Petitioner — Swan Creek IV LLC MICHIGAN TAX TRIBUNAL Vv Respondent — Township of Fremont, Saginaw Co. MOAHR Docket No. Parcel No. 7315-11-2-11-1002-000 7315-11-2-11-2001-002 20. List the separate and specific facts upon which Petitioner relies to support the relief requested Fact 1 - Clearing trees and grading dirt berms to store excess soils do not warrant a $482,000 true cash value increase to the total property valuations. Fact 2 - The Petitioner's intended use of the two properties is for future residential single family subdivisions, many of the improvements made are exempt infrastructure improvements as determined by the Michigan Supreme Court in the Toll Northville LTD and Biltmore Wineman LLC v Township of Northville. Fact 3 - The new assessments illegally and substantially increased the valuations of the two contiguous properties above 50% of the actual true cash value/market value of the properties. Fact 4 - The Taxable Value was illegally increased by more than $240,950 in additions that should be exempt. Fact 5 - Lack of assessment uniformity. No other properties in Fremont Township were assessed for similar dirt berms. This is nothing more than predatory assessing and unfairly assessing the petitioner differently than other similar properties in Fremont Township. Fact 6 — The July Board of Review states the reason for the property additions was for a “Mutual Mistake of Fact”. There was no “Mutual Agreement” that these additions should be added to the subject properties. That determination was made unilaterally by the assessor with a request to make the change at the 2025 July Board of Review. These changes to the subject properties’ values are just another blatant failure of the assessment administration of Fremont Township, Saginaw County.
