ORDER VACATING JANUARY 21, 2026 ORDER HOLDING PETITIONER IN

DEFAULT

The Tribunal has considered the file in this case and finds that it entered an order

holding Petitioner in default on January 21, 2026. The Tribunal erred in the entry of this

order, as Petitioner timely filed a copy of the notice giving rise to the appeal.1 It appears

that the filing had simply not been processed as of the entry of the January 21, 2026

order. As such, and inasmuch as Petitioner has complied with the Tribunal’s rules of

practice and procedure, the Tribunal finds good cause to vacate the default order.

Therefore,

IT IS ORDERED that the January 21, 2026 Order Holding Petitioner in Default is

VACATED.

1 Petitioner’s filing indicated an appeal for the 2022, 2023, and 2024 tax years. While Petitioner’s claims

regarding the 2024 tax year are currently under appeal in MTT Docket No. 25-000030, on January 13,

2025, the Tribunal issued an Order of Partial Dismissal, dismissing Petitioner’s claims regarding the 2022

and 2023 tax years. On January 10, 2026, Petitioner filed an amended petition in MTT Docket No. 26-

000070, again listing the previously dismissed tax years; however, the previously issued order stands and

the claims regarding those tax years shall remain dismissed.
