Re;

Fair Haven, M1 48023

Dear Members of the Board of Review,

On December 7, 2021

| applied for a building permit for repairs of an existing structure. This

included repairs to the roof, walls, floor and block of the existing structure.

On January 10, 2022 a building permit #PB220010 was issued to repair the roof, walls, floor

and block of the existing garage/ boat house.

On February 9, 2022

| applied to the Zoning Board of Appeals for a variance of section 7.23

NONCONFORMITIES for “repair of an existing structure which is non-conforming. To facilitate

repairs and the quality of construction, the repairs may go beyond 60% of the assessed value

of the building, provided that the cubic content of the building as it existed at the time of pas-

sage or amendment of this ordinance shall not be increased. Nothing in this ordinance shall

be deemed to prevent the strengthening or restoring to a safe condition of any building or

part thereof declared to be unsafe by any official charged with protecting the public safety,

upon order of such official.”

| would also site the Mathieu Gast Act, P.A. 293 of 1976 as amended, MCL 211.27(2)

Non- Consideration of the True Cash Value of Normal Repairs, Replacements and Mainte-

nance for Residential Property. MCL 211.27(2) states: The assessor shall not consider the in-

crease in true cash value that is a result of expenditures for normal repairs, replacement, and

maintenance in determining the true cash value of property for assessment purposes until the

property is sold. The following repairs are considered normal maintenance if they are not part

of a structural addition or completion.
