STIPULATED MOTION TO ADJOURN HEARING

NOW COMES Respondent, Township of Beaver, by and through its undersigned counsel,

Andrew C. Thompson of Poznak Dyer Kanar Schefsky Thompson PLC, and hereby requests the

Tribunal to Adjourn the Hearing scheduled in this matter for November 16, 2026, and as grounds

therefor, states as follows:

1.

The Tribunal issued a Notice of Telephone Hearing in this matter for November 16,

2026 at 1:45 p.m.

2.

Respondent requests that the Tribunal adjourn and reschedule the Hearing in this

matter, and Petitioner, through counsel, stipulates to the same.

3.

The requested adjournment would allow the Parties to continue settlement

discussions. The Parties stipulate to this adjournment and ask the Tribunal to work with them to

facilitate a possible resolution on the merits.

4.

The Parties, through counsel, have been in communication and are engaging in

discussions, including potential settlement discussions.

5.

As the requested adjournment will allow the Parties to prepare necessary evidence

and could lead to an amicable resolution of the above captioned appeal, there is good cause to

grant the adjournment.

6.

This is the first requested adjournment and the granting of the requested

adjournment will not unduly delay the resolution of this appeal.

WHEREFORE, Respondent respectfully requests this Honorable Tribunal to enter an

Order Adjourning the Hearing in this matter.

Date: October 15, 2026

Respectfully submitted,
