Halm ORDER SETTING ASIDE RESPONDENT’S DEFAULT The Tribunal has considered the file in this case and finds that it entered an order on February 3, 2026, holding Respondent in default for failing to appear at a duly-noticed hearing. Respondent was required to file information and documentation justifying their absence within 14 days to assist the Tribunal in determining whether a default hearing was warranted.1 Respondent filed a response on February 3, 2026, indicating Respondent “[w]as having a hard time to connect to telephonic and also hearing was conflicting with another hearing.” The Tribunal has considered the response and finds that Respondent’s failure to appear was not willful and they have no history of refusing to comply with Tribunal orders or of deliberate delay. Respondent timely responded to the default order and allowing them continued participation in this matter will not prejudice Petitioner. Therefore, IT IS ORDERED that Respondent’s default is SET ASIDE. IT IS FURTHER ORDERED that the hearing shall be rescheduled in the normal course of scheduling.
