STATE OF MICHIGAN GRETCHEN WHITMER DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS MARLON I. BROWN, DPA GOVERNOR LANSING DIRECTOR My son owned the property in question until his death on November 23, 2019, from Duchenne's muscular dystrophy. Prior to his passing, in his confused state, he offered the home to a friend. The friend obliged, and thus he had a Lady Bird deed drawn up. I was appointed his personal representative in his will, which gave me the power to choose what happened to the property in question. It was previously designated for myself to inherit the property, but once he passed away I discovered that the friend was in fact the new owner of the property. The friend then informed me of the transaction and offered the property back to me. She agreed to transfer the property back to me through the quick claim deed process on December 6, 2019, just 13 days after his passing. This then led to a re- assessment of the property increasing the property tax obligation causing much undo hardship to me these past 7 years. I am a US Navy Veteran on a fixed income and am barely able to cover all of my monthly expenses do to this. In fact I might have to sell the property and move to another home because I am not sure if I can afford to live there for the remainder of my life. In the last days of his life he was suffering from carbon dioxide poisoning because with his condition, Duchenne's muscular dystrophy, he was not able to expend the carbon dioxide in his lungs and it was causing great confusion. If he had not transferred ownership to his friend then the property would have passed to me, his blood heir, and therefore a tax re-assessment would not have taken place. I am asking for your reconsideration in this tax assessment review. Section 5: Jurisdictional Issues Did you protest the special assessment at the hearing held to confirm the special assessment roll? No If Yes, what was the date of the hearing held to confirm the special assessment roll? If No, explain: There was no prior hearing. Fee Information A fee of $100.00 is required for the filing of a Special Assessment Appeal.
