This reduction is a result of the total final costs being lowered from $286,381.11 down to $208,925.33 for the entire district. The issue in this appeal is whether the cost of the paving of Salt River Dr. exceeds the benefit, defined as an increase in value to the property, by a disproportionate amount. The Michigan Supreme Court in Dixon Rd. Group v. City of Novi has held that a cost which exceeds the benefit of 2.6 times the value increase was invalid. The MSC goes on to further state, “while decisions made by municipalities with respect to special assessments generally should be upheld, this Court will intervene where there is a substantial or unreasonable disproportionality between the amount assessed and the value which accrues to the land as a result of the improvements.”

In Justice Boyle's concurring opinion, quoting Frischkorn Investment Co. v. Detroit (1932) he states “Where there has been no showing of fraud, mistake, discrimination or a clear absence of benefits claimed, Courts should hesitate to interfere with a legislative determination of the existence or value of the benefit. Such decisions are best made by the legislative bodies charged with levying the assessments.” Also, due to the status of Salt River Dr as a private road the property owners would be responsible for the entire cost of the repaving. The Township. Board hereby agrees to solicit bits and construct the: road improvements described.in Exhibit "A" attached hereto and made a part hereof. 3. The Township Board hereby approves the preliminary plans and estimates of cost prepared by Spalding: DeDecker. .The Township will: secure the lowest responsible bid: for installation of the improvements, which bid, together: will related costs, shall be the sum so. levied. Spalding DeDecker is authorized to prepare final engineering drawings and upon completion the Township will then proceed to bid. 4. The Township Board finally determines that the special assessment district. against which. the aforesaid sum shall be ‘assessed shall consist of all lands described in ‘said petition ‘and constituting the area to ‘be benefitted by said improvements. The term of the special assessment district shall be Ten (10) years. 5. The Supervisor is hereby directed to make a special assessment roll in which shal be described all of the. parcels of land to be assessed; as above set forth, with the names of all the owners thereof, if known, and the total amount to be assessed against each parcel of land, which amount shall be such relative portion of the whole

6. When the Supervisor shall have completed the special assessment roll, he shall affix thereto his certificate stating that said roll was made pursuant to the resolution of the Township Board of the Charter Township of Chesterfield, adopted on May 28, 2024 and that in making the assessment roll he has, according to his best judgment, conformed in all respects to the directions in said resolution and the statutes of the State of Michigan, and the Supervisor shall then report the special assessment roll, with his certificate attached thereto, to the Township Board. re All resolutions and parts of resolutions insofar as they conflict with the provisions of this resolution be and the same are hereby rescinded. Said Special Assessment Roll shall be paid in ten (10) equal annual installments, the first annual payment to be due on December 1, 2024, and the following payments to be due on December 1 of each and every year thereafter. Said installments of the Special Assessment Roll shall bear interest from and after December 1, 2024 at the rate of five percent (5%) per annum to be payable annually on each installment due date. 3.
