We have typically used Marx Wetlands for those. After that I recommend having an

that I recommend having an onsite pre-application meeting with EGLE to discuss the project and potential for wetlands impacts. EGLE may waive wetland mitigation requirements for impacts under 1/3 of an acre, but that needs to be discussed with and approved by them. The other thing to keep in mind are the floodplain limits. The floodplain map I sent from GIS is approximate, the legal limits of the floodplain are based on elevation and will need to be mapped based on a topo survey we would need to perform. Some work within the floodplain may be permissible, but any fills will need to be offset by a compensating cut elsewhere. EGLE may also require a hydraulic analysis to prove no adverse impacts to the floodplain. The presence of a floodway and county drain easement will likely mean that a drive across the drain won’t be permitted. They may be able to develop the SW and NE corner, with separate drives to the adjacent public roads, but they likely won’t be able to connect them together so you could directly drive between them.

There are also setbacks to work with. Looks Like for C-2 zoning they are 50’ for front and rear, and 15’ for side yard. No building will be allowed within that. Parking front yard setbacks where the road is are 20’ from the right of way line. Daniel W. drain. According to the state requirements we need a total of 2100 sq feet Do you think we can make this happen even if we had to use the southwest corner for the majority of the project and what ever is left we can use the northeast corner I’m not sure if that will work I would appreciate your input Sent from Yahoo Mail for iPhone On Tuesday, December 2, 2025, 4:39 PM, Ken Perry <KPerry@rowepsc.com> wrote: Our engineer did some initial investigation of the site. There is a county drain crossing diagonally through the site. The Drain Commissioner will typically have an easement centered on those which restricts what can be done within it. There is also a floodway (red crosshatch), and 100 year floodplain (blue shading) which is over half of the site. A maximum of 300 cyd of fill, which isn’t much, is normally allowed before compensating cut is required. The southwest corner of the site appears to be out of the floodplain, but even that buildable area will be reduced by whatever the setbacks are. There also may be wetlands on
Page 10
There also may be wetlands on site. See attached wetlands PDF I made of the site from the county GIS. The orange shading is possible wetlands, which is most of the site. The accuracy of the online wetlands viewer is very hit or miss, they would need a formal wetlands assessment to get a wetlands determination to determine whether wetlands are present, and if they are, what the boundary is. The presence of the drain with a likely easement, a floodplain, floodway, and possible wetlands makes this a very difficult site to develop. By the time those factors are considered, and the setbacks, there may not much if any buildable area. Daniel W.
