STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR Are the parcels listed by Petitioner contiguous or adjoining? If no, list which parcels are adjoining. N/A Classification of Property: Real Residential Section 4: Explain Your Answer to this Appeal Respondent acknowledges that MCL 211.7cc(2), as amended by Public Act 141 of 2022, authorizes the local assessor to grant a Principal Residence Exemption (PRE) for the current calendar year and the immediately preceding three calendar years when the property owner meets the statutory eligibility requirements. However, the statute does not authorize the local assessor to grant a PRE for tax years beyond that period. The assessor’s authority is expressly limited by MCL 211.7cc(2) to the current calendar year and the three immediately preceding calendar years. Neither the statute nor Public Act 141 of 2022 provides the assessor with authority to retroactively grant a PRE for earlier tax years. Accordingly, any request for a PRE extending beyond the current calendar year and the three immediately preceding calendar years exceeds the authority granted to the local assessor under MCL 211.7cc(2).
