TO ENTIRE TRIBUNAL PROPERTY TAX PETITION

Respondent, Crystal Lake Township, by and through its attorneys, Foster, Swift, Collins &

Smith, P.C., states as follows for its Answer to Petitioner’s Entire Tribunal Property Tax Petition:

1.

Petitioner Wychwood Cottages, LLC (“Petitioner”) is a Michigan limited liability

company with its registered office at 4033 Eastern Sky, Traverse City, MI.

ANSWER: Respondent is without sufficient knowledge or information to form a

belief as to the truth of the allegations of paragraph 1 of the Petition and, therefore,

neither admits nor denies the allegations, but leaves Petitioner to its proofs.

2.

Petitioner is the owner of and/or the party in interest with respect to the subject

Page 2

real property (the “Property”) which is located in Crystal Lake Township,

Benzie County, Michigan, and is more particularly described as:

Parcel No.

Property Address

05-085-033-00

2469 Pilgrim Hwy, Frankfort, MI 49635

ANSWER: Respondent admits that, per its assessment records, Petitioner,

Wychwood Cottages, LLC, is the owner of the Subject Property. Whether

Petitioner is also a party in interest is a legal conclusion to which no response is

required. To the extent that a response is required, Respondent states that it is

without sufficient knowledge or information to form a belief as to that allegation,

and leaves Petitioner to its proofs.

3.

Respondent, Crystal Lake Township, assesses, levies and collects the property

taxes on the Property. Respondent Benzie County collects “delinquent” property

taxes on the Property. Crystal Lake Township and Benzie County will cumulatively

be referred to herein as “Respondents.”

ANSWER: Respondent admits that Crystal Lake Township is responsible for

assessing, levying and collecting property taxes on the Subject Property.

4.

The property is located in Benzie County and is located with the Frankfort Area

Public School District.

ANSWER: Respondent admits the allegations contained in paragraph 4.

5.

The Property is classified as 401 (residential-improved real property).

ANSWER: Respondent admits the allegations contained in paragraph 5.

6.

The Property was originally constructed to be used as a place for family and friends

to gather and reside, and it is currently used for the same purpose.

ANSWER: Respondent is without sufficient knowledge or information to form a

belief as to the truth of the allegations of paragraph 6 of the Petition and, therefore,

neither admits nor denies the allegations, but leaves Petitioner to its proofs.

7.

This matter involves issues relating to taxable value.

ANSWER: Respondent admits the allegation contained in paragraph 7 of the Petition.

8.

 The tax years at issue are tax years, 2012, 2013, 2014, 2015, 2016, 2017, 2018,

2019, 2020, 2021, 2022, and 2023.

Page 3

ANSWER: Respondent admits the allegations contained in paragraph 8 of the Petition.

9.

On or about September 4, 2024, Respondent Benzie County sent the attached letter

to Petitioner notifying it that Respondent Crystal Lake Township had retroactively

uncapped the Property for tax years 2012 through 2023. See Exhibit 1. The letter

included an invoice for “DELINQUENT TAXES DUE.” Id.

ANSWER: Respondent admits that the letter attached to the Petition as Exhibit 1 is

dated September 4, 2024. Regarding Petitioner’s description of the contents of the

letter, Respondent states that the letter speaks for itself.

10.

This letter is the first notice that Petitioner received regarding the purported

uncapping of the Property for the tax years at issue. This appeal has been filed

within thirty-five (35) days of Respondents’ letter and is timely under MCL

205.735(a)(6).

ANSWER: Respondent lacks sufficient knowledge or information to form a belief as to

the truth of when Petitioner first received notice of the uncapping. Respondent denies

that the County’s September 4, 2024 letter was the first notice provided to Petitioner

regarding the uncapping. On August 23, 2024, Respondent, Crystal Lake Township, sent

a Notice of Uncapping to Petitioner advising that Petitioner must appeal the Uncapping

Notice within 35 days of August 23, 2024. That Notice of Uncapping is attached hereto

as Exhibit 1. Petitioner’s statement that this appeal is filed timely is a legal conclusion

to which no answer is required. To the extent that an answer is required, Respondent

denies the allegation.

11.

are as follows:

ANSWER:

Respondent Crystal Lake Township denies that the Revised Taxable Value for

the 2021 tax year was $797,729 as, per the applicable inflation rate multiplier, the Revised

Taxable Value was determined to be $787,729. Respondent admits the remaining allegations

contained in paragraph 12 of the Petition. See Uncapping Notice, Exhibit 1.

$854,410

$283,924

ANSWER:

Respondent denies Petitioner’s calculation of the taxable value in dispute for

the 2021 tax year for the reasons stated above in response to Petitioner’s paragraph 12 but

admits the remaining allegations of paragraph 13.

Page 5

14.

Despite Respondents' recent recalculation of the Property's taxable values, there was

no transfer of ownership under MCL 211.27a(6) and no other uncapping event in tax

year 2012 (calendar year 2011) or in any other year that is subject to this appeal. Thus,

Respondents' current effort to uncap the taxable values for the Property for tax years

2012, 2013, 2014, 2015, 2016, 2017, 2018, 2019, 2020, 2021, 2022, and 2023 violates

Michigan law.

ANSWER:

Respondent denies Petitioner’s allegation that no transfer of ownership

occurred in 2011 and denies that the uncapping violates Michigan law. See Quitclaim

Deeds, attached hereto as Exhibit 2.

15.

Indeed, the Property has been owned and controlled by the same family and its

descendants for over 100 years (since approximately 1917).

ANSWER:

Respondent is without sufficient knowledge or information to form a belief

as to the truth of the allegations of paragraph 15 of the Petition and, therefore, neither

admits nor denies the allegations, but leaves Petitioner to its proofs.

16.

Petitioner requests the reduction of the Property's taxable values to those identified as

the Original Taxable Values in paragraphs 11 and 13 above. Petitioner further requests a

refund with interest of taxes paid due to the original, incorrect assessment and any

other relief this Tribunal deems appropriate.

ANSWER:

Respondent denies that Petitioner is entitled to the relief requested in

paragraph 16 of the Petition.

17.

The tax year 2012 through 2023 taxable values imposed on the Property, and the taxes

to be levied and collected thereon, are invalid and unlawful and operate as fraud upon

the taxpayer for the reason that the Property's taxable values exceed the amounts

permitted by the Michigan Constitution and applicable statutes.

ANSWER:

Respondent denies the allegation contained in paragraph 17 of the Petition for

the reason that they are untrue.

WHEREFORE, Petitioner requests that the Tribunal grant the following relief:

A.

Reinstate the taxable values of the Property as follows:

Tax Year

Original Taxable Value

2012

$455,138

2013

$466,061

2014

2022

$543,320

2023

$570,486

B.

Provide such additional relief to Petitioner as this Tribunal shall deem

appropriate.

ANSWER:

Respondent denies that Petitioner is entitled to the relief requested.

AFFIRMATIVE DEFENSES

Respondent, Crystal Lake Township, by and through its attorneys, Foster, Swift, Collins &

2.116(C)(4) and (8)), including on, but not necessarily limited to, the following grounds:

a.

The Petition does not comply with the Tax Tribunal Rules TTR 227(1) and

Page 7

incorrect.

d.

The Petitioner provides no factual basis to support the claim for different

7.

The Tribunal may lack subject matter jurisdiction over this appeal. MCR

2.116(C)(4) and (8).

8.

Respondent has properly and lawfully assessed Petitioner’s property and

established its taxable value in accordance with statutory and constitutional requirements.

9.

Petitioner may have failed to file a Property Transfer Affidavit, as required by

Michigan law.

10.

Petitioner may have failed to file its Petition within 35 days of Respondent’s Notice

of Uncapping, dated August 23, 2024, thus depriving the Tribunal of jurisdiction over this appeal.

MCL 205.735a(6).

11.

Respondent reserves the right to add additional affirmative defenses as they become

known to it through discovery in this matter.

WHEREFORE, Respondent requests that the Tribunal affirm the assessed and taxable

values as determined by Respondent, dismiss the Petition, and award Respondent its costs and

attorney fees and any other relief that the Tribunal determines is fair, just, and equitable.
