COLLIS, GRIFFOR & HENDRA A PROFESSIONAL CORPORATION 1851 Washtenaw Avenue Ypsilanti, MI 48197 Phone: 739 481-8911 Fax: (734) 481-8918 March 12, 2025 Pittsfield Township Department of Assessment Board of Review 6201 W. Michigan Ave. Ann Arbor, MI 48108 Dear Board of Review: We are requesting a re-evaluation of the assessment. As noted by the assessor, this is a property under construction. At the moment, there is a retaining wall on this property and two adjoining properties that is damaged to the point that if it is not repaired soon, will cause none of the three properties to have any business in these buildings. There have been issues with obtaining consent for a maintenance agreement with one of the adjacent properties, owned by Jane Bassett, resulting in a delay of at least 4 months in making necessary repairs that the Township desires. Under such circumstances, it is inconceivable that the taxable value would nearly double from $161,575 to $303,183 and that the assessor believes that the property value would increase from $373,762 to $505,260 in just one year. Also, the increase in taxable value appears to be tied to the “Additions” provision of the Michigan Constitution. However, under Michigan Law, replacement construction is not included under the provision that allows an increase in taxable value above the annual inflation threshold. As the construction in question was composed of the replacement of retaining walls and other drainage processes as a result of their damage as well as the replacement of the existing parking lot, such construction is exempt from increases a property’s taxable value under MCL 205.735a. Furthermore, while there are now some tenants in this building, those leases were created without the anticipation of nearly doubling the taxable value. Consequently, this will cause Great Arbor Properties to function at a loss and be unable to provide adequate services to the tenants that lease at this property. Unfortunately, due to. this being Ramadan, our client was unable to obtain comparables or other documentation relevant to further demonstrate the hardship and unfairness of this increase. If given an adjourned date until after Ramadan, our client could provide more documentation that would further demonstrate the harshness and irrationality of the assessed and taxable values. Sincerely, Jlrlow £. ya Andrew C. Hendra
