action in the circuit court to compel disclosure of the requested records if you believe they were wrongfully withheld from disclosure. If, after judicial review, the court determines that the Township has not complied with MCL 15.235 in this denial and orders disclosure of all or a portion of a public record, you have the right to receive attorneys’ fees and damages as provided in MCL 15.240, a copy of which is enclosed (Enclosure #2). Please refer to MCL 15.240a regarding a FOIA requestor’s ability to appeal FOIA fees. If you have any questions about the content of this letter and response, you may contact the undersigned. Please find a copy of the Township’s FOIA Procedures and Guidelines and its Written Public Summary of the same online here: https://www.peninsulatownship.com/foia-forms.html Sincerely, Sophia Youssif Associate Direct: 517.927.3710 syoussif@fsbrlaw.com Enclosures: (1) Certificate of No Public Record (2) Responsive Records (3) MCL 15.240

5 CERTIFICATE OF NO PUBLIC RECORDS On behalf of Peninsula Township’s FOIA Coordinator, I hereby certify that the Township has made a good faith effort to identify the public records requested in your FOIA request. You requested, in relevant part: Specific Manual Reference Pages: Copies of the specific pages from the State Tax Commission (STC) Assessor’s Manual referenced to determine the base costs for this property. The "Top-Level" Property Base Cards you provided are only part of the initial request from yesterday. Without the "Building Cost Detailed Worksheet", i.e., the internal math the township used for calculations of my property assessment, I cannot verify the details of your assessment. Component Audit: The specific line-item breakdown for the Additions/Adjustments applied in the 2024 and 2025/2026 tax year I hereby certify that the Township was unable to locate any responsive public records to this portion of your Michigan Freedom of Information Act request. As such, your request for the above is denied because the requested public records do not exist under the name provided by you or under any other name reasonably known to the Township. MCL 15.235(5)(b). _______________________ Dated: April 14, 2026 Sophia Youssif Peninsula Township Attorney On behalf of the Peninsula Township FOIA Coordinator

FREEDOM OF INFORMATION ACT (EXCERPT) Act 442 of 1976 15.240 Options by requesting person; appeal; actions by public body; receipt of written appeal; judicial review; civil action; venue; de novo proceeding; burden of proof; private view of public record; contempt; assignment of action or appeal for hearing, trial, or argument; attorneys' fees, costs, and disbursements; assessment of award; damages. Sec. 10. (1) If a public body makes a final determination to deny all or a portion of a request, the requesting person may do 1 of the following at his or her option: (a) Submit to the head of the public body a written appeal that specifically states the word "appeal" and identifies the reason or reasons for reversal of the denial. (b) Commence a civil action in the circuit court, or if the decision of a state public body is at issue, the court of claims, to compel the public body's disclosure of the public records within 180 days after a public body's final determination to deny a request. (2) Within 10 business days after receiving a written appeal pursuant to subsection (1)(a), the head of a public body shall do 1 of the following: (a) Reverse the disclosure denial. (b) Issue a written notice to the requesting person upholding the disclosure denial. (c) Reverse the disclosure denial in part and issue a written notice to the requesting person upholding the disclosure denial in part. (d) Under unusual circumstances, issue a notice extending for not more than 10 business days the period during which the head of the public body shall respond to the written appeal. The head of a public body shall not issue more than 1 notice of extension for a particular written appeal. (3) A board or commission that is the head of a public body is not considered to have received a written appeal under subsection (2) until the first regularly scheduled meeting of that board or commission following submission of the written appeal under subsection (1)(a). If the head of the public body fails to respond to a written appeal pursuant to subsection (2), or if the head of the public body upholds all or a portion of the disclosure denial that is the subject of the written appeal, the requesting person may seek judicial review of the nondisclosure by commencing a civil action under subsection (1)(b). (4) In an action commenced under subsection (1)(b), a court that determines a public record is not exempt from disclosure shall order the public body to cease withholding or to produce all or a portion of a public record wrongfully withheld, regardless of the location of the public record. Venue for an action against a local public body is proper in the circuit court for the county in which the public record or an office of the public body is located has venue over the action. The court shall determine the matter de novo and the burden is on the public body to sustain its denial. The court, on its own motion, may view the public record in controversy in private before reaching a decision. Failure to comply with an order of the court may be punished as contempt of court. (5) An action commenced under this section and an appeal from an action commenced under this section shall be assigned for hearing and trial or for argument at the earliest practicable date and expedited in every way. (6) If a person asserting the right to inspect, copy, or receive a copy of all or a portion of a public record prevails in an action commenced under this section, the court shall award reasonable attorneys' fees, costs, and disbursements. If the person or public body prevails in part, the court may, in its discretion, award all or an appropriate portion of reasonable attorneys' fees, costs, and disbursements. The award shall be assessed against the public body liable for damages under subsection (7). (7) If the court determines in an action commenced under this section that the public body has arbitrarily and capriciously violated this act by refusal or delay in disclosing or providing copies of a public record, the court shall order the public body to pay a civil fine of $1,000.00, which shall be deposited into the general fund of the state treasury. The court shall award, in addition to any actual or compensatory damages, punitive damages in the amount of $1,000.00 to the person seeking the right to inspect or receive a copy of a public record. The damages shall not be assessed against an individual, but shall be assessed against the next succeeding public body that is not an individual and that kept or maintained the public record as part of its public function.
