SECTION 4 – REASON FOR THE APPEAL

1. Unreasonable disproportionality between the amount of the assessment and the value that

accrues to MY PROPERTY.



Michigan law provides that a special assessment is only valid if the property specially

assessed receives a special benefit that is proportional to the cost of the assessment. The

general rule is that the benefits derived from a special assessment to a property should be

determined by the difference in the market value of the property before and after the

making of the improvement. See Dixon Road Group v City of Novi, 426 Mich. 390 (1986);

Kadzban v City of Grandville, 442 Mich 495 (1993); Michigan’s Adventure, Inc v Dalton

Twp, 290 Mich App 328 (2010).

o

The Township has not at any point in the special assessment district process stated

that the sewer project will increase the property values of affected parcels. In-fact,

the Township’s own engineer stated in a public hearing that he was surprised there

was interest in this project after determining that the cost would be more than

$12,500 per parcel.

o

I have a working septic system in good shape and repair. A sewer connection adds

no quantifiable benefit to my property. The added monthly expense of $75/mo. for

flat fee sewer service (subject to increase at the whim of LASA) negatively impacts

my property by at least $900/year. There is no direct measurable economic benefit

to my property; instead, the sewer creates a direct economic liability to my property.

o

In a rural setting with many of the homes on Bankson Lake being summer cottages

only, a home buyer does not care if a house is on sewer or septic; all they care about

is whether the toilet flushes. Sewer does not add value.

o

I intend to offer some or all of the following as evidence to show the unreasonable

disproportionality between the assessment against my property and the value (or

lack thereof) that accrues to my property by virtue of the sewer project:

assessments, quotes for a replacement system (if needed in the future), assessor

reports, financial data from other sewer projects, LASA financials, property record

cards, sales comparisons, and appraisal(s).

o

The total cost of $27,500 to my property ($24,500 benefit fee/REU + $3,000 parcel

fee) does not result in a proportional increase in the value of my property. Even if

my current sewer system were to fail, a brand-new system would cost around

$10,000 – about 1/3 of the cost of the assessment.

o

The Township will not be able to show any market value increase to my property

as a result of the sewer project, let alone a proportional increase to the exorbitant

cost of this project. If the Township and LASA wish to pursue the sewer project,

it must be paid for from a general levy and not from a special assessment against

my property.

2. The special assessment district was not properly or fairly determined.



Porter Township has cited Michigan Act 368 of 1978 (the Michigan Public Health Code)

as one of the key reasons in guiding this project, asserting that the sewer installation is a

Page 2

public health necessity required to protect the water quality and environmental integrity of

Bankson Lake. Despite the stated environmental and public health purpose of protecting

the lake’s ecosystem, the Township’s infrastructure plan excludes certain properties

surrounding the lake. Consequently, not all properties around the lake will be connected to

the public sewer system.

o

You can’t tell people that the main reason you are requiring properties around a

lake to hookup to a sewer is for the health and wellbeing of the lake but then allow

large sections of the surrounding lake properties to be excluded from the special

assessment district because “it would increase everyone’s cost” to include those

properties (Alan Smaka, engineer for LASA and Porter Township). It’s telling that

the properties surrounding Bankson lake owned by Porter Township board

members and their families were conveniently excluded from the special

assessment district.



Under Michigan law, a valid special assessment must confer a specific, proportional

economic benefit to the assessed property above and beyond the benefit conferred to the

general public. Because the Township is including Act 368 of 1978 as one of the reasons

to justify a comprehensive environmental protection measure for Bankson Lake, the entire

lake community residents of Porter Township benefit (public lake with public launch).

However, by failing to connect all properties surrounding the lake, the financial burden is

distributed unequally. The petitioner is being forced to subsidize a lake-wide and greater

public environmental remediation effort, whereas excluded properties remain exempt from

both the infrastructure connection and the equivalent financial burden.



If one of the project's objectives under Act 368 of 1978 is the mitigation of public health

risks and the protection of the lake, leaving un-sewered gaps and disconnected properties

directly undermines that purpose. Contamination from excluded properties will continue

to impact the lake, thereby failing to deliver the full environmental benefit that supposedly

justifies the high cost levied against the Petitioner's property.



The disparate layout of the sewer project creates an arbitrary distinction between

properties, rendering the assessment an unconstitutional tax rather than a true special

assessment.

3. Unequal and Inequitable Cost Distribution.



The assessment methodology is fundamentally flawed and inequitable. The district

includes a religious camp (The Miracle Camp Retreat Center) that has been granted a

substantial discount on its portion of the project costs. Mircale Camp not only has a failing

sewage collection system, but it also intends to expand, and it needs access to a sewer

system to remedy its failing system and accomplish its intended growth. LASA and Porter

Township officials negotiated in secret with Miracle Camp and ultimately entered into a

back-door agreement that provides Miracle Camp a subsidized sewer system with the

additional financial burden being put on the surrounding property owners, including me.



Miracle Camp’s tax-exempt or non-profit status does not legally or morally justify shifting

its infrastructure improvement costs onto neighboring private property owners. A special

assessment must be apportioned uniformly based on the benefit received. Shifting costs to

subsidize another entity creates an unconstitutional and unequal tax burden.

Page 3



Total Costs:

o

Total amount of Bankson Lake Sewer project $6,472,668.67. (Attachment A, p. 2).

o

Total amount paid by Lake Residents $3,857,000. (Attachment A, p. 4).

o

Total amount paid by the Miracle Camp $1,855,966.44 (Attachment B, p. 5 Item

b).



Total REU’s:

o

There are 3 separate REU’s for the one Special Assessment District (Bankson Lake

Sanitary Sewer Extension Special Assessment District No. 1)



The Miracle Camp has 2 separate REU rates:

o

1 REU - Direct Connection Rate = $21,010

o

125.4 REU’s - Indirect Connection Rate: $10,505

o

Capacity fee = $508,629.44 for 126.4 units)

(Attachment B, p. 5 Item b).

o

Miracle Camp should be paying at least $3,099,250 if they

were being charged equitably for their REU’s.



Bankson Lake Residents have one REU rate of $24,500.

(Attachment A; Exhibit D)



Total Parcel Fees:

o

The Miracle Camp has 6 parcels in the Special Assessment District (Attachment A,

Exhibit D), however only 3 have parcel fees attached (Attachment B, p. 5 Item b).

Total Parcel Fee is $9,000. It should be $18,000.

o

Lake Resident Parcel fees: $3,000 for each parcel. (Attachment A, Exhibit D).

4. Lack of project cost coverage:

The revenue generated from the Miracle Camp charges and Lake Resident charges is insufficient

to cover the costs of the sewer Special Assessment District, which will only result in higher special

assessments and even more disproportionality to any possible market value benefit to my property.

o

Total project amount:

$6,472,668.67

o

Miracle Camp amount: ($1,855,966.44)

o

Lake Resident amount: ($3,857,000.00)

o

Project Cost Short Fall

$759,702.23



Monthly cost for usage:

o

Miracle Camp: Referencing the Miracle Camp Sewer Connection Contract

(Attachment B, Exhibit B - Connection Fee Calculation for Property; Capacity

purchased 22,500 gallons per day), the Miracle Camp will be charged $75.00 per

month times the actual metered usage (Contract estimate is currently at 28.2

REU’s). Fifteen dollars of this charge will be applied to pay down debt. The

remaining $60.00 per REU will be a monthly cost for usage. When calculating the

usage cost, the Miracle Camp will be charge:



$60.00/month * 28.2 REU’s = $1,692.00/month or $20,304.00 annually.

o

Lake Residents will be charge $75.00/month ($15.00 will pay down debt):

Page 4



$60.00/month * 136 REU’s = $8,160.00/month or $97,920.00 annually.

This is 4.8 times more than Miracle Camp.

5. Violations of Michigan Public Act 188 of 1954.



MCL 41.724 and MCL 41.726 state that the Township must have the following information

on file with the township clerk for public inspection:

o

Improvement Plans: Detailed engineering and layout plans for the sanitary sewer

construction.

o

Cost Estimates: Projected total project cost estimates (including engineering and

legal/incidental costs).

o

Special Assessment District Description/Boundaries: A legal description or map

of the land parcels designated to receive the benefit.

o

Special Assessment Roll: Prepared by the township assessing officer/supervisor

listing each parcel, the name of the record owner, property value/taxable value or

benefit calculations, and the specific assessment amount assigned to each property.



Attempts were made by multiple Township residents on September 15th, September 16th,

and September 23rd, 2026 to inspect these documents at the Clerk’s Office at Porter

Township Townhall and none of these documents were available to review during normal

business hours (See Attachments C, D and E). The failure of the township to make these

mandatory documents available for inspection prior to the Public Hearing on September

30th, 2026 violates due process and statutory procedural requirements under Michigan law,

impairing a resident’s ability to evaluate the proportionality of the benefit and the accuracy

of the assessment. (The original Public Hearing on September 9th was adjourned and

continued on September 30th)

6. Illegible Documents in all three Township Resolutions.



August 12, 2026, Resolution 1 and October 6, 2026, Resolution 3 include an Estimate of

Cost summary sheet that is severely degraded, blurred, and illegible, making it impossible

to determine the true scope of the project, the exact impact on my property, or the accuracy

of the apportionment.

7. Discrepancy in Special Assessment District Key Elements.



The Estimate of Costs summary sheet contains mathematical errors and errors when

applying the percentage allocations to the Lake Residents and the Miracle Camp when

apportioning the capacity fees (Attachment F).

o

The cost allocation based on the percentage indicated in footnotes [1] and [2] are

calculated incorrectly.



[1] Indicates total capacity purchased by Lake Residents will be 43.64%.



The amount paid to Cedar Lake residents 43.64% * $117,062.71 =

$51,086.17 not the $59,478.37 indicated



[2] Indicates total capacity purchased by the Miracle Camp will be 56.36%.



The amount paid to Cedar Lake residents 56.36% * $117,062.71 =

$65,976.54 not the $57,584.34 indicated.

Page 5

o

Consequently, the usage charges for the Lake Residents and the Miracle Camp were

calculated incorrectly



[1] the LASA General capacity purchased for the Lake Residents, using the

engineering allocation percentages should be:



Lake Residents LASA allocation = $465,880.55



Miracle Camp LASA allocation =

$451,045.10

Total LASA General Allocation = $916,925.65

o

Lake Residents $916,925.65 * 43.64% = $400,146.35

o

Miracle camp = $916,925.65 * 56.36% = $516,779.30



This shows that the cost allocations in the Cost Summary Sheet do not

match the contract signed between the township and Miracle Camp for the

usage portion.



The contract states the total usage for the Miracle Camp is $508,629.44. In

fact, when the percentage shown in the Cost Summary Sheet (56.36%) is

applied, the amount should be $582,755.84 ($65,976.54 + $516,779.30).



The Miracle Camp is receiving a $74,126.40 discount on the usage fee

resulting in that same amount being charged to the Lake Residents.



Based on that allocation, the Lake Residents should be charge $74,126.40

less in usage fees ($74,126.40 / 136 REU’s = $545.05 per REU)



This is a significant mistake that is identifiable with the limited information

being provided. If the required information per PA188 were available, a

more equitable allocation of costs between the Lake Residents and the

Miracle Camp may be more apparent.



Special Assessment District No. 1 is to consist of the parcel numbers listed as “The

District” and the “Map of District” as determined in the September 9th Porter Township

Resolution (Attachment G, p. 3-4, and Attachment G; p.2 respectively). There are 15

parcel numbers listed in “The District” list of parcel numbers that are not shown on the

“Map of District”.



The Roll (Attachment A; Exhibit D) consists of 2 parcels that are not included in the

description of “The District” (Attachment G, p.3)



Description of Improvements (Attachment A, Exhibit A, par.2) states there are 185 Lake

Resident REU’s to be serviced. The actual Lake REU number is 136 (Exhibit D).



The required public notices that were included in the August 20th and August 27th, 2026

editions of the Courier Leader contained a list of 203 parcel numbers that do not match the

Map in the publication (Attachments H and J).



The required public notices that were included in the September 17th and September 24th,

2026 editions of the Courier Leader contained a list of 203 parcel numbers but did not

include a visual map or a clear written explanation showing the boundaries of the entire

neighborhood or zone affected by the proposed project. (Attachments K and L)

Page 6

8. Disproportionate Usage vs. Assessment Ratio



The Miracle Camp, by its operational nature, generates a significantly higher volume of

wastewater and places a much heavier demand on the new sewer infrastructure than a Lake

Resident’s property. Despite creating a larger burden on the system, the camp is paying a

reduced monthly rate, while a lake resident’s property is being assessed at a higher monthly

rate relative to its actual impact and benefit. This represents an arbitrary and capricious

distribution of the project’s financial burden.



While Miracle Camp operates as a non-profit organization, it functions as a revenue-

generating entity with an operational budget supported by camp fees and programming. In

contrast, the surrounding lake residents are private homeowners who derive no income

from their properties. Granting a sewer special assessment discount to a revenue-generating

camp, while requiring non-income-producing residents to pay full price, creates an unfair

and disproportionate financial burden on the residential community. Therefore, Miracle

Camp should be assessed at the standard rate. The Miracle Camp will receive a substantial

benefit of having its usage metered while Lake Residents will be charged a flat rate of

$75.00 per month regardless of their seasonal occupancy or usage.



The Miracle Camp will be receiving an REU discount when its capacity portion is almost

half of the entire project.

o

Miracle Camp REU = 126.4 = 48.17%

o

Lake Residents REU = 136 = 51.83%

9. Failure to Mitigate Lake Resident Costs while recognizing Miracle Camp Financial

Pressures



The Township Board has breached its implied fiduciary obligation and duty of care to the

property owners within the Special Assessment District by failing to investigate, pursue,

or secure available external funding mechanisms including State of Michigan grants or

loans.

o

The Porter Township Supervisor and LASA engineer first communicated on

September 3rd, 2022 that they would be seeking to secure grant funds to help finance

the project. This communication continued until August 2nd, 2025. (Per multiple

Bankson Lake Association Meeting Minutes).

o

Per the June 20th, 2026 Bankson Lake Meeting Minutes, the Porter Township

Supervisor and LASA engineer communicated that a sewer agreement had been

signed with the Miracle Camp. The LASA engineer indicated that USDA grants

were available, but they come with extra requirements on the projects, which

overall make the project more expensive, even if the grant is awarded. Also, those

grants are very limited now (Attachment P).

o

Based on information obtained on-line, loan and grant programs are available for

the State of Michigan from the USDA with lower interest rates offered than what

the bonds will be sold for from the Bendzinski and Co. Municipal Finance advisors.



See Attachment R – USDA website indicating loans are available at a

market rate of 4.75%

Page 7



See Attachment S – LASA Bond – Bankson Lake Project – indicating bonds

are going to be sold at an interest rate of 6.75%

o

In late 2021/2022 the Miracle Camp was notified by the State of Michigan that the

current septic system and leach field were failing and, in order to continue, or

expand their organization, new infrastructure would need to be implemented – three

options were considered (1) Upgrade the current system, (2) Build their own

wastewater treatment system (3) Become part of LASA (Lake Area Sewer

Authority) (Attachment M).

o

Per the May 7th, 2022 Bankson Lake Association Meeting Minutes:

Ross Adams, Executive Director of Miracle Camp, is looking at long term solutions

and is in discussion with LASA about hooking into their sewer system. Cost to run

and hook up is roughly $2.5 million, which is not feasible for Miracle Camp alone”.

(Attachment N)

o

Per the September 9th, 2023 Bankson Lake Association Meeting Minutes:

“Ross [Adams] indicated that Miracle Camp does not have multi-million dollars

waiting for this project, they are going to have to fundraise and raise fees to get

this sewer”. (Attachment M).

DESCRIPTION OF IMPROVEMENTS

The proposed project will function as an extension of the existing Cass County. Lakes Area Sewer

Authority wastewater collection and treatment system that currently serves Cedar, Finch, Fish,

Gravel and West Saddlebag Lakes

in Porter Township, Van Buren County, Michigan and

Marcellus and Volinia Townships, Cass County, Michigan. The Lakes Area Sewer Authority

Section — Extension No.

2 collection system extension will discharge to

a forcemain, and

ultimately the wastewater treatment plant (WWTP). constructed as part of the initial Cass County,

Lakes Area Sewer Authority project. The initial project was completed in 2010 (four lakes and

WWTP) and the Cedar Lake extension completed in 2013. The overall system has sufficient

capacity to accept the extension and additional customers.

The proposed project includes a combination of 10” and 8” gravity sewers, manholes, 2”, 2 147, 4”

and 8” forcemain, 3 lift stations, 3 grinder stations (system type), and 9 individual grinder stations

(customer type) to serve nearly 185 Residential Equivalent Units. Capacity purchase costs for the

joint 12” forcemain from the connection point to the WWTP, as well as for the WWTP. are

included in the project costs and will offset a portion of the initial capital costs associated with

these improvements.

the principal balance of the Connection Fee is paid in full.

In the event no Bonds are sold, the

rate of interest on the unpaid principal balance of the Connection Fee shall be six percent (6%) per

annum.

Extension and the roll is divided into 30 annual installments of principal, Owner’s payment of the

Connection Fee due under this Contract, less the Prepayment Amount set forth in paragraph 4.a.,

above, shall be payable in 30 annual installments.

Cc.

If Porter, the Authority, and the County decide to not proceed with the

Bankson Lake Extension, the Authority shall refund the $300,000 deposit to Owner within 30 days

of such final decision by Porter, the Authority and the County.

d.

The Connection Fee shall not be subject to prepayment unless and until the

Bonds issued by the County are subject to redemption prior to maturity.

Once the Bonds are

subject to redemption prior to maturity, Owner may prepay all or any portion of any outstanding

principal balance of the Connection Fee, plus accrued interest thereon through the last day of the

month in which the prepayment is made.

Any such prepayment by Owner must be made to the

Authority on behalf of the Township not less than 60 days prior to the date of redemption of the

Bonds.

e.

The Authority or Porter will give notice to Owner within five (5) business

days of scheduling the date of the sale of the Bonds along with the most recent terms known at

that time (the “Bond Notice”).

f.

Notwithstanding the foregoing, at the election of Owner, Owner may pay

the entire balance of the Connection Fee for the connection described in paragraph 3 via a lump

sum payment, so long as Owner gives written notice of its intent to do so not later than 30 days

prior to the scheduled date of the sale of the Bonds, or within five (5) business days of receipt of

lien (as provided by the Sewer Ordinance and applicable state law) upon the Property for said

unpaid balance of the Connection Fees and the interest thereon which. in the event of default

therein, may be enforced by the Authority

or Porter

in the manner provided by the Sewer

Ordinance for unpaid Sewer Rates and Charges (as defined in the Sewer Ordinance).

The lien on

the Property shall be apportioned by Porter between the legal divisions of the Property, if any.

The lien and corresponding credit for payments then made to date and allocable to principal and

the obligation to pay the remaining principal balance shall

be made based on one indirect

connection fee, as determined by this Contract, for each Unit (or portion thereof) within the

Property.

Upon payment in full by the Owner of the Connection Fees and interest thereon

apportioned to any specific legal division of the Property, the amount due thereon shall be deemed

paid in full and the lien on that particular land division (if applicable) shall be discharged from the

records.

6.

ON-SITE COLLECTION SYSTEM.

a.

Owner shall pay for all costs related to the design, construction, operation,

maintenance, repair, replacement and improvement of the On-Site Collection System, including,

if necessary pumping stations and appurtenances thereto to collect the sanitary sewage from the

Property, and any abandonment of existing septic tanks and STEP sewer system components, and

deliver all sanitary sewage generated on the Property and so collected by the On-Site Collection

System to the Public Sewer System made available to the Property in accordance with paragraph

8 below.

Page 38

Final

June 4, 2026

the Owner’s On-Site Collection System to the Public Sewer System may need to be accomplished

in various phases (the “Phase Connection”).

Owner shall submit its proposed abandonment of

the existing septic tanks and STEP sewer system components, and Phased Connection schedule

for review and approval of the Authority’s engineer.

c.

Owner shall begin its Phased Connection of the On-Site Collection System

to the Public Sewer System within 90 days of receiving written notice from the Authority of the

availability of the Public Sewer System.

d.

Owner

shall

complete

the

necessary

improvements

to

the

On-Site

Collection System within two (2) months of connection of the On-Site Collection System to the

Public Sewer System.

e.

As part of the Owner’s On-Site Collection System, the Owner shall install

one or more sewage flow meters (the “Meter™), in accordance with the Authority's specifications,

which Meter(s) shall measure sewage flow from the Property to the Public Sewer System.

Once

the Meter is installed, the Meter shall be owned, operated, maintained, repaired, and replaced by

the Authority as part of the Public Sewer System.

The Meter shall either be located on public

property or on the Property and subject to an easement granted by Owner to Porter and the

Authority for access to such Meter.

Further the Authority shall have the right, but not the

obligation, to connect the Meter to the Authority's Supervisor Control Data Acquisition (SCADA)

system to aid in reading of said Meter.

f.

Owner hereby consents

to

the representatives

of Porter or Authority

Page 39

Final

June 4, 2026

shall have the right to inspect the Owner's On-Site Collection System at any reasonable time upon

reasonable advance notice to the Owner.

g.

The Owner

shall

be

solely

responsible

for

the

design,

construction,

operation, maintenance, repair, replacement and improvement of the On-Site Collection System

and the On-Site Collection System as currently existing (or hereinafter improved by Owner in the

future) shall not be considered part of the Public Sewer System and neither Porter or the Authority

shall have any right or responsibility for the operation, maintenance, repair, replacement or

improvement of the On-Site Collection System.

h.

Notwithstanding the foregoing, the Authority acknowledges that Owner's

abandonment of the existing septic tanks and STEP sewer system components and Phased

Connection may be delayed solely as a result of a Force Majeure Event. For purposes of this

Contract, a “Force Majeure Event” means only an act of God; natural disaster; severe weather

event that makes removal unsafe or unlawful; governmental order, restriction, or moratorium not

caused by Owner; act of terrorism; war; equipment or transportation availability; or region-wide

transportation shutdown or embargo. Force Majeure Event expressly excludes, and shall not

include, delays arising from Owner's financial condition, failure to plan or contract in advance,

contractor or subcontractor availability, labor shortages limited

to Owner or

its contractors,

scheduling conflicts, internal approvals, market conditions, or disputes with third parties. As a

condition to invoking this provision, Owner shall provide the Authority with written notice within

five (5) days after the commencement of the Force Majeure Event, describing the nature of the

pursue the abandonment of the existing septic tanks and STEP sewer system components and

Phased Connection as soon as such Force Majeure Event ceases to prevent the abandonment of

the existing septic tanks and STEP sewer system components and Phased Connection.

7.

SEWER ORDINANCE; APPLICABILITY TO CONTRACT. Upon connection

to the

Public Sewer System, the Owner (or Owner's successors and assigns) shall be subject to the terms

and conditions of the Sewer Ordinance, including applicable Sewer Rates and Charges established

thereafter for the use of the Public Sewer System.

Unless otherwise provided in an amendment

to the Sewer Ordinance, Sewer Rates and Charges for transportation and treatment of sewage from

the Property shall be based on actual metered flow from the Property as measured by the Meter

that is converted to a Unit basis (based on 178 gpd per Unit) and the then-current per Unit rate(s)

established by resolution of the Authority from time to time.

This Contract shall be subject to all

ordinances of the Authority and Porter and, to the extent of any conflict between this Contract and

the Sewer Ordinance as amended from time to time shall control.

8.

CONSTRUCTION OF PUBLIC SEWER SYSTEM TO PROPERTY.

The Authority, by

and through its contract with Porter and the County, shall cause the Public Sewer System to be

constructed to serve the Property and other properties along Bankson Lake

in Porter.

The

Authority represents and warrants that it will reserve for Owner within, and that said Public Sewer

System will be designed and constructed

to provide public sanitary sewer transportation and

treatment capacity for up to 22,500 gpd maximum daily flow of discharge from Owner’s Property

subject to regulatory approvals, system availability, EGLE requirements, and all federal, state and

this Contract, a public utility easement generally in the form attached hereto as Exhibit C, which

easement area shall be not more than twenty feet in width and adjacent to 80™ Avenue over the

entire frontage of the Property for the construction, operation, maintenance, repair and replacement

of necessary Public Sewer System infrastructure.

The final terms of the easement shall be

negotiated between the Owner and Authority and/or Porter, and the parties shall make a good faith

effort to minimize the impact of such easement on Owner’s Property including, but not limited to,

the size and extent of the easement and the impact to the Owner’s current tree canopy, provided

such efforts do not materially impair constructability, cost efficiency, regulatory compliancy or

long-term operation and maintenance.

Owner shall execute the easement in recordable form

within thirty (30) days after presentation by Authority.

9.

FLOW LIMITATIONS AND EXCEEDANCE PROVISION. The Owner’s maximum daily

flow under this Contract is 22,500 gpd (the “Maximum Daily Allowable Flow”). Any flow in

excess of the Maximum Daily Allowable Flow shall constitute “Excess Flow.”

The Owner shall

be liable to the Authority for a surcharge on the User Charge (the “User Surcharge™) for any Excess

Flow.

a.

The User Surcharge shall be equal to ten percent (10%) of the then-current

User Charge (the “User Surcharge Rate”).

b.

The User Surcharge shall be calculated by multiplying the volume of the

Excess Flow (in gallons) for that day on which the Excess Flow occurred (as measured by the

Meter) by the User Surcharge Rate.

The Parties acknowledge and agree that the Use Surcharge

Page 42

Final

June 4, 2026

Parties further acknowledge and agree that the Excess Flow Surcharge Rate shall not constitute a

tax, but rather shall represent payment for actual services rendered in compliance with the Headlee

Amendment to the Michigan Constitution (Article IX, Section 31).

c.

If the sewage from the Property as measured by the Meter exceeds the

Maximum Daily Allowable Flow, resulting in Excess Flow, on more than 14 distinct days within

any single billable quarter (a “Chronic Excess Flow Event”), the Authority shall provide the Owner

with written notice detailing the dates of non-compliance (e.g., specific days in which there was

Excess Flow) and the quantity of measured Excess Flow.

The Owner shall either: (1) make a

request to the Authority within 60 days of receipt of such notice of non-compliance to acquire

additional capacity (at then-current Sewer Rates and Charges including, but not limited

to,

additional Connection Fees) in the Bankson Lake Extension to accommodate the highest measured

quantity of Excess Flow, which shall then be added to and become the Owner’s new Maximum

Daily Allowable Flow under this Contract, or (2) remedy the circumstance(s) resulting in the

Chronic Excess Flow Event to the satisfaction of the Authority.

d.

INSPECTION.

No sewer connections shall be made to the Public Sewer

System until all sanitary sewer construction on the Property has been inspected by Porter or the

Authority and found to be

in compliance with all (Porter, Authority, and State) construction

regulations and furthermore, no sewer service shall be furnished unless all required payments,

inspection fees, and other applicable amounts due are current with Porter and the Authority.

Ordinance; (ii) failure of Owner to comply with any material term, covenant, or obligation under

this Contract or the Sewer Ordinance; (iii) failure of Owner to timely complete connection to the

Sewer System as required herein; (iv) discharge by Owner in violation of applicable law, permit

requirements. or the Sewer Ordinance; or (v) any representation or warranty of Owner contained

herein proving to have been materially false when made.

b.

Upon the occurrence of an Event of Default, the Authority and/or Porter

shall provide written notice thereof to Owner. Owner shall have thirty (30) days after receipt of

such notice to cure a monetary default and forty-five (45) days after receipt of such notice to cure

a non-monetary default; provided, however, that if a non-monetary default cannot reasonably be

cured within forty-five (45) days, Owner shall not be deemed

in default so long as Owner

commences cure within such period and thereafter diligently pursues completion of such cure.

c.

If an Event of Default is not timely cured, the Authority and/or Porter may

exercise any and all rights and remedies available at law or in equity, including, without limitation:

(i) acceleration of all unpaid amounts due under this Contract; (ii) enforcement of any lien rights

authorized by this Contract, the Sewer Ordinance,

or applicable law;

(iii) discontinuance or

suspension of sewer service to the extent permitted by law; (iv) imposition of penalties, interest,

surcharges, or additional fees authorized by the Sewer Ordinance or applicable law; and (v)

commencement of legal action to enforce the terms of this Contract. All such remedies shall be

cumulative and not exclusive.

the Authority and Porter for all reasonable attorney fees, court costs, engineering fees, expert fees,

and other costs and expenses incurred in connection therewith.

e.

Nothing contained herein shall be construed as a waiver by Porter or the

Authority of any governmental immunity, statutory protection, or limitation of liability available

under Michigan law.

11.

OWNER’S REPRESENTATIONS: Owner represents, warrants and certifies to the

Authority and Porter that:

Motion to approve agenda as written made by Andy Thorburn second by Daphne Sebastian.

Motion passed.

Motion to approve minutes from 07/29/2023 meeting made by Brand Jasik second by Karen

Churchill. Motion passed.

President Report — James Smith, President, thanked our Activity Committee for their hard

work, and residents for their participation in events throughout the year. James wanted to clarify

with Lake Association that he and Heather are not promoting for or against a sewer project.

James and Heather are unsure if a sewer project goes into the lake, if they will be able to

participate due to their location. They feel it could be good for the lake, and will help spread

information only and are staying neutral on the sewer project.

Vice President report — Don Mitchell, Vice President, absent.

Treasurer's Report - Susan Shirk, Treasurer, gave a detailed listing of all bank activities since

the last meeting. Balance as of 7/29/23 meeting was $9,405.35. There have been payments for

Landing Directors — correspondence from lake residents to Board. Tammy Hollingsworth

shared concerns from the LASA sewer meeting. There were disappointed comments on the

meeting being on a Sunday morning. Heather stated that it was a LASA (Lakes Area Sewer

Authority) meeting, not a lake association meeting. James said he would discourage LASA from

future Sunday morning meetings.

Tammy Hollingsworth also stated that there was a Q&A handout given at the LASA meeting that

she did not get because she didn't attend. Heather Smith explained this handout was created by

LASA, not the Lake Association. Heather provided the handout to Don Mitchell and it is on the

Bankson Lake website.

Weed Control — Wayne Shirk, Weed Control Chairperson, stated that water samples were

taken from the lake and tested for E Coli. Bankson Lake was well within acceptable limits. East

shore was at 76, Miracle Camp at 16, West shore at less than 4. Scott Gorton searched online

and found that 130 is the high limit for E Coli before levels become unsafe.

Wayne reminded everyone that with weed spraying, timing and temperature are important.

James Smith thanked Wayne for his hard work on the weed program.

Logo Store Update — Daphne stated that some people have requested the Bankson Lake logo

be updated. A graphic art designer friend of Renee Mahoney has created some new logo

options. Daphne will leave the options on the table, after the meeting, please feel free to check

them out and write down which one you like best.

Activity Update — Karla Gorton, Activity Committee Chairperson, stated there is one more

activity this year — Octoberfest on Kern Road, at the Miller/Stockover & Sugrue properties on

October 7. We have had a successful year. James reminded everyone that we can always use

volunteers at events throughout the year.

Public Comments

Tammy Hollingsworth had questions about the potential sewer project. On the Q&A form,

question 27 is — who financially benefits? She has heard rumors that family members of the

LASA board will benefit and the answer on the sheet is not clear. Heather reminded that the

Q&A was created by LASA, not the Bankson Lake Association, and questions could be directed

there.

Ross Adams from Miracle Camp offered updates on the potential sewer project. About 2 years

ago, Miracle Camp had issues with their current system. They contacted LASA and discussed

options, of which they have 3. 1-upgrade current system, 2- build their own wastewater

treatment system, 3-become a part of the LASA sewer system. Miracle Camp is currently

exploring the option to become a part of the LASA system. Since this is on the lake, LASA is

Page 84

indicated that Miracle Camp does not have multi-million dollars waiting for this project, they are

going to have to fundraise and raise fees to get this sewer.

Seth Churchill — asked several questions on how much of the project Miracle Camp is going to

pay. He had concerns that residents will be paying part of Miracle Camp’s project cost. Is

Miracle Camp going to get a price for their own project and also a price for

a combined project?

And are they going to pay that single project cost either way, or will lake residents pay more

than they should? Would Miracle Camp do the project alone if residents decide not to join? Ross

— yes. Seth asked if estimates have considered the cost of easements, as 6 miles of easements

will be expensive to get. Seth Churchill had concerns that ratio of Miracle Camp to parcel was

not fair to residents.

Heather Smith stated unofficial sewer survey was sent out and results given to LASA. LASA

determined there was enough positive interest in a sewer project to go forward with the petition

process. Petition wording will be approved by LASA and then by the Township at meetings this

week. Then people who were willing to circulate petitions will be contacted to begin that

process.

Alice Crimaldi asked if people do not want to hook up, will they be forced to? Heather Smith

answered that it is her understanding that if a sewer project is put in place at your residence,

you will be required to hook up. Alice had concerns that we are faced with 2 assessments — the

drain and the sewer - and that some people will be priced out of their homes/cottages. Alice

wants Miracle Camp to get their own system and not include Bankson Lake.

Scott Gorton requested that LASA give residents the estimates of Miracle Camp going alone,

and with Bankson Lake. Scott also mentioned that the sewer project was brought up in the past

and was turned down. Scott stated that pollution in lake is caused 1/3 by human, 1/3 by animals,

and 1/3 by runoff. This project would spend money to fix only 1/3 of the problem.

Keith Russell questioned the trend on area lakes for sewers. Ross Adams indicated that Gravel

Lake and Cedar Lake are hooked up to LASA system. Ross also indicated that the State of

Michigan has passed many clean water initiatives, and are getting more and more restrictive in

order to protect water quality.

Wayne Shirk asked if Miracle Camp has plans to expend/double it's size? Ross indicated they

currently have 425 beds, and may add/expand to 100-200 more beds. There are many

infrastructure factors to consider, and it is unknown at this time.

Side note from Ross Adams — 2025 will be Miracle Camp's 60 Anniversary!

Jeff Kolbe asked about wash station at public access. James Smith and Wayne Shirk attended

a seminar regarding wash stations a year or so ago.

It was noted then that either EGLE or DNR

Page 85

the township created a resolution a couple years ago, so the 70% is not needed. Clint will find

out about fees and charges.

Clint Sebastian also stated that there was a speed limit warning/recorder on Waldron Drive from

Aug 22-28. The results of the recorder show 2,622 passes in that one week. Only 14 instances

of speeding, two of those being 30-35 mph over speed limit.

Carol Hutchison asked about raising Lake Association dues, as $20 per year seems low

compared to landing dues, etc. This could be an option in the future, general consensus is that it

is not needed now.

John Crimaldi had concerns that the high number on one of the water samples could be due to

the dust control. He stated that whatever they use as dust control on Kern Road runs into lake,

makes a film, and is oily. Heather suggested that any resident who has this concern should

contact the Van Buren County Road Commission.

Motion to adjourn by Daphne Sebastian, second by Karen Churchill. Motion passed.

Meeting schedule for 2024 will be in spring newsletter and on the website when it becomes

Call to order & welcome — James Smith, President, welcomed everyone at 9:08 am.

Motion to approve agenda as written made by Daphne Sebastian second by Scott

Gordon. Motion passed.

Motion to approve amended minutes from 09/11/2021 meeting, with one correction -

minutes indicated that Jeff Kolbe stated the township is mandating a sewer for our lake.

Jeff Kolbe clarified that no one is mandating at this point, but most likely the State of

Michigan will be mandating a sewer in the future. Motion to approve minutes as

corrected made by Karen Churchill, second by Scott Gorton. Motion passed.

President Report — James Smith, President, took a moment to recognize a few long

time members of our lake and association who passed this past year — Bill Cronenwett

Jr, Bill Cronenwett Sr, and Garth Prindle.

James complimented Wayne Shirk on our successful weed control last year. Reminder

to practice safe boating near docks & swim rafts, please slow down and be safe. James

noted that officers will be elected at the next meeting. He had conversations with current

officers and all are willing to serve again, but if anyone else is interested in being an

officer, please attend next meeting when we will vote. Also at the next meeting, James

has invited Matt Diana from the DNR to attend. He will discuss fish & vegetation. DNR

stocks muskee in our lake. Please prepare any questions you may have for the DNR.

Vice President report — Don Mitchell, Vice President, announced the 2022 schedule is

on the Bankson Lake Association website. There is a lot of information and links on the

website. We have expanded website capacity, be sure to check it out.

Treasurer's Report - Susan Shirk, Treasurer, reported that as of the 9/11/21 meeting,

Page 88

On Monday will be an evaluation of weeds on the lake. The first treatment is scheduled

for 5/23, weather depending. Reminder that we only treat/spray for invasive weeds, we

do not treat for lily pads. A great source of information on what are invasive weeds are

on the website — www.michiganlakeinfo.com.

Stocking Fish — Chuck Slucas indicated that we will be getting 1000 (4-5 inch) perch

added to the lake in the upcoming weeks.

Updating By-Laws — The By-Laws were written many years ago and could use some

updates. One example is allowing more information to be shared via email vs mail.

Anyone is welcome to review By-Laws and bring suggestions to future meetings. A

committee was formed to begin working on rough draft updates, and then will need to

be sent to a lawyer for review. Committee consists of Karen Churchill, Tammy

Hollingsworth, Bridgid Miller, Don Mitchell, Heather Smith

New Resident — Craig Gray, Maxine Water's grandson was introduced and welcomed

to our lake.

Beaver Damage — Gary Hainrihar was concerned about beaver damage to trees

around lake. Trapping season ended 4/28/2022, and won't start again until 11/10/2022.

Permit from DNR is required for trapping. Discussion about a lake resident who used a

trapper that did not charge any money, just took the hides as his payment. Jeff Kolbe

wondered if muskrat could be trapped along with beaver. This item will be put on next

agenda so we can ask questions of Matt Diana from DNR. Heather Smith, Secretary,

will take a list of names & addresses of residents interested in allowing a trapper on

their property during trapping season. Residents are also asked to provide any

information on trappers they have used.

Speed limits - James Smith, President, asked that everyone be mindful of speed limits

in residential neighborhoods. The Lake Association does not have ability to do anything

about speeders, just a reminder to be good neighbors and remember that kids and dogs

can run into the street at any time. Waldron and 80" Avenue are areas of concern,

please be mindful of your speed and surroundings.

Activity Committee — Karla Gorton, Activity Committee Chairperson — stated the

committee are hosting the same events as last year and adding a pancake breakfast

fund raiser this year. The funds will be used to cover activity costs. Anyone is invited to

the pancake breakfast, not just lake residents, feel free to invite family and friends.

Bridgid Miller invited all lake residents to her & Sugrue's Octoberfest the 2" weekend in

October. She will get a flyer together and Heather will distribute to lake residents.

Fund approval — motion to approve porta potties at events as needed throughout year

Page 89

Ross Adams, Executive Director of Miracle Camp, is looking at long term solutions and

is in discussions with LASA about hooking onto their sewer system. Cost to run and

hook up is roughly $2.5 million, which is not feasible for Miracle Camp alone.

Tammy Hollingsworth asked for an update on the mute swans. This will be something

we can ask of Matt Diana at next meeting.

Motion to adjourn meeting made at 10:00 by Randy Rice seconded by Daphne

Sebastian. Motion passed.

Next meeting will be June 18 at 10 am at Porter Township Hall.

Meeting of the Bankson Lake Association

Porter Township Hall, 88040 M-40, Lawton

June 20, 2026

Attending: Officers: James Smith - President; Susan Shirk — Treasurer, Heather Smith -

Secretary

Attending: Landing Directors: Scott Gorton (Lytle), Tammy Hollingsworth (Kern), Brand Jasik

(Lytle), Jeff Kolbe (Laguna), Sharon Noteboom (Waldron), Keith Russell (North Shore), Clint

Sebastian (Waldron), Wayne Shirk (Beechwood)

Attending: Guests: Joe & Maureen Beall, Seth & Karen Churchill, Gary Cihak & Jen Taylor,

Mark & Traci Dyksterhouse, Dan & Elaine Gilman, Karla Gorton, Carol Hutchison, Bill Johnson,

Bridgid Miller, Don Mitchell, Randy & Laurie Rice, Jayne Russell, Bethany Stewart, Jon & Karen

Taylor, Martha Wright

Call to order & welcome — James Smith, President, welcomed everyone at 10 am.

Motion to approve agenda as written made by Martha Wright second by Scott Gorton. Motion

passed.

Motion to approve minutes from 05/02/26 meeting made by Brand Jasik, second by Maureen

Beall. Motion passed.

Guest speakers — Alan Smaka, LASA (Lakes Area Sewer Authority), & Chris Oxley, Porter

Township Supervisor & LASA

Before sewer update, Chris Oxley gave general township updates. He invited residents to look

at addition to the township hall, built in collaboration with Senior Services of Van Buren County.

Senior Services currently does lunch and activities on Thursdays from 11-1 at Porter Township

Hall. The Lawton Fire Department ordered a new fire truck. It is already paid for through the

Porter Township Fire Special Assessment District. Porter Township is working on an agreement

to begin blight enforcement services through Van Buren County Sheriff Department, who

currently serve 15 other townships.

Sewer Update — Sewer bond contracts & engagement letters were signed last week. LASA —

Lakes Area Sewer Authority — is made up of 3 townships — Porter, Marcellus, and Volinia.

Over the past year, Miracle Camp and LASA signed a sewer agreement. Miracle Camp bought

additional capacity for future needs. LASA is pursuing a Construction Management Approach,

similar to a homeowner being their own general contractor when building a home. This will lower

Page 92

Costs are still estimates, as the jobs have not been bid out yet. Current estimates are:

$25,000 Benefit fee —

residents can pay up front or over the term of the bond at 1% over bond rate —

estimated at 4-5%, giving residents a 5-6% estimated rate, if rates stay consistent.

Currently looking at 25-30 year bond period. This fee will be charged to any parcel

that connects to the sewer. If someone connects later, the cost could be different.

$4,000 Parcel fee —

This will be charged if connected to sewer or not. Every parcel in the SAD (Special

Assessment District) will get a parcel fee, even if a vacant lot. This can be charged

on tax bill over the term of the bond.

$72.50 Monthly fee

Same rate charged to all LASA customers. Increases annually with inflation.

$1500-$5000 Fee to hook up to new system and abandon current septic systems.

Homeowner will need to contract this out. Generally,

a company will quote several

neighbors at the same time and give discounted rates as more parcels are

contracted — so talk to your neighbors and ask about such discounts.

The LASA sewer presentation from a couple years ago is on the Bankson Lake website. The

narrative in that presentation also breaks down cost.

Bill Johnson asked about grants for the project. The grants which were available when past

sewer projects went in are not available anymore. Alan Smaka stated that USDA does have

grants available, but they come with extra requirements on the project, which overall make the

project more expensive, even if grant is awarded. Also, those grants are very limited now.

The sewer project is being split into 4 quadrants of the lake. There were several questions about

the plan and who is impacted, Don Mitchell agreed to put the information on the Bankson Lake

website.

Chris Oxley stated the Sewer Special Assessment District will begin to be set up in the next

month or so.

Miracle Camp will have a metered flow on their sewer usage, and they have a peak they have

agreed to, and will have to pay extra if they go over it. Miracle Camp is paying about $1.9 million

toward this project, prepaying some of that fee. Residents will be based on REU (Residential

Equivalent Unit), basically meaning one house is one unit/REU.

It was mentioned that if residents have 2 parcels that can be combined, that could save a

resident the second parcel fee.

Sewer hookup is mandatory if you are in the Sewer Special Assessment District. The current

design map will soon be available on the Bankson Lake website. The map will have a yellow

Page 93

The sewer line will be drilled under the lake in a couple spots — from 80% to Waldron, and from

Lytle’s to Shore. Check map online for locations. This is currently done on Finch Lake also. The

line is drilled 10 feet under the bottom of the lake.

On roads where a sewer is going in, you will get a new road out of this project. Residents will

always have access to their homes, but there could be limited days when you may need to park

down a street, etc. These times will be conveyed to residents and coordinated ahead of time.

Jeff Kolbe asked about the capacity of the LASA plant. Right now, it is run at 20-40% plant

capacity. Adding Bankson will make it around 55% capacity. Note that on holiday weekends,

etc., it can be up to 70% capacity.

Back lots within 200 feet will be required to connect, per state law and township ordinance.

Chris Oxley suggested that once the maps are published on the Bankson website, that he and

Alan would be willing to have another meeting to go through individual questions.

LASA meetings are the 15 Monday of each month at 6:00 pm, at the LASA Treatment facility,

53550 Hemlock Lake Road, Marcellus.

Elect Officers — Motion by Martha Wright, support by Randy Rice to nominate all current

Officers for a one year term. Motion approved.

Elect Landing Directors - Motion by Bridgid Miller, support by Randy Rice to nominate all

current Landing Directors for a one year term. Motion approved.

President Report — James Smith, President, announced that the Bankson Solar Project has

changed their name to Banner Pines Solar Project.

James announced that an AED Defibrillator has been installed on the Sampsell’s shed, about

mid-way down Waldron Drive. Heather Smith will put a picture of the shed on the Bankson

Community Facebook page. Please take a minute on your next boat trip and locate it. Thank

you to the Sampsell Family for installing this device for our residents!

Mike Mahoney is looking into placing an AED on the roadside of his property also.

Vice President report — Rudy Cortes, Vice President, absent, no report.

Treasurer’s Report - Susan Shirk, Treasurer, reported that as of the 5/2/26 meeting, the BLA

bank balance was $11,161.46. We have continued to collect dues and logo store. Our current

balance is $11,012.46.

Page 94

Weed Control — Wayne Shirk, Weed Control Chairperson, stated that we had a heavier weed

treatment on 5/26, and an algae treatment on 6/12. Algae has been caused by rain/run

off/inutrients in water. EGLE limits how and where you can treat for algae. James Smith thanked

Wayne for this ongoing weed work, and indicated that the Weed Assessment has a surplus of

funds due to Wayne's diligent work. That is how the weed assessment rate may be lowered this

year.

Website Update — Don Mitchell, will post information from LASA. The LASA presentation and Q

& A from the presentation a couple years ago is currently on the homepage. Don will also post

a map with the AED location on Waldron.

Logo Store Update — Clinton stated the logo store is always open. An order was placed for golf

shirts to be sold at the pancake breakfast. Give him or Daphne a call for all your logo store

wants and needs.

Activity Update — Randy Rice, chairperson, reminded everyone that participation is what make

the activities fun! Please join us in our upcoming activities (calendar below)
