REPEATED REQUESTS FOR MISSING SHERWOOD FOREST RESOLUTION AND

OCTOBER 11, 2023, FIRST-HEARING DEFECT

Exhibit 11 — Page 1 of 21

Source Record:

Combined City Council Formal Session and Budget, Finance and Audit Standing Committee transcript

records for June 7, 2023; June 13, 2023; October 11, 2023; October 17, 2023; October 18, 2023; and

October 24, 2023; November 8, 2023, Budget, Finance and Audit Standing Committee eSCRIBE

Agenda Package excerpt; and Clerk archive / Detroit Legal News public-hearing notice excerpt.

Short Title:

Repeated Resolution Requests / October 11 First-Hearing No-Attachment Defect

Purpose of Exhibit:

This exhibit is offered to show that Deputy CFO / Assessor Alvin Horhn was repeatedly placed on

record notice that a resolution was required before the Sherwood Forest SAD renewal hearing process

could properly proceed. Despite that notice, the October 11, 2023, first public hearing proceeded with

No Attachments and without any identified Sherwood Forest-specific resolution, tentative

assessment roll, Clerk-filed public-examination record, Administering Department report, land-

area verification record, or notice-supporting authority material available to affected Sherwood

Forest owners before that hearing.

Material Record Points:

1. On June 7, 2023, Committee Chair Fred Durhal asked whether the item was merely a report or a

resolution, and whether another request or line item would be needed to set the public hearing.

2. On June 7, 2023, Assistant City Council Committee Clerk Cindy Golden stated that, to set the

public hearing, “we would need a resolution to do so.”

3. On June 7, 2023, Golden stated that no resolution was attached and that no document had been

attached in the form of a resolution.

4. On June 7, 2023, Durhal asked Horhn whether he had the resolution and whether it had been

submitted through eSCRIBE.

5. On June 7, 2023, Horhn acknowledged that the resolution had not been submitted and stated that

he “should have known better.”

6. On June 7, 2023, Golden explained the upload timing required for a resolution to appear on the

next Formal Session agenda.

7. On June 7, 2023, the Committee moved Line Item 8.4 to Formal Session with a recommendation

to approve pending attachment of the resolution.

Page 2

8. On June 13, 2023, the Formal Session record still identified the item as “PENDING THE

RESOLUTION” and listed Detroit Golf Club and Palmer Woods resolution attachments, but no

comparable Sherwood Forest-specific resolution attachment.

9. On October 11, 2023, the first public-hearing record stated, “No Attachments.”

10. On October 11, 2023, after the first public hearing, Golden asked Horhn whether he would

provide the resolution for the matter to go before the full City Council.

11. On October 11, 2023, Durhal asked Horhn to provide a copy of the resolution before the next

Formal Session so Council could “lay eyes on it.”

12. The first combined Detroit Golf Club / Palmer Woods / Sherwood Forest resolution appearing

after the October 11, 2023, first public hearing was dated October 13, 2023. That document is

addressed separately in Exhibit 10.

13. On October 17, 2023, the Formal Session record shows that the matter was sent back to Budget,

Finance and Audit for a continued or additional public hearing.

14. On October 18, 2023, Horhn apologized for the prior week’s imprecise language and stated, “By

mistake I did not catch the Clerk in time.”

15. On October 24, 2023, the Formal Session record shows that Council approved setting the second

public hearing for November 8, 2023.

16. The November 8, 2023, Budget, Finance and Audit eSCRIBE Agenda Package identifies a 1:10

p.m. continued public hearing concerning Chapter 17 purchasing-and-supplies amendments, not

the noticed Sherwood Forest / Detroit Golf Club / Palmer Woods SAD second public hearing.

Tribunal Relevance:

This exhibit is material because it shows that the October 11, 2023, first public hearing occurred after

repeated record notice that the required resolution had not been submitted. The reviewed record does not

show that a Sherwood Forest-specific resolution, tentative assessment roll, Clerk-filed public-

examination record, Administering Department report, land-area verification record, or notice-

supporting authority material was attached, filed, or made available before affected Sherwood Forest

owners were expected to appear, review the matter, and object at the first public hearing.

Golden’s October 11, 2023, post-hearing request for the resolution is material because it shows that the

resolution issue remained unresolved at the time affected owners were expected to have already

appeared and objected. Durhal’s request that Council be allowed to “lay eyes on it” before Formal

Session is also material because affected Sherwood Forest owners needed a meaningful opportunity to

review the same core authority materials before the hearing.

The October 13, 2023, combined resolution did not cure the first-hearing defect because it appeared

after the first public hearing had already occurred. As shown in Exhibit 10, a post-hearing combined

multi-district resolution cannot retroactively serve as the pre-hearing Sherwood Forest-specific

resolution, tentative assessment roll, Clerk-filed public-examination record, land-area verification

record, or notice-supporting authority material required before the October 11, 2023, hearing.

Exhibit 11 — Page 2 of 21

Page 3

This exhibit is also material to Petitioner’s protest and waiver position. If the required Sherwood Forest-

specific authority-chain materials were not attached, filed, or available before the October 11, 2023,

hearing, then Petitioner’s nonappearance or failure to protest at that hearing should not be treated as

waiver, consent, acquiescence, or confirmation of lawful notice.

The November 8, 2023, agenda record is material because it shows that the noticed SAD second public

hearing does not appear in the reviewed November 8, 2023, Budget, Finance and Audit agenda package.

The reviewed agenda instead identifies a 1:10 p.m. continued public hearing concerning Chapter 17

purchasing-and-supplies amendments. This supports Petitioner’s position that the hearing sequence and

notice record did not provide affected Sherwood Forest owners with a clean, traceable, lawful hearing

process tied to the required authority-chain materials.

Record Limitation:

Petitioner does not ask the Tribunal to determine personal motive from this exhibit. Petitioner offers this

exhibit to show the procedural sequence reflected in the reviewed record: repeated requests for the

missing resolution; June 13 Formal Session action while the item was still marked “PENDING THE

RESOLUTION”; the October 11, 2023, first public hearing with No Attachments; post-hearing

requests for the resolution; the October 13, 2023, combined resolution addressed in Exhibit 10; the

October 17, 2023, referral back to Budget, Finance and Audit; the October 18, 2023, second-hearing

routing discussion; the October 24, 2023, action setting a second public hearing for November 8, 2023;

and no reviewed November 8, 2023, agenda record identifying the noticed SAD second public hearing.

Petitioner does not deny that Detroit later created or used combined multi-district documents. Petitioner

disputes that those later combined documents were legally sufficient to cure the absence of a Sherwood

Forest-specific resolution, tentative assessment roll, Clerk-filed public-examination record,

Administering Department report, land-area verification record, and notice-supporting authority

material before the October 11, 2023, first public hearing.

Insert Behind This Cover Sheet:

1. June 7, 2023, Budget, Finance and Audit Standing Committee transcript excerpt showing the

missing-resolution discussion, Clerk timing explanation, Horhn’s acknowledgment that the

resolution had not been submitted, and pending-resolution action.

2. June 13, 2023, City Council Formal Session record showing Line Item 16.3 proceeded while

marked “PENDING THE RESOLUTION,” with Detroit Golf Club and Palmer Woods

resolution attachments but no comparable Sherwood Forest-specific resolution attachment.

3. October 11, 2023, Budget, Finance and Audit Standing Committee edited transcript excerpt

showing “No Attachments,” Golden’s post-hearing request for the resolution, and Durhal’s

request that Council be able to “lay eyes on it.”

4. October 17, 2023, Formal Session transcript excerpt sending the item back to Budget, Finance

and Audit for a continued or additional public hearing.

(Motion made by YOUNG; all Committee Members were in favor; motion carried 3-0.)

Transcript Excerpt

BFA Committee Chair Fred Durhal: "Next, we will move to Line Item 8.4, submitting a

report relative to request to set public hearing dates to renew special assessment districts

for Sherwood Forest, Detroit Golf Club and Palmer Woods. Is there a motion to discuss

Line Item 8.4 discussion? Thank you, Member Santiago-Romero. Mr. Horhn is joining us,

our Assessor. Good afternoon. Can you tell us a little bit more about Line Item 8.4 and

setting public hearing dates to renew our special assessment districts for Sherwood Forest,

Detroit Golf Club, and Palmer Woods?"

Deputy CFO / Assessor Alvin Horhn: "Thank you, Sir. Through the Chair, each of these

special assessment districts currently in effect in the City of Detroit are due to expire this

year. They were originally created by this honorable body in 2016. They have a seven-year

term. Under Section 44-3-221 of the Detroit City Code, to continue a special assessment

district beyond its original term, the steps to renew it are the same as it was to create it.

Each of the districts have started the first process, which is to submit petitions to the Office

of the Assessor verifying the majority of the residents want the district to continue. Those

petitions have been received by my office and we have reviewed and verified them. The

second step is the first of two public hearings, the first before this honorable body in which

members/residents who both support and oppose the districts have the opportunity to

present their arguments to City Council. Council can choose to vote to accept the petitions

and recommendations and forward everything to Committee of the Whole, they can ask for

another hearing, or they can reject them, but for cause. So, we are simply asking Council to

continue the process to take the second step in renewing the three existing districts, which

Exhibit 11 — Page 5 of 21

Page 6

is a public hearing before this honorable body. Thank you, Sir."

Durhal: "And to you Mr. Horhn, is this just a report or is this a resolution to Mr. Corley or

Ms. Barcliff? Our action is to receive and file this report. Will there be another request or

line item coming before us to set the public hearings?"

Alvin Horhn: "My apologies, Mr. Chair. This was intended to be a request for your

honorable body to set a date for a public hearing. The City Clerk needs at least 10 business

days to receive the mailing labels from the Office of the Assessor and then to notify the

residents in the affected areas. So, this was a request to you to set that first date for a first

public hearing."

Durhal: "OK, to the Clerk, because I see we have it again on our agenda as a report,

submitting report relative to, this is not a resolution, so that is my question about setting the

public hearing?"

Assistant City Council Committee Clerk Cindy Golden: "To Mr. Chair, in order for us

to set the public hearing, we would need a resolution to do so. When this came on the last

agenda, we did have a resolution to set the public hearing."

Durhal: "OK, so is this a Scrivener's error? Possibly?"

Cindy Golden: "There was no resolution attached, so it was submitted in the form of the

title requesting to set a public hearing, but there was never a document attached in the form

of a resolution to do so. So that is why it was written out as a report."

Durhal: "Thank you, Madam Clerk. And to the Assessor, do you have that, has that been

submitted through eSCRIBE for the resolution, Mr. Horhn?"

Alvin Horhn: "My apologies, Mr. Chair. That has not been submitted. I was not aware that

I needed to submit the resolution before the date was set, and I should have known better.

My apologies to the Committee. I will make sure a resolution is submitted before the week

ends."

Durhal: "So with that, what I will ask for is a motion to bring back this Line Item 8.4 in

one week. And then at that point to the Clerk, when the resolution is attached through

eSCRIBE, will it be attached to this line item or will it come as a separate line item?"

Cindy Golden: "It is going to come as a separate item if this resolution is uploaded to

eSCRIBE between today by 5:30 p.m.; if not today, by Friday at 1:00 o'clock it can show

up on next Tuesday's Formal Session agenda, the New Business side, as a referral back to

this Committee."

Durhal: "To come back and possibly make it to next Wednesday's BFA agenda?"

Cindy Golden: "Unless we get it in time to place it on New Business, it would be your

decision to move it on to New Business for a vote and that way the public hearing could be

set that Tuesday."

Durhal: "Right, Mr. Horhn?"

Alvin Horhn: "I will work some magic, Sir, and get that done before 5:00 today."

Exhibit 11 — Page 6 of 21

Page 7

Durhal: "OK, if not, please be in communication with our office so we are aware that

when Formal Session comes Tuesday if that has to be moved to New Business and voted

on by the entire Council."

BFA Vice Chair Coleman Young II: "Thank you, Mr. Chair. I do not have any questions

for you, Mr. Horhn, but thank you. I just have a question in general for maybe Mr. Graham.

I do not know if this would be to you or not, but there have been some questions about the

legality in terms of approval to form, in terms to the property tax reform ordinance. Are

you going to be there or somebody from Law to really kind of answer some of these

questions in terms of why it is not being approved to form, and in terms of whether it

encroaches on certain things that it is not supposed to encroach on? I just want to make

sure that we are having this discussion and everybody is there so we can answer these

questions, both from a legal standpoint, from a charter standpoint, and potentially from a

constitutional standpoint and a stay if necessary."

Law Department, Graham Anderson: "Absolutely, through the Chair, Graham

Anderson, Law Department. This is beyond my wheelhouse of expertise, but I can promise

you I will make sure someone from the Law Department who is familiar with this matter

will be able to speak on the matter next week."

Cindy Golden: "Thank you, Mr. Chair. The other option is we can move this item out

pending the resolution to be received by Tuesday if you like. That is also an option."

Durhal: "I am fine with that, noting that again, this is only to set a public hearing and we

will hear from the public about the special assessments in those areas. I am fine with

moving this out pending the resolution. I do not know if there is any objection for that. OK,

alright Mr. Horhn, we are going to do you a solid, you have to have that resolution by

Tuesday, so do I have a motion to send Line Item 8.4 to Formal Session with the

recommendation to approve pending the attachment of the resolution? (Young, motion.)

Hearing no objection, that action shall be taken. Line Item 8.4 will be sent to Formal

Session with the recommendation to approve pending the attachment of the resolution to

set public hearing dates to renew special assessment districts for Sherwood Forest, Detroit

Golf Club and Palmer Woods."

Public Hearing Held: Alvin Horhn, Deputy CFO / Assessor. Michelle Story-Stewart, President

of Palmer Woods Association, spoke at the table regarding questions raised during public

comment.

Public Comment In Person: Jed Durkin, Chris Campbell, Jim Levandowski, Michelle

Story-Stewart, Anthony Kurt Ronald Foster, and Eric Watson.

Public Comment Summary Note: The reviewed public-comment list in this excerpt does not

identify a Sherwood Forest Association representative or Sherwood Forest resident as speaking

at this first public hearing.

Committee Chair Fred Durhal: "Next, we will call back to order our 1:00 p.m. public

hearing for the special assessment hearing for the Detroit Golf Club, Palmer Woods, and

Sherwood Forest. Joining us today from the Assessor's Office, we have Mr. Alvin Horhn."

Deputy CFO / Assessor Alvin Horhn: "Thank you, Mr. Chair, members of the

Committee. Alvin Horhn, Assessor for the City of Detroit. The purpose of today's hearing

is to consider petitions for Sherwood Forest, Detroit Golf Club, and Palmer Woods to

extend their current Special Assessment Districts for another seven-year term. This is

allowed under Section 44-3-221 of the Detroit City Code, Continuation of a special

assessment district upon its expiration. Detroit City Code designates the Office of the

Assessor as the administrative body for these special assessment districts. That means that

we are required to report to City Council that each of the districts meet the minimum

requirements set by this honorable body to continue. That is the purpose of me being here.

Today, each of the districts have submitted petitions. Those petitions were reviewed and

approved by the City's Law Department. They are required to have at least 51% of the

taxpayers - I am sorry, my apologies - 51% of the property owners in each area sign the

petition. By doing so, they affirm that they wish the district to continue. Each petition has

been submitted to the City. I can report that 73% of the property owners in Palmer Woods

have signed the petition, 67% of the property owners in Golf Club have signed the petition,

and 60% of the property owners in Sherwood Forest have signed the petition, so they meet

the minimum requirements. In addition, each of the districts is required to affirm that they

continue to be regarded as a designated neighborhood improvement organization; that I can

confirm for each organization as well. In addition, by City Code, 60% of the property

owners are required to be current with their taxes; that we can confirm is true as well. So

they meet the minimum requirements set forth in the Detroit City Code for the continuation

of each of those special assessment districts. This is the first of at least two hearings which

must be held. This honorable body can hold the hearing, decide to forward a

recommendation for approval today to Committee of the Whole, vote to simply forward it

without a recommendation, say no and direct the Assessor to correct any deficiencies you

might find, or hold another hearing at its own convenience. So that is the purpose of today's

Exhibit 11 — Page 10 of 21

Page 11

hearing, Sir. The Assessor is confirming that they meet the minimum requirements to

continue. Members of some of the organizations are here, and I am here to answer any

questions that you and the Committee may have."

Committee Chair Fred Durhal: "Thank you, Mr. Horhn, and just for clarity for the

public, can we define what a special assessment district is as well? I know there are some

folks watching at home and other communities that do not have special assessment

districts. Can we please clarify what that is for the folks at home?"

Deputy CFO / Assessor Alvin Horhn: "Thank you, Sir. Through the Chair, there are

several types of special assessment districts which are allowed, but this specific one is

created under Michigan law and MCL 211.785, which allows a designated neighborhood

organization, which is a geographic area within the city and has its own charter, to collect a

fee for the purposes of snow removal, enhanced security, and mosquito abatement. That

district will last for seven years and is renewable upon this honorable body."

Committee Chair Fred Durhal: "And if you can give me the percentage numbers again

for the petitions for DGC, Palmer Woods, and Sherwood?"

Deputy CFO / Assessor Alvin Horhn: "Yes, Sir. Palmer Woods, 73% of the property

owners approved the petition. Sherwood Forest, 60% of the property owners approved the

petition. Detroit Golf Club, 66% of the property owners approved the petition."

Committee Chair Fred Durhal: "OK. Alright. And now I will turn it over to members of

the Committee for questions. Chair recognizes Member Santiago-Romero."

Committee Member Gabriela Santiago-Romero: "Thank you, Mr. Chair. So, Mr.

Horhn, quick question. I remember having this conversation before as well regarding

residents that do not want to be a part of this fee to be able to receive these services. I

remember there was a way to have them not be a part of this. Am I remembering correctly?

Remind me if there are options for them to opt out of this."

Deputy CFO / Assessor Alvin Horhn: "Unfortunately no. It is a majority vote. If the

majority votes to designate the area and impose the fee, that fee is collected by the City's

Treasurer. It will go on the residents' summer property tax bill and, over a ten-month

period, the money is turned over to each district for their use. There is no opt-out provision,

I am sorry."

Committee Member Gabriela Santiago-Romero: "Understood. Is there a way for there

to be an opt-out option? I mean, I move into this neighborhood, I am talking for myself,

even though as a Council member with this job, I struggle with my monthly payments as a

young single person that does not come from money. So I can definitely understand the

need for someone to have some relief. Is there a way for us to find relief for residents that

cannot pay this additional special assessment district fee?"

Petitioner Note: Horhn’s reference to “Michigan law” and “MCL 211.785” is offered to

show the legal-authority framing presented at the October 11, 2023, hearing. Petitioner’s

position is that the governing Detroit SAD authority is MCL 117.5i and Detroit City Code

Division 8, and that Detroit has not produced the authority-chain records required under

that framework.

Exhibit 11 — Page 11 of 21

Page 12

Deputy CFO / Assessor Alvin Horhn: "No, I am afraid not, no ma'am. The special

assessment district is based on Michigan law. The concept is that the services need to be

shared by everyone in the community. Each of the three organizations appearing before

you today actually had voluntary contributions before the designation was approved, and

what they all reported is that while everyone benefited from the services, relatively few

people actually paid toward those services when it was a voluntary payment. The purpose

of the special assessment district is to ensure that everyone who benefits from those

services actually pays their fair share."

Committee Member Gabriela Santiago-Romero: "Has there been discussion for there to

be funding set aside to support residents that cannot pay the fee within the organization?

You may not know the answer to that question, but I am just wondering if among neighbors

that has been discussed."

Deputy CFO / Assessor Alvin Horhn: "We have had conversations with two of the

organizations. The question has come up whether those who have been approved for HOPE

applications - Homeowners Property Exemptions - are required to pay the fee. Our report is

that it is up to the organization itself to make that determination. There is no provision one

way or the other in either City ordinance or state law that defines that. So we have left it up

to each organization to define that. Having said that, there is a provision under City Code

that a fee is for a service and everyone has to pay their fair share of that fee. But based on

the City solid waste fee, those who received HOPE applications pay less than the entire

special assessment fee. So the organizations have that right, I believe. The designated

neighborhood improvement organizations cannot say you do not have to pay anything, but

they can reduce the special assessment fee based on their own criteria, I believe."

Committee Member Gabriela Santiago-Romero: "Any other creative solutions that have

been discussed within the organization to support the neighbors that may not be able to pay

the fee? That is one. Have there been other discussions?"

Deputy CFO / Assessor Alvin Horhn: "I am not aware of organizations having them, I do

not know."

Committee Chair Fred Durhal: "Mr. Horhn, when we talk about engagement, 73% of

residents for Palmer Woods, 60% for Sherwood, 66% for DGC, how do we come up with

these petition signatures? What does the engagement look like relative to folks signing

these petitions? Is everyone aware, or are the residents aware of the special assessment

district renewal campaign for petition signatures in the community?"

Deputy CFO / Assessor Alvin Horhn: "The number of petitioners is based entirely on the

tax roll, the City's assessment roll at the time the petitions were taken out. Each of the areas

has a geographic area, so they have boundaries. Those boundaries are defined on the

petitions themselves. The Office of the Assessor pulls the address and name for every

property within those boundaries, and we create the petitions. The petitions are then turned

over to each of the neighborhood organizations, and they are required to hold public

hearings and an informational campaign within their geographic areas to notify their

members that there is a drive to renew the petitions."

Exhibit 11 — Page 12 of 21

Page 13

Committee Chair Fred Durhal: "And when we talk about increases or the cost of special

assessments, can you give me an idea of what that looks like per year per resident in those

designated areas?"

Deputy CFO / Assessor Alvin Horhn: "My apologies, Sir. That is the one thing that I did

not bring with me, the dollar amount of each fee. I will say that there is a provision under

the ordinance which, if for some reason enough funding is not raised by the designated

neighborhood organization to cover the cost of the contracts - I will point out that the City

has no involvement in contracts; the organizations are required to bid out the special

assessment district contracts based on City protocol and City ordinance, but the City does

not involve itself in the application or in finding a vendor - but getting back to the

question, if for some reason the special assessment district does not raise enough money to

pay off their contracts, the ordinance would allow the Assessor to raise the fee 15%, but I

can assure the Committee before we would do that, we would recommend that this

honorable body discontinue this special assessment district. Because if they cannot raise

enough money, then there is not support anymore, or people are not paying their property

taxes. Because the fee is part of your property tax bill, you cannot not pay the fee

separately. The City does not allow you to pick and choose which line items on your tax

bill you are not paying. We advise each of the committees to base their budget on what the

percentage of tax collection is in the area. No area in the City collects 100%. It averages

about 83% or 85%. So, each of the districts has been advised to base its special assessment

district budget on 83% to 85%. We, the Assessor, say: here is your total; if everybody -

record homeowners - paid their property tax in the special assessment district, here is 85%

of the total special assessment district fees; base your budget on that. So, over the seven

years since special assessment districts have existed, that has not been a concern. We have

advised these three special assessment districts, along with University District, that before

we would go to this honorable body and raise the fee, we would ask the Council to

discontinue the special assessment districts."

Petitioner Note: Fee increases and tax-bill treatment are addressed in Petitioner's tax-bill exhibits

and billing-correction exhibits. This transcript excerpt is offered to show Horhn's explanation that

the charge is placed on the summer property tax bill, collected by the Treasurer, and turned over to

the districts over time.

Committee Chair Fred Durhal: "And if you can please get that information to us relative

to what the actual assessment fee cost per district is, it is just great to get a picture of what

that cost is for those special assessment services for residents before the end of this public

hearing. That would be great."

Deputy CFO / Assessor Alvin Horhn: "I will send a text message to bring the numbers

down, Sir."

Committee Member Gabriela Santiago-Romero: "I would like to see the fees and would

like to see if there is any change in the fees, but we will get to that point when we come

back."

Exhibit 11 — Page 13 of 21

Page 14

Committee Chair Fred Durhal: "OK, Mr. Horhn, you can hang around because I also

want to have the opportunity to have you answer some questions relative to residents. More

comments may be made during public comment as required for public hearings. We have

to do a round of public comment just to let members of the public know who are joining us

online or in person. Your public comment must be germane, specific to the special

assessment hearing for the Detroit Golf Club, Palmer Woods, and Sherwood Forest. No

other public comment will be given or allowed. Again, it has to be germane to this topic,

which is the 1:00 p.m. public hearing. We will now open public comment for our 1:00 p.m.

public hearing. To participate and join us online, please indicate so by raising your hand."

[Transcript Excerpt Resumes After Public Comment]

Senior Assistant City Council Committee Clerk Cindy Golden: "Yes, so the public

hearing that was presented today was just submitted as a public hearing in itself. If you are

moving it forward for a resolution to go in front of the City Council Formal Session full

body, through you Mr. Chair, Mr. Horhn, will you be providing us with a resolution?"

Petitioner Note: The resolution referenced in this exchange is material to Petitioner's

missing-resolution issue. The reviewed October 11 first-hearing record states 'No Attachments'

and this post-hearing exchange shows Golden asking whether the Assessor would provide a

resolution for the matter to go before the full City Council. Petitioner does not ask the Tribunal to

infer personal motive from this exchange alone.

Deputy CFO / Assessor Alvin Horhn: "Yes, the Office of the Assessor will provide the

City Clerk with that resolution."

Committee Chair Fred Durhal: "And to you, Mr. Horhn and the Clerk, just so we are

always clear when these public hearings come before us, is there a possibility to include the

resolution at that time so we do not have to revisit it? Or is there a way, or is it necessary,

to have that separation with just the public hearing, which is similar to a discussion, and

then have the resolution presented again?"

Assistant City Council Committee Clerk Cindy Golden: "Typically, we do get them at

the same time, but in this instance it was done kind of the opposite, where the special

assessment renewal request document in itself was presented strictly to publish as the

public hearing, and there was no other documentation at that time. So we were under the

impression that this public hearing was for today only. However, because you are moving

it out, as mentioned, I am requesting the resolution for you, Committee Chair Durhal."

Committee Chair Fred Durhal: "And Mr. Horhn, just for a matter of fact, if you could

provide us a copy of that resolution so we can lay eyes on it before Formal Session on

Tuesday, just to make sure that we are on the same page, that would be great because it still

would have to be authorized on Tuesday in City Council Formal Session."

Alvin Horhn: "Thank you, Mr. Chair. Through the Chair, my apologies for the imprecise

Record Review Note - The BF&A agenda did not list the noticed SAD second public

hearing.

The October 24, 2023, Formal Session record set the second public hearing for November 8,

2023. The Clerk archive / Legal News notice also identified a Special Assessment Hearing for

the Detroit Golf Club, Palmer Woods, and Sherwood Forest to be held before the Budget,

Finance and Audit Standing Committee on Wednesday, November 8, 2023, at 1:10 p.m.

Petitioner reviewed the November 8, 2023, Budget, Finance and Audit Standing Committee

eSCRIBE Agenda Package. The agenda identifies a 1:10 p.m. continued public hearing

concerning amendments to Chapter 17 of the Detroit City Code, Finance, Purchasing and

Supplies. The agenda does not identify the noticed Sherwood Forest / Detroit Golf Club /

Palmer Woods SAD second public hearing, public comment, testimony, or action on the SAD

renewal on November 8, 2023.

Petitioner offers this record only to show that the reviewed November 8, 2023, Council record

does not show that the noticed SAD second public hearing occurred on the noticed date.

1. It does not identify the Sherwood Forest / Detroit Golf Club / Palmer Woods SAD second

public hearing.

2. It does not identify public comment, testimony, or action on the SAD renewal on November

8, 2023.

Exhibit 12 — Page 1 of 10

Source Record:

November 15, 2023, Budget, Finance and Audit Standing Committee record; November 9, 2023, Detroit

Legal News publication / Clerk archive notice excerpt concerning the November 8 and November 15

SAD hearing notices; Clerk archive / FOIA correspondence concerning located public-hearing notice

records; and Exhibit 11 source records showing the November 8, 2023, second-hearing setting and

agenda sequence.

Short Title:

November 15, 2023 — Second-Hearing Notice Defect

Purpose of Exhibit:

This exhibit is offered to show that the Sherwood Forest / Detroit Golf Club / Palmer Woods SAD

second public hearing was held on November 15, 2023, after the second public hearing had been set and

noticed for November 8, 2023. Exhibit 11 establishes the November 8 setting and shows that the

November 8, 2023, Budget, Finance and Audit agenda did not identify the noticed SAD second public

hearing. This exhibit focuses on the later November 15 hearing and Detroit’s nonproduction of a

cancellation notice, rescheduling notice, renewed mailed notice, mailing-label transmittal,

certificate of mailing, proof of first-class mailing, or other notice-supporting record showing that

affected Sherwood Forest record owners were lawfully notified that the second public hearing would

occur on November 15, 2023.

Material Record Points:

1. Exhibit 11 shows that the second public hearing was set for November 8, 2023.

2. Exhibit 11 shows that the November 8, 2023, Budget, Finance and Audit agenda did not identify

the noticed Sherwood Forest / Detroit Golf Club / Palmer Woods SAD second public hearing.

3. The November 15, 2023, Budget, Finance and Audit record shows that the SAD second public

hearing was later held on November 15, 2023.

4. The November 15, 2023, agenda identifies Item 5 as the 1:10 p.m. public hearing for Special

Assessment: Detroit Golf Club, Palmer Woods, and Sherwood Forest.

5. The reviewed November 15 agenda package does not identify an attachment showing a

cancellation notice, rescheduling notice, renewed mailed notice, mailing-label transmittal,

certificate of mailing, proof of first-class mailing, Sherwood Forest-specific resolution,

tentative assessment roll, or Clerk-filed public-examination record.

6. Horhn stated on June 7, 2023, that the City Clerk needed at least 10 business days to receive

mailing labels from the Office of the Assessor and notify affected residents before the public

hearing.

7. The reviewed record does not identify a cancellation notice for the November 8, 2023, noticed

hearing or a rescheduling notice setting the second public hearing for November 15, 2023.

Page 23

8. The reviewed November 15, 2023, hearing record does not identify a Sherwood Forest

Association representative or Sherwood Forest resident appearing to support, oppose, or

otherwise address the Sherwood Forest SAD renewal.

9. The November 15, 2023, second public hearing therefore proceeded without the reviewed record

identifying notice-supporting attachments for the changed hearing date or Sherwood Forest

participation at the hearing.

Tribunal Relevance:

This exhibit is material because Detroit cannot rely on the November 15, 2023, hearing as a lawful

second public hearing unless it can show that affected Sherwood Forest record owners received legally

sufficient notice of that hearing date. A public hearing set and noticed for November 8, 2023, does not

automatically become a valid November 15, 2023, hearing without a produced record showing

cancellation, rescheduling, renewed notice, or lawful notice to affected owners.

Horhn’s June 7, 2023, statement, included in Exhibit 11, is material to the November 15, 2023, notice

defect. Horhn stated that the City Clerk needed at least 10 business days to receive the mailing labels

from the Office of the Assessor and notify affected residents before a public hearing. Michigan’s special-

assessment notice framework requires notice of special-assessment hearings to be mailed by first-class

mail to each owner or party in interest shown on the last local tax assessment records at least 10 days

before the hearing, in addition to any notice required by publication or posting.

The November 9, 2023, Detroit Legal News publication is relevant, but it does not itself prove mailed

notice to affected Sherwood Forest record owners. A newspaper publication dated after the November 8,

2023, noticed hearing date, and only days before the November 15, 2023, hearing, does not show that

affected owners received legally sufficient mailed notice and a fair opportunity to appear, protest, or file

a written objection before the changed hearing date.

The November 15, 2023, record is also material because the reviewed agenda package and hearing

record do not identify notice-supporting attachments for the changed hearing date or Sherwood Forest

participation at the second public hearing. If Detroit held the second hearing on November 15, 2023,

after noticing November 8, 2023, the record should identify the cancellation, rescheduling, renewed

mailed notice, mailing-label transmittal, certificate of mailing, proof of first-class mailing, or other

notice-supporting record showing that affected Sherwood Forest owners had a lawful opportunity to

appear and protest on the changed date.

This exhibit is also material to Petitioner’s protest and waiver position. If affected Sherwood Forest

record owners did not receive legally sufficient notice of the changed November 15, 2023, hearing date,

then Petitioner’s nonappearance or failure to protest at that hearing should not be treated as waiver,

consent, acquiescence, or confirmation of lawful notice.

Record Limitation:

Petitioner does not ask the Tribunal to determine personal motive from this exhibit. Petitioner offers this

exhibit to show the notice sequence reflected in the reviewed record: second public hearing set for

November 8, 2023; November 8, 2023, Budget, Finance and Audit agenda not identifying the noticed

SAD second public hearing; later hearing held on November 15, 2023; and no produced cancellation,

rescheduling, renewed mailed-notice, mailing-label transmittal, certificate-of-mailing, proof-of-first-

Exhibit 12 — Page 2 of 10

Page 24

class-mailing, or other notice-supporting record showing that affected Sherwood Forest owners were

lawfully notified of the November 15, 2023, hearing date.

Petitioner does not contend that publication is irrelevant. Petitioner contends that the reviewed record

does not show the legally required mailed notice to affected Sherwood Forest record owners for the

November 15, 2023, changed hearing date, and that the November 9, 2023, Legal News publication

does not itself prove mailed notice, cancellation notice, rescheduling notice, certificate of mailing,

mailing-label transmittal, proof of first-class mailing, or lawful notice to affected owners.

showing that the SAD second public hearing was held on November 15, 2023, and that the

resident participation.

2. November 15, 2023, Budget, Finance and Audit Standing Committee agenda package excerpt

amendments.

for the November 15, 2023, changed hearing date.

REVISED BUDGET, FINANCE AND AUDIT STANDING COMMITTEE

NOVEMBER 15, 2023 - SECOND PUBLIC HEARING TRANSCRIPT

EXCERPT

Editing Note:

This edited excerpt normalizes obvious automated-transcript errors in spelling, punctuation,

capitalization, speaker labels, and spacing. The name of Deputy CFO / Assessor Alvin Horhn

is corrected throughout. Bracketed text identifies editorial clarification. No substantive

position is inserted into the quoted transcript text.

Committee Chair Fred Durhal:

"We will now move into our agenda. I will now call to order the 1:10 p.m. public hearing for

the special assessment of the Detroit Golf Club, Palmer Woods, and Sherwood Forest. I

believe we have Mr. Alvin Horhn, the Assessor, who is here joining us. Please join us at the

table. All folks participating in this public hearing, please queue up. For members of the public

to note, we will be taking one-minute public-hearing comments for the Detroit Golf Club,

Palmer Woods, and Sherwood Forest Special Assessment District. Good morning. Both of

you, state your name for the record."

Deputy CFO / Assessor Alvin Horhn:

"Good afternoon, Mr. Chair, members of the Committee, Council President. Alvin Horhn,

Deputy CFO and Assessor for the City of Detroit."

Deputy Assessor Cynthia Burton:

"Good afternoon. Cynthia Burton, Deputy Assessor over Operations and Policy with the Office

of the Assessor."

Deputy CFO / Assessor Alvin Horhn:

"Thank you, Mr. Chair. This is the second public hearing to consider renewal of the special

assessment districts for Detroit Golf Club, Palmer Woods, and Sherwood Forest. If this

honorable body proceeds, then the final vote will be taken before the Formal Session of the

Detroit City Council. This renewal is for seven years. Each of the districts has submitted its

petitions. Those petitions have been verified by the Office of the Assessor. They contained the

required number of signatures to move forward. We have followed their work as far as public

hearings and outreach to the different citizens. Everything is in accord with the relevant City

ordinances. We are asking this body to hold the second hearing and, if this body decides to

move forward, as I said, then it will go to a vote of the Formal Session of the Detroit City

Council to consider the renewal."

Committee Chair Fred Durhal:

"Thank you, Mr. Horhn. Members, we have already had one public hearing on this, now our

second public hearing. Are there any questions regarding the special assessment district for the

Detroit Golf Club, Palmer Woods, and Sherwood Forest? OK, seeing none, we will go directly

into public comment regarding our 1:10 p.m. public hearing."

Exhibit 12 — Page 4 of 10

Page 26

Committee Chair Fred Durhal:

"Mr. Horhn will give an opportunity to respond. I hope you are taking note of some of those

public-comment questions. Please proceed."

Deputy CFO / Assessor Alvin Horhn:

"Thank you, Mr. Chair. First, I would like to say that the special assessment is a fee; it is not a

tax. It is based on the services that each district determines that they want to include. Each

organization is vetted to determine that they have a charter, that they have a written means of

electing their officers, and that they have a proven track record of providing services in those

areas. Each of these organizations approaches the City of Detroit. We do not go out and look for

people to form special assessment districts. The first step starts with the Department of

Neighborhoods. They vet the organizations to determine if they meet the minimum requirements

in state law and City ordinance to serve as a designated neighborhood improvement organization.

Once that determination is made, the Department of Neighborhoods hands the matter off to the

Office of the Chief Financial Officer and the Assessor's Office. We are then required to help each

organization set up public hearings, determine that there is interest in the community, verify that

the organization is viable, verify the petitions, and place the fee on the tax roll if the district is

approved."

Deputy CFO / Assessor Alvin Horhn:

"The City will place that fee on the tax roll and collect it, and then we turn the money over to the

organization. We vet the contracts to make sure that the money is being spent on the services

provided under the organization's mandate, but that is the extent of our involvement. We provide

the petitions. We verify the petitions. They are based on the assessment roll as of the time of the

request, per state law. We verify that a majority of the established owners in the area agree to

this. Even though state law says 51%, this honorable body has made it clear it does not want to

see a petition that says 51% to 49%, so we work with the agency to make sure that there is clear

support for the objectives of the Special Assessment District."

Deputy CFO / Assessor Alvin Horhn:

"Each of the neighborhoods decides the services, not the City of Detroit. We place the fee on the

tax roll, we turn the money over to the special assessment districts, and we vet to make sure they

only spend the money on what they are supposed to spend it on. These special assessment

districts are creatures of the neighborhood association. A majority of the neighbors want to go

down this path. They agree to pay these fees and they agree to these services. Each one of these

special assessment districts was voted on by a majority of the residents in the area. Per Council's

requirement, it is a clear majority, not 51% to 49%. Each of these organizations, when they

presented petitions, was over 60%; one was at 58%, one at 63%, and one at 71%. There is a clear

majority of residents in these areas who support the creation of these special assessment districts.

Thank you, Mr. Chairman."

Petitioner Note:

This excerpt is offered to show the City representative’s statement that the charge is placed on

the tax roll, collected by the City, and turned over to the districts, along with the petition-

percentage statements made at the second public hearing. Petitioner does not adopt those

percentages as accurate. Petitioner separately disputes the legal sufficiency of the underlying

petition, land-area verification, and calculation record.

Exhibit 12 — Page 5 of 10

Page 27

Petitioner Note Continued:

The stated Sherwood Forest petition-support figure shifted from 60% at the October 11, 2023,

first public hearing to 58% at the November 15, 2023, second public hearing, making the

official calculation and authority-chain records material; Detroit should not be permitted to rely

on oral percentage summaries in place of the official Sherwood Forest calculation worksheet,

certified land-area calculation, or Administering Department verification record.

Committee Chair Fred Durhal:

"I am concerned, and I do understand that it is not the City's responsibility relative to how those

services are getting rolled out, but it is our responsibility to ensure that those contracts are up to

par. In that same vein, Mr. Horhn, I am hopeful when you have those conversations with those

folks that live on Seven Mile, you provide this Committee with that information and how that

dialogue has gone, because that could be very important to the decision that we make here as a

Committee and then as a Formal Session body."

Deputy CFO / Assessor Alvin Horhn:

"Sir, they are within the boundaries. I actually do not know the answer to that. We will meet

with the residents and with the governing board to figure out what is going on. As the Chair

pointed out, they are collecting the fees from all the members. It goes in the tax bill. It is not

voluntary. You get the money. So I believe it is the City's obligation to ensure that the services

are being provided equitably to all the citizens."

Committee Chair Fred Durhal:

"Another question. I know you mentioned the petitions were just the verifying of signatures. I

know there is a process we have to go through with those signatures being verified via the Clerk.

How do these petition signatures receive verification that they are indeed lawful and adequate,

and the signatures of that individual?"

Deputy CFO / Assessor Alvin Horhn:

"Beginning with the petitions, they are verified by the Detroit Corporation Counsel Office. They

verify that these petitions meet the minimum standards necessary to collect them. Under state

law, the petitions are printed based on the assessment roll for that area. We literally draw a map,

pull the owners of the properties off the map, and create a petition around it. We verify that the

person who actually lives in the residence at the time the petition is created is the one who

signed it. I will state that the law does not require the City, through the Assessor's Office, to

knock on each door to confirm that you signed this. There is a bit of trust built into this process

that each organization has taken due diligence to make sure that the person who answered that

door is the person whose name appears on that petition. There have been instances where the

EXHIBIT 13

FOIA PETITION-RECORDS REQUEST, APRIL 2025 PRODUCTION, AND DISPUTED 2022

SIGNATURE SOURCE

Exhibit 13 — Page 1 of 21

Source Record:

December 4, 2024, FOIA request for Sherwood Forest SAD petition records; December 11, 2024,

forwarding email to Ivars Steins; January 22, 2025, follow-up email concerning FOIA Request No. A24-

10616; April 7, 2025, City of Detroit Law Department / FOIA response; representative City-produced

Sherwood Forest SAD petition-record excerpt from the ninety-six-page OCFO production; and LARA

corporate-status records concerning Sherwood Forest Association’s dissolution by operation of law and

renewal of corporate existence.

Short Title:

Petition-Records FOIA Production / Disputed 2022 Signature Source

Purpose of Exhibit:

This exhibit is offered to show that Petitioner requested the Sherwood Forest SAD petition records and

that Detroit produced redacted petition/signature records in response. The April 2025 production is

material because those City-produced petition records became the source record from which Petitioner

identified petition irregularities and later reconstructed the Sherwood Forest SAD petition-support

record.

This exhibit is also offered to identify the representative City-produced petition page containing

Petitioner’s disputed 2022 signature. Petitioner contends that the signature should not be treated as valid

petition support because SFA Director Stefanie Esters obtained the signature by misrepresenting the

document’s true purpose as a block-club list when Petitioner specifically asked what the document was

and did not have his glasses available to read it.

The 2022 timing is material because LARA records state that Sherwood Forest Association dissolved by

operation of law on December 1, 2016, and remained dissolved by operation of law until it renewed its

corporate existence on January 31, 2023. Petitioner therefore disputes Detroit’s reliance on a 2022

signature collected by or for SFA during the period when LARA records state SFA had not renewed its

corporate existence.

This exhibit is offered as a production-chain, source-foundation, and disputed-signature-source

exhibit. It is not offered as the full petition-validity analysis, the final reconstructed assessment roll, the

complete land-area calculation exhibit, or the complete SFA corporate-status exhibit.

Material Record Points:

1. On December 4, 2024, Petitioner submitted a FOIA request seeking Sherwood Forest SAD

petition records.

2. The December 4, 2024, FOIA request sought copies of petitions circulated for renewal of the

Sherwood Forest SAD, the proposed yearly SAD fee increase to $300, and City Council

approval of the Sherwood Forest SAD assessment fee.

Page 33

3. On December 11, 2024, Petitioner forwarded the FOIA confirmation to Ivars Steins after being

directed to do so.

4. On January 22, 2025, Petitioner followed up with Ivars Steins concerning FOIA Request No.

A24-10616.

5. On April 7, 2025, the City of Detroit Law Department responded to FOIA Request No. A24-

10616.

6. The April 7, 2025, response states that the request was submitted to the City of Detroit Office of

the Chief Financial Officer (“OCFO”) to conduct a search for the requested records.

7. The April 7, 2025, response states that OCFO submitted records to the Law Department and that

the redacted OCFO production consisted of ninety-six (96) pages.

8. The representative petition page produced by Detroit is titled “Petition to Authorize the

Creation of a Special Assessment District” and identifies the potential special assessment

district as Sherwood Forest.

9. The representative petition page includes Petitioner’s parcel/property row for Parcel No.

02004962.001 / 19130 Parkside and shows the City-produced petition source record containing

Petitioner’s disputed 2022 signature.

10. Petitioner disputes the validity of that 2022 signature as petition support. Petitioner contends

that SFA Director Stefanie Esters obtained Petitioner’s signature by misrepresenting the

document’s true purpose as a block-club list when Petitioner specifically asked what the

document was and did not have his glasses available to read it.

11. The representative petition page does not identify Stefanie Esters or any SFA circulator /

representative on the face of the petition sheet. Petitioner further contends that the reviewed

City-produced petition sheets do not contain SFA representative identification, circulator

certification, or petition-circulation information sufficient to substantiate who obtained the

signatures and how Detroit treated those signatures as valid petition support.

12. LARA records state that Sherwood Forest Association dissolved by operation of law on

December 1, 2016, and remained dissolved by operation of law until it renewed its corporate

existence on January 31, 2023.

13. The LARA status record is material to Petitioner’s disputed signature because Petitioner’s

signature was collected in 2022, during the period when LARA records state Sherwood Forest

Association remained dissolved by operation of law and had not renewed its corporate existence.

14. The April 2025 petition production did not include or identify a City-certified 51% land-area

calculation, official Sherwood Forest calculation worksheet, Administering Department

verification record, Administering Department report, tentative assessment roll, confirmed

special assessment roll, Clerk endorsement, or Treasury transmittal authorizing later SMS/SWF

billing.

15. Petitioner’s December 4, 2024, FOIA request used the phrase “51% property owners’ signature”

to request the City’s petition records. Petitioner does not adopt that phrase as the governing legal

standard. Petitioner’s position is that MCL 117.5i and Detroit City Code Division 8 require

Exhibit 13 — Page 2 of 21

Page 34

petition support from record owners of not less than 51% of the land comprising the actual

SAD, not merely a count of property owners or residents.

16. Petitioner offers this exhibit to establish the request-and-production chain for the petition records

and to identify the City-produced petition page containing Petitioner’s disputed 2022 signature.

The detailed petition-validity, signer-validity, duplicate-signature, taxpayer-matching,

misrepresentation, SFA corporate-status, and land-area analysis is addressed in separate filing

materials and exhibits.

Tribunal Relevance:

This exhibit is material because Detroit’s claimed 2023 Sherwood Forest SAD renewal depends in part

on the legal sufficiency of the petition process. The April 2025 FOIA production supplied the City-

produced petition/signature records that Petitioner reviewed to test Detroit’s claimed petition support.

The production is therefore relevant to the Tribunal’s review of whether Detroit can substantiate the

petition component of the legal-authority chain supporting the current 2026 SMS/SWF charge imposed

under Detroit’s claimed 2023 renewal of the Sherwood Forest Special Assessment District.

This exhibit is also material because the representative City-produced petition page contains Petitioner’s

disputed 2022 signature. Petitioner contends that the signature should not be treated as valid petition

support because it was obtained through misrepresentation of the document’s true purpose and because

the produced petition sheet does not identify Stefanie Esters or any SFA circulator / representative

responsible for obtaining the signature.

The 2022 signature date is independently material because LARA records state that Sherwood Forest

Association was dissolved by operation of law on December 1, 2016, and remained dissolved by

operation of law until it renewed its corporate existence on January 31, 2023. Detroit should not be

permitted to rely on Petitioner’s disputed 2022 signature as valid petition support without producing the

official petition-validation, land-area calculation, DNIO-status, and authority-chain records showing that

the signature was lawfully collected, lawfully counted, and lawfully used to support a compulsory

special assessment charge.

This exhibit also explains Petitioner’s timing and discovery record. Petitioner did not have the City-

produced petition records during the 2023 hearing process. Petitioner obtained the petition records

through later FOIA production, reviewed those records, identified petition irregularities, and then

pursued further record requests for the official calculation and authority-chain records Detroit would

need to prove lawful special-assessment authority.

The exhibit is also material because the April 2025 production produced petition/signature records but

did not include or identify the corresponding City-certified 51% land-area calculation, official

Sherwood Forest calculation worksheet, Administering Department verification record, Administering

Department report, tentative assessment roll, confirmed roll, Clerk endorsement, or Treasury transmittal.

Petition sheets alone do not prove lawful special-assessment authority for a compulsory charge imposed

through the property-tax system.

Record Limitation:

Petitioner does not offer this exhibit as the final reconstructed assessment roll or complete petition-

validity analysis. Petitioner offers this exhibit to show the request-and-production chain for the petition

Exhibit 13 — Page 3 of 21

Page 35

records and to identify the City-produced petition records as the source basis for later petition and land-

area review.

Petitioner does not ask the Tribunal to resolve the full signature-validity issue from this exhibit alone.

Petitioner offers the representative petition page to show the City-produced source record containing

Petitioner’s disputed 2022 signature and to preserve Petitioner’s position that the signature was not

valid petition support. The complete signature-validity, misrepresentation, SFA corporate-status, and

petition-validity challenge is addressed in separate filing materials and exhibits.

Petitioner does not contend in this exhibit alone that every petition defect is fully proven. Petitioner

contends that the City-produced petition records required further review and that Detroit has not

produced the corresponding City-certified 51% land-area calculation, official Sherwood Forest

calculation worksheet, Administering Department verification record, Administering Department report,

tentative assessment roll, confirmed special assessment roll, Clerk endorsement, or Treasury transmittal

sufficient to establish lawful authority for the current 2026 SMS/SWF charge.

Petitioner further does not adopt the “51% property owners” phrasing contained in the December 4,

2024, FOIA request as the governing legal standard. That phrase appears in the record because Petitioner

requested the petition records Detroit was using. Petitioner’s legal position remains that the governing

petition threshold is 51% of the land comprising the actual SAD.

Steins.

responsive records and that the redacted OCFO production consisted of ninety-six (96) pages.

6. Representative City-produced Sherwood Forest SAD petition page from the ninety-six-page

OCFO production, showing the petition-record source, Petitioner’s parcel/property row, and

Petitioner’s disputed 2022 signature.

7. LARA corporate-status record excerpt stating that Sherwood Forest Association dissolved by

operation of law on December 1, 2016, and remained dissolved by operation of law until it

renewed its corporate existence on January 31, 2023.

8. LARA renewal / annual-report record excerpt showing the January 31, 2023, filing of delinquent

annual reports used to renew Sherwood Forest Association’s corporate existence.

Comments:

LARA certifies that, to the best of the LARA’s knowledge, information, and belief, the requested information does

not exist within LARA under the description given or another reasonably known to LARA. MCL 15.235(5)(b). The

Corporations Division does not have any records that would specifically detail what you are requesting. However,

in the spirit of cooperation, the based on a review of available information within the Corporations Division, the

entity's status history is as follows:

Sherwood Forest Association (ID 800804744) dissolved by operation of law on December 1, 2016, for failing to file

the 2014 Annual Report for two years consecutively. Sherwood Forest Association remained dissolved by

operation of law until it renewed its corporate existence on January 31, 2023. Sherwood Forest Association

renewed its corporate existence by filing the 2018 through 2022 Annual Reports and paying the annual filing fees

and penalty fees for all the years for which they were not paid pursuant to MCL450.2925. MCL 450.2925 requires

the last five years of Annual Reports to be filed when a nonprofit corporation is renewing its corporate existence

afterbeing dissolved by operation of law. Thus, the 2014, 2015, 2016, and 2017 Annual Report forms were not

required to be filed; however, the annual filing fees and penalty fees for those years were required to be paid.

The Corporations Division does not have system-generated records to state this information. However, you may

use the Mi Business Registry Portal link in the FOIA Center to order a Certificate of Fact stating specific facts to

be attested to by the Corporations Division. The Certificate of Fact stating specific facts is $20.00 for the first fact

and $10.00 for each additional fact.

As to the denial of your request, under section 10 of the FOIA, MCL 15.240, LARA is obligated to inform you that

you may do the following:

1) Appeal this decision in writing to Appeals Officer Adam Sandoval, Department of Licensing and Regulatory

Affairs, P.O. Box 30004, Lansing, MI 48909. The writing must specifically state the word “appeal” and must

identify the reason or reasons you believe the denial should be reversed. The head of the Department or her

designee must respond to your appeal within 10 business days of its receipt. Under unusual circumstances, the

time for response to your appeal may be extended by 10 business days.

2) Commence an action in the Court of Claims within 180 days after the date of the final determination to deny

the request. If you prevail in such an action, the court is to award reasonable attorney fees, costs, and

disbursements, and possible damages.

If you have questions concerning this matter, please email us at larafoiainfo@michigan.gov.

To review a copy of LARA’s written public summary, procedures, and guidelines, please

Sincerely,

Caitlin Keene

June 30, 2025, FOIA request seeking the 2023 Sherwood Forest SAD Administering Department report,

tentative assessment roll, petition-compliance verification records, and related pre-hearing authority-

chain records; July 1, 2025, City FOIA acknowledgment; July 17, 2025, Ivars Steins assignment email

response and related transmittal; May 6, 2026, final request for production, inspection date, or written

FOIA determination; and May 7, 2026, Lorena Beal / Clerk archive email identifying the limited Clerk

archive records located.

Short Title:

Administering Department Report / Tentative Assessment Roll Request

Purpose of Exhibit:

This exhibit is offered to show that Petitioner requested the core records that should substantiate

Detroit’s claimed petition verification and pre-hearing authority for the 2023 Sherwood Forest SAD

renewal: the Administering Department report, the tentative assessment roll, the petition-

compliance verification record, and related authority-chain materials.

These records are material because Detroit’s claimed 2023 renewal required more than petition sheets or

oral percentage summaries. Before lawful hearing notice, public examination, Council action, roll

confirmation, Clerk endorsement, Treasury transmission, or later billing could occur, the reviewed

record should identify Detroit’s official pre-hearing verification and tentative roll materials supporting

the claimed Sherwood Forest renewal.

This exhibit is also offered to show the production problem created by Detroit’s responses. Petitioner

requested the report-and-roll records. The City’s September 3, 2025, FOIA response stated that the

request was submitted to the City Clerk for search and retrieval and that the Clerk’s redacted production

consisted of twenty-six (26) pages. The later May 7, 2026, Clerk archive email identified the Clerk

archive material located as the Notice of Public Hearing and the record Beal described as “the

resolution sent by you with the roll call.” Petitioner reports Beal’s description only and does not adopt

that description as proof that Detroit produced a lawful Sherwood Forest-specific resolution, report,

tentative roll, confirmed roll, or billing-authority record.

Material Record Points:

1. After obtaining City-produced petition records, Petitioner requested the 2023 Sherwood Forest

SAD Administering Department report verifying petition compliance.

2. Petitioner also requested the 2023 Sherwood Forest SAD tentative assessment roll.

3. Petitioner’s June 30, 2025, request specifically sought all writings pertaining to the City of

Detroit Finance Department / Administering Department “report and tentative assessment

roll” verifying the validity of the proposed Sherwood Forest SAD petition.

Page 54

4. Petitioner’s request quoted the operative report-and-roll requirement: if the Administering

Department determines that the petition meets the requirements of the division, it shall submit a

report to City Council verifying the validity of the petition and shall obtain from the Board of

Assessors a tentative assessment roll for the proposed SAD, which it shall include with its report

to City Council.

5. On July 1, 2025, the City acknowledged that Petitioner’s June 30, 2025, request was deemed

received by the Law Department on July 1, 2025, and that the request was being handled by

Ivars Steins.

6. On July 17, 2025, Ivars Steins informed Petitioner that the request had been assigned

Submission No. 2509361.

7. On September 3, 2025, Ivars Steins transmitted the City’s response letter and redacted records

for FOIA Request Submission No. 2509361.

8. The September 3, 2025, City of Detroit Law Department response states that Petitioner’s request

sought writings pertaining to the 2023–2024 City of Detroit Finance Department “report and

tentative assessment roll” verifying the validity of the proposed Sherwood Forest SAD petition.

9. The September 3, 2025, response states that the request was submitted to the City Clerk to

conduct a search and retrieval of the requested records.

10. The September 3, 2025, response states that the redacted record from the City Clerk consisted of

twenty-six (26) pages of documents.

11. The reviewed production record does not identify a City-produced Administering Department

report verifying that the Sherwood Forest SAD renewal petition satisfied the governing petition

requirements.

12. The reviewed production record does not identify a City-produced tentative assessment roll

showing the proposed Sherwood Forest tax parcels, parcel shares, assessed costs, or land-area

basis for the claimed renewal.

13. The reviewed production record does not identify a City-certified land-area calculation

establishing that the Sherwood Forest SAD renewal petition satisfied the 51% land-area

requirement.

14. On May 6, 2026, Petitioner sent a final request seeking production, inspection, or written FOIA

determination for the 2023 Sherwood Forest SAD Tentative Assessment Roll, the

Administering Department report verifying petition compliance, the Clerk-filed petition file,

and the confirmed Sherwood Forest Special Assessment Roll, including any Clerk endorsement,

confirmation date, or transmittal to the Board of Assessors, Treasurer, or Sherwood Forest

Association.

15. On May 7, 2026, Lorena Beal of the City Clerk’s Office responded that, on March 20, 2026, she

sent Amanda Kelly a PDF attachment with seven copies and copied Cindy Golden, and that the

copies contained all of the information located in the Clerk archive records.

16. Beal identified the located Clerk archive records as “Notice of Public Hearing” and the record

she described as “the resolution sent by you with the roll call.”

Exhibit 14 — Page 2 of 15

Page 55

17. Petitioner reports Beal’s description of the located archive material but does not adopt that

description as proof that Detroit produced a lawful Sherwood Forest-specific resolution,

Administering Department report, tentative assessment roll, confirmed assessment roll, Clerk

endorsement, Treasury transmittal, or billing-authority record.

18. Beal’s May 7, 2026, email did not identify an Administering Department report, tentative

assessment roll, City-certified land-area calculation, Clerk-filed public-examination roll,

confirmed Sherwood Forest special assessment roll, Clerk endorsement, Treasury transmittal, or

billing-authority record.

19. The absence of these produced records is material because petition sheets alone do not establish

that Detroit lawfully verified petition sufficiency, prepared a tentative roll, made the roll

available for public examination, supported lawful notice, or proceeded with lawful pre-hearing

authority before the 2023 Sherwood Forest SAD hearings.

20. Petitioner offers this exhibit to establish that the core report-and-roll records were specifically

requested and that the reviewed production record does not identify those records as having been

produced.

Tribunal Relevance:

This exhibit is material because the current 2026 SMS/SWF charge imposed under Detroit’s claimed

2023 renewal of the Sherwood Forest Special Assessment District depends on a valid legal-authority

chain. Detroit cannot establish that chain through petition sheets, tax-bill entries, or oral percentage

summaries alone. The Administering Department report and tentative assessment roll are the

records that should show how Detroit verified the petition, determined the proposed parcels and

assessments, obtained the tentative roll from the Board of Assessors, and supplied the pre-hearing

materials necessary for lawful notice, public examination, and Council action.

This exhibit is also material because the September 3, 2025, FOIA response did not identify the

requested report-and-roll records as having been produced. Instead, the City stated that the request was

submitted to the City Clerk and that the Clerk’s redacted production consisted of twenty-six (26) pages.

The later May 7, 2026, Clerk archive email identified the located archive records as a Notice of Public

Hearing and the record Beal described as “the resolution sent by you with the roll call.” Petitioner

reports that description only. Petitioner does not adopt Beal’s description as proof that Detroit produced

a lawful Sherwood Forest-specific resolution or any substitute for the missing report-and-roll records.

A notice and a record described by Beal as a resolution with roll call do not substitute for an

Administering Department report, tentative assessment roll, City-certified land-area calculation,

Clerk-filed public-examination record, confirmed roll, Clerk endorsement, Treasury transmittal,

or lawful billing authority. The relevant issue for this exhibit is not whether some resolution-related

paper existed in the Clerk archive. The issue is that the reviewed production record does not identify the

official report-and-roll records required to substantiate Detroit’s pre-hearing authority for the claimed

Sherwood Forest SAD renewal.

This exhibit is also material to Petitioner’s protest and waiver issues. If Detroit did not produce the

Administering Department report, tentative assessment roll, City-certified land-area calculation, or

related pre-hearing authority materials, then Petitioner’s later challenge is not a belated objection to a

known and available roll. It is a challenge to a current charge imposed under a record sequence in which

Exhibit 14 — Page 3 of 15

Page 56

Detroit has not produced the pre-hearing authority records necessary to show lawful notice, lawful

opportunity to inspect the tentative roll, lawful opportunity to protest, and lawful authority to continue

billing the 2026 SMS/SWF charge.

Record Limitation:

Petitioner does not ask the Tribunal to infer from this exhibit alone that the records were never created.

Petitioner offers this exhibit to show that Petitioner specifically requested the Administering Department

report, tentative assessment roll, petition-compliance verification records, and related authority-chain

materials, and that the reviewed production record does not identify those records as having been

produced.

Petitioner also does not contend that a FOIA production dispute by itself decides the legality of the

special assessment. Petitioner offers the FOIA correspondence and Clerk archive response to show the

record trail: Petitioner requested the core report-and-roll records, the City routed the request to the Clerk

for search and retrieval, the City produced limited records, and the Clerk archive email later identified

the located archive material as public-hearing notice and the record Beal described as “the resolution

sent by you with the roll call.”

Petitioner does not adopt Beal’s phrase “the resolution sent by you with the roll call” as a legal

conclusion, as proof of a lawful Sherwood Forest-specific resolution, or as a substitute for the

Administering Department report, tentative assessment roll, City-certified land-area calculation, Clerk-

filed public-examination record, confirmed roll, Clerk endorsement, Treasury transmittal, or billing-

authority record.

Petitioner reserves the right to supplement this exhibit if Detroit later produces an Administering

Department report, tentative assessment roll, City-certified land-area calculation, Clerk-filed public-

examination record, confirmed assessment roll, Clerk endorsement, Treasury transmittal, billing-

authority record, or other authority-chain record.

Insert Behind This Cover Sheet:

1. July 17, 2025, Ivars Steins email assigning FOIA Submission No. 2509361, with attached email

chain acknowledging Petitioner’s request for the City of Detroit Finance Department /

Administering Department report and tentative assessment roll verifying the Sherwood Forest

proposed SAD petition.

2. July 1, 2025, City of Detroit FOIA acknowledgment stating that Petitioner’s June 30, 2025,

request was deemed received by the Law Department on July 1, 2025, and was being handled by

Ivars Steins.

3. June 30, 2025, FOIA request seeking all writings pertaining to the 2023–2024 City of Detroit

Finance Department / Administering Department report and tentative assessment roll verifying

the validity of the proposed Sherwood Forest SAD petition, including the quoted ordinance

language requiring the Administering Department report and tentative assessment roll.

4. September 3, 2025, Ivars Steins email transmitting the City’s response letter and redacted records

for FOIA Request Submission No. 2509361.

5. September 3, 2025, City of Detroit Law Department FOIA response letter stating that the request

sought the report and tentative assessment roll, that the request was submitted to the City Clerk

Exhibit 14 — Page 4 of 15

Page 57

for search and retrieval, and that the City Clerk’s redacted production consisted of twenty-six

(26) pages of documents.

6. May 7, 2026, Lorena Beal / Clerk archive email stating that the Clerk archive records located

consisted of the Notice of Public Hearing and the record Beal described as “the resolution sent

by you with the roll call.”

7. May 6, 2026, final request for production, inspection date, or written FOIA determination

specifically requesting the 2023 Sherwood Forest SAD Tentative Assessment Roll, the

Administering Department report verifying petition compliance, the Clerk-filed petition file, and

the confirmed Sherwood Forest Special Assessment Roll with any Clerk endorsement,

confirmation date, or transmittal record.

Subject: [EXTERNAL] Final Request for Producon, Inspecon Date, or Wrien FOIA Determinaon — Sherwood

Forest SAD Records

Dear Ms. Kelly,

I hope you are well.

I am writing regarding my pending FOIA request for records related to the 2023 Sherwood

Forest Special Assessment District renewal.

The City Clerk’s Office previously directed me to the Law Department/FOIA process. I now

understand from prior correspondence that the Law Department is awaiting records or a response

from the City Clerk’s Office. Respectfully, I am not submitting a new or expanded FOIA request.

I am requesting a final written status and production decision on the specific records already

requested.

To narrow the matter and avoid any ambiguity, I am requesting final action on the following

records:

1. The 2023 Sherwood Forest SAD Tentative Assessment Roll;

2. The Administering Department report verifying petition compliance for the 2023 Sherwood

Forest SAD renewal;

3. The Clerk-filed Sherwood Forest SAD renewal petition file, including the original petition,

all signature sheets, all supplemental petitions, any petition summary form, and any

transmittal records showing receipt by the City Clerk;

4. The confirmed Sherwood Forest Special Assessment Roll, including any Clerk

endorsement, confirmation date, or transmittal to the Board of Assessors, Treasurer, or

Sherwood Forest Association.

Please provide one of the following within five business days:

A. Produce the responsive records electronically;

B. Provide a date and time when I may inspect the responsive records in person at the City

Clerk’s Office; or

C. Provide a written final FOIA determination stating, for each record category above, whether

the record:

• currently exists and will be produced;

• exists but cannot be located;

• existed but was destroyed or otherwise disposed of;

• was never created;

• is in the custody of another City department or office; or

• is being withheld, in whole or in part, with the specific FOIA exemption relied upon.

If the City’s position is that any of these records do not exist, cannot be located, or were never

created, please state that clearly in writing. If the records are held by another City department,

please identify the department or office responsible for custody and preservation of the records.

If the City is not producing these records or scheduling inspection, please treat this email as a

request for a final written FOIA determination sufficient to permit administrative appeal or

judicial review.

This request is intended to resolve the circular referral issue in which the Clerk’s Office directed

me to FOIA, while FOIA has indicated it is awaiting a response from the Clerk’s Office. I am

simply seeking production, inspection, or a final written determination regarding the official

Sherwood Forest SAD renewal records.

I am copying the Clerk’s Office because prior correspondence indicated that these records are

expected to be maintained or made available through the Clerk’s Office. I am copying FOIA/Law

because the Clerk’s Office directed me to the FOIA process, and FOIA is now the office

responsible for issuing the City’s final written determination.

Thank you for your attention to this matter.

Kind regards,

Cletis Kendrick

EXHIBIT 15

BEAL / KELLY CLERK ARCHIVE AND FOIA NONRESPONSE RECORD

Exhibit 15 — Page 1 of 22

Source Record:

December 15, 2023, FOIA request seeking complete official Sherwood Forest SAD renewal records

maintained by or available through the City Clerk; Amanda Kelly’s March 16, 2026, FOIA status email

stating that Law Department / FOIA was still waiting on the City Clerk’s Office; Lorena Beal’s May 7,

2026, email concerning the March 20, 2026, Clerk archive transmission to Amanda Kelly; March 20,

2026, seven-page Clerk archive attachment; Petitioner’s May 6, 2026, final request for production,

inspection date, or written FOIA determination; and Petitioner’s June 1, 2026, deadline-preservation and

request for final FOIA determination.

Short Title:

Clerk Archive / FOIA Nonresponse Record

Purpose of Exhibit:

This exhibit is offered to show the record sequence after Petitioner requested the official Sherwood

Forest SAD renewal records that should have been maintained by, filed with, transmitted to, or made

available through the City Clerk under Detroit City Code Division 8.

This exhibit shows that Law Department / FOIA personnel treated the City Clerk’s Office as a source or

custodian for responsive Sherwood Forest SAD records, that the Clerk archive material located was

limited, and that Petitioner did not receive a final written FOIA determination producing or identifying

the Division 8 authority-chain records necessary to support the current 2026 SMS/SWF charge.

This exhibit is also offered to clarify the limited significance of the Clerk archive material identified by

Lorena Beal. Beal stated that the Clerk archive material located consisted of “Notice of Public

Hearing” and the record she described as “the resolution sent by you with the roll call.” Petitioner

reports Beal’s description only. Petitioner does not adopt that description as proof that Detroit produced

a lawful Sherwood Forest-specific resolution, Administering Department report, tentative assessment

roll, confirmed special assessment roll, Clerk endorsement, Treasury transmittal, or billing-authority

record.

Material Record Points:

1. On December 15, 2023, Petitioner submitted a FOIA request seeking complete official Clerk

records for the Sherwood Forest SAD renewal.

2. The December 15, 2023, request sought records required by Detroit City Code Division 8 to be

filed, maintained, transmitted, or made available for public inspection through the City Clerk.

3. The request sought the complete petition file, petition summary, signature-collector

certifications, Administering Department records, tentative assessment roll, hearing notice

materials, mailed statutory notices, publication affidavits, public-examination materials, final

approval records, confirmed special assessment roll, Clerk endorsement, reassessment or

redetermination rolls, and related Clerk-maintained Division 8 records.

Page 69

4. On March 16, 2026, Amanda Kelly stated that Law Department / FOIA was still waiting on a

response from the City Clerk’s Office and that Kelly had followed up accordingly.

5. Kelly’s March 16, 2026, email is material because it shows that Law Department / FOIA treated

the City Clerk’s Office as a source or custodian for responsive Sherwood Forest SAD records.

6. On May 7, 2026, Lorena Beal stated that, on March 20, 2026, she sent Amanda Kelly a PDF

attachment with seven pages / copies and copied Cindy Golden.

7. Beal stated that the March 20, 2026, attachment contained all of the information located in the

Clerk archive records.

8. Beal identified the located Clerk archive material as “Notice of Public Hearing” and the record

she described as “the resolution sent by you with the roll call.”

9. Petitioner reports Beal’s description of the located archive material but does not adopt that

description as proof that Detroit produced a lawful Sherwood Forest-specific resolution,

Administering Department report, tentative assessment roll, confirmed roll, Clerk endorsement,

Treasury transmittal, or billing-authority record.

10. The Clerk archive material described by Beal did not identify a Sherwood Forest-specific

Administering Department report verifying petition compliance.

11. The Clerk archive material described by Beal did not identify a pre-hearing Sherwood Forest

tentative assessment roll.

12. The Clerk archive material described by Beal did not identify a City-certified 51% land-area

verification worksheet or official land-area calculation supporting the claimed petition

sufficiency.

13. The Clerk archive material described by Beal did not identify a Clerk-filed public-examination

record showing that the tentative assessment roll, plans, specifications, proposed term, estimated

annual and aggregate costs, and estimated tax parcel share were on file for public inspection

before the hearing.

14. The Clerk archive material described by Beal did not identify a Sherwood Forest-specific

October 11, 2023, first-hearing mailed notice record, proof of first-class mailing, mailing labels,

mailing file, certificate of mailing, or mailing-vendor record.

15. The Clerk archive material described by Beal did not identify an October 11, 2023, first-hearing

publication affidavit, posting record, or complete Clerk-filed notice-content record tied to a

Sherwood Forest tentative assessment roll.

16. The Clerk archive material described by Beal did not identify a post-hearing confirmed

Sherwood Forest special assessment roll, a resolution confirming a final Sherwood Forest special

assessment roll, or the Clerk’s endorsement of the confirmation date on a confirmed Sherwood

Forest special assessment roll.

17. The Clerk archive material described by Beal did not identify delivery or transmittal of a

confirmed Sherwood Forest special assessment roll to the Board of Assessors, Treasurer, or

Sherwood Forest Association.

Exhibit 15 — Page 2 of 22

Page 70

18. The Clerk archive material described by Beal did not identify a Treasury billing-authority record

authorizing the Treasurer to place the renewed Sherwood Forest SAD charge on the 2024, 2025,

or 2026 tax bills.

19. After Beal’s March 20, 2026, archive transmission to Kelly, Petitioner did not receive a final

written FOIA determination from Kelly or the Law Department / FOIA Section producing or

identifying the missing Division 8 authority-chain records.

20. On May 6, 2026, Petitioner sent Kelly a final request for production, inspection date, or written

FOIA determination and expressly stated that Petitioner was not submitting a new or expanded

FOIA request.

21. The May 6, 2026, request specifically sought final action on the 2023 Sherwood Forest SAD

tentative assessment roll, Administering Department report verifying petition compliance, Clerk-

filed petition file, and confirmed Sherwood Forest special assessment roll, including any Clerk

endorsement, confirmation date, or transmittal.

22. On June 1, 2026, Petitioner sent a deadline-preservation and final-determination request to

Kelly, Steins, and the Law Department / FOIA Section.

23. The June 1, 2026, request again sought final written determinations for missing Sherwood Forest

SAD authority-chain records, including the official parcel-by-parcel 51% land-area verification

worksheet, petition summary, signature-validity records, signature-collector certifications,

deficiency / cure records, Administering Department report, City Council confirmation, Clerk

endorsement, delivery or transmittal records, and Treasurer billing-authority records.

24. The June 1, 2026, request expressly stated that public-hearing notices, publication materials, and

combined resolution materials do not substitute for the official 51% land-area verification

worksheet, Administering Department report, tentative assessment roll, confirmed roll,

Clerk endorsement, or Treasurer billing authority.

25. Petitioner offers this exhibit to establish that the Clerk archive / FOIA record did not identify the

Division 8 authority-chain records Detroit would need to substantiate lawful renewal,

confirmation, transmittal, billing, and collection of the current 2026 SMS/SWF charge.

Tribunal Relevance:

This exhibit is material because Detroit’s authority to impose the current 2026 SMS/SWF charge

depends on the City’s ability to prove the 2023 Sherwood Forest SAD renewal authority chain. The

Clerk archive record, as described by Beal, identified limited public-hearing notice material and the

record Beal described as “the resolution sent by you with the roll call.” Those materials do not

substitute for the official records required to prove lawful petition verification, tentative-roll preparation,

public-examination availability, hearing notice, roll confirmation, Clerk endorsement, Treasury

transmittal, or billing authority.

This exhibit is also material because Law Department / FOIA had notice of the production gap before

the 2026 charge. Kelly stated on March 16, 2026, that Law Department / FOIA was still waiting on the

City Clerk’s Office. Beal later stated that, on March 20, 2026, she sent Kelly the located Clerk archive

material and copied Cindy Golden. After that archive transmission, Petitioner still did not receive a final

written determination producing or identifying the missing Division 8 authority-chain records.

Exhibit 15 — Page 3 of 22

Page 71

This exhibit is material to Petitioner’s protest and waiver position. Detroit cannot rely on Petitioner’s

nonappearance or lack of protest unless Detroit first proves lawful notice of a lawful hearing process tied

to the required tentative or confirmed Sherwood Forest special assessment roll. The Clerk archive /

FOIA record did not identify the October 11, 2023, first-hearing mailed notice record, proof of first-class

mailing, mailing labels, Clerk-filed public-examination record, tentative assessment roll, confirmed roll,

Clerk endorsement, or roll-confirmation materials necessary to support waiver, consent, acquiescence, or

lawful continuation of the charge.

This exhibit also supports Petitioner’s current-charge theory. Petitioner is not asking the Tribunal to

adjudicate a separate FOIA enforcement claim in this appeal. Petitioner offers the FOIA and Clerk

archive record for the limited Tribunal purpose of showing that Petitioner repeatedly requested the

specific authority-chain records Detroit would need to substantiate the claimed 2023 Sherwood Forest

SAD renewal and the resulting 2026 SMS/SWF charge. The reviewed record does not show that Detroit

produced or identified the Administering Department report, 51% land-area verification, tentative

assessment roll, confirmed special assessment roll, Clerk endorsement, Treasury transmittal, or billing-

authority records necessary to establish lawful authority for the current charge.

This exhibit should be reviewed with Exhibit 6, Exhibit 11, Exhibit 12, and Exhibit 14. Together,

those exhibits show the gap between what Detroit City Code Division 8 requires and what the Clerk

archive / FOIA record actually identifies.

Record Limitation:

Petitioner does not assert from this exhibit alone that no responsive records exist anywhere in City

possession. Petitioner asserts that the Clerk archive production, as described by Beal, identified limited

records and did not identify the Division 8 authority-chain records required to support lawful renewal,

confirmation, transmittal, billing, and collection.

If Detroit contends that the missing records exist, Detroit should be required to identify them, produce

them, state the custodian, and explain why they were not included in the Clerk archive / public-

examination record or in the Law Department / FOIA response after Beal’s March 20, 2026, archive

transmission.

the City Clerk’s Office.

Clerk archive PDF and that it contained all information located in the Clerk archive records.

FOIA EMAIL AND SOURCE-RECORD CHRONOLOGY SHEET

Purpose of Chronology:

This chronology identifies the FOIA / Clerk archive source records attached behind the Exhibit 15 cover

sheet. It is provided only to help the Tribunal follow the record sequence. The chronology is not a

substitute for the attached source records.

The source records begin on Exhibit 15 — Page 7 of 22.

1. Date: December 15, 2023

Record: Petitioner’s FOIA request to the City Clerk for complete official Sherwood Forest SAD

renewal records.

Source Pages: Exhibit 15 — Pages 7–8 of 22

Record Significance: Petitioner requested the complete petition file, Administering Department records,

tentative assessment roll, hearing / notice / public-examination materials, confirmed special assessment

roll, Clerk endorsement, reassessment or redetermination rolls, and related Clerk-maintained Division 8

records.

2. Date: March 16, 2026

Record: Amanda Kelly email concerning FOIA status.

Source Pages: Exhibit 15 — Page 9 of 22

Record Significance: Kelly stated that Law Department / FOIA was still waiting on a response from the

City Clerk’s Office and that she had followed up accordingly. This shows Law Department / FOIA

treated the Clerk’s Office as a source or custodian for responsive Sherwood Forest SAD records.

3. Date: May 7, 2026

Record: Lorena Beal email concerning Clerk archive records and prior March 20, 2026, archive

transmission to Amanda Kelly.

Source Pages: Exhibit 15 — Page 10 of 22

Record Significance: Beal stated that, on March 20, 2026, she sent Kelly a seven-page Clerk archive

PDF, copied Cindy Golden, and that the attachment contained all information located in the Clerk

archive records. Beal identified the located information as “Notice of Public Hearing” and the record

she described as “the resolution sent by you with the roll call.” Petitioner reports Beal’s description

only and does not adopt that description as proof of a lawful Sherwood Forest-specific resolution.

4. Date: March 20, 2026

Record: Seven-page Clerk archive attachment described in Beal’s May 7, 2026, email.

Source Pages: Exhibit 15 — Pages 11–17 of 22

Exhibit 15 — Page 5 of 22

Page 73

Record Significance: The attachment contains public-hearing notice materials, Detroit Legal News

notice material, combined multi-district resolution pages, and roll-call material. The attachment does not

identify the Administering Department report, pre-hearing tentative assessment roll, Clerk-filed public-

examination record, post-hearing confirmed Sherwood Forest special assessment roll, Clerk

endorsement, Treasury transmittal, or Treasury billing-authority record.

5. Date: May 6, 2026

Record: Petitioner’s final request for production, inspection date, or written FOIA determination.

Source Pages: Exhibit 15 — Pages 18–19 of 22

Record Significance: Petitioner requested final action on the specific Sherwood Forest SAD records

already requested and expressly stated that the request was not a new or expanded FOIA request.

6. Date: June 1, 2026

Record: Petitioner’s deadline-preservation and request for final FOIA determination.

Source Pages: Exhibit 15 — Pages 20–22 of 22

Record Significance: Petitioner stated that he had not received a final FOIA response and again

requested final written determinations for the missing authority-chain records. Petitioner specifically

stated that public-hearing notices, publication materials, and combined resolution materials do not

substitute for the official 51% land-area verification worksheet, Administering Department report,

tentative assessment roll, confirmed roll, Clerk endorsement, or Treasurer billing authority.

Chronology Limitation:

This chronology is not offered as a substitute for the attached source records. It is only a roadmap to the

attached FOIA / Clerk archive records. The source records themselves appear at Exhibit 15 — Pages 7–

22 of 22.

Subject: Final Request for Production, Inspection Date, or Written FOIA Determination — Sherwood Forest

SAD Records

To: kellya@detroitmi.gov

<gilbertand@detroitmi.gov>, Lorena Beal <beall@detroitmi.gov>, winfreyj@detroitmi.gov, dietjp@detroitmi.gov

Dear Ms. Kelly,

I hope you are well.

I am writing regarding my pending FOIA request for records related to the 2023

Sherwood Forest Special Assessment District renewal.

The City Clerk’s Office previously directed me to the Law Department/FOIA process.

I now understand from prior correspondence that the Law Department is awaiting

records or a response from the City Clerk’s Office. Respectfully, I am not submitting

a new or expanded FOIA request. I am requesting a final written status and

production decision on the specific records already requested.

To narrow the matter and avoid any ambiguity, I am requesting final action on the

following records:

1. The 2023 Sherwood Forest SAD Tentative Assessment Roll;

2. The Administering Department report verifying petition compliance for the 2023

Sherwood Forest SAD renewal;

3. The Clerk-filed Sherwood Forest SAD renewal petition file, including the

original petition, all signature sheets, all supplemental petitions, any petition

summary form, and any transmittal records showing receipt by the City Clerk;

4. The confirmed Sherwood Forest Special Assessment Roll, including any Clerk

endorsement, confirmation date, or transmittal to the Board of Assessors,

Treasurer, or Sherwood Forest Association.

Please provide one of the following within five business days:

A. Produce the responsive records electronically;

B. Provide a date and time when I may inspect the responsive records in person at the

City Clerk’s Office; or

C. Provide a written final FOIA determination stating, for each record category

above, whether the record:

• currently exists and will be produced;

• exists but cannot be located;

• existed but was destroyed or otherwise disposed of;

• was never created;

• is in the custody of another City department or office; or

• is being withheld, in whole or in part, with the specific FOIA exemption relied

upon.

If the City’s position is that any of these records do not exist, cannot be located, or

were never created, please state that clearly in writing. If the records are held by

another City department, please identify the department or office responsible for

custody and preservation of the records.

If the City is not producing these records or scheduling inspection, please treat this

email as a request for a final written FOIA determination sufficient to permit

administrative appeal or judicial review.

This request is intended to resolve the circular referral issue in which the Clerk’s

Office directed me to FOIA, while FOIA has indicated it is awaiting a response from

the Clerk’s Office. I am simply seeking production, inspection, or a final written

determination regarding the official Sherwood Forest SAD renewal records.

I am copying the Clerk’s Office because prior correspondence indicated that these

records are expected to be maintained or made available through the Clerk’s Office. I

am copying FOIA/Law because the Clerk’s Office directed me to the FOIA process,

and FOIA is now the office responsible for issuing the City’s final written

determination.

Thank you for your attention to this matter.

Kind regards,

Cletis Kendrick

Subject: Deadline Preservation and Request for Final FOIA Determination — Sherwood Forest SAD Legal

Authority Records

From: Cletis Kendrick <cbkendrick@att.net>

Date: 6/1/2026, 3:20 AM

Dear City of Detroit FOIA Coordinator, Ms. Kelly, and Mr. Steins:

This is a deadline-preservation and final-determination request regarding my existing

Sherwood Forest Special Assessment District records requests. This is not a new

FOIA request.

As of June 1, 2026, I have not received a final FOIA response from the Law

Department/FOIA Section or from the assigned handlers regarding the Sherwood

Forest SAD records requested in my pending FOIA matters, including:

1. My FOIA request concerning complete official records for the 2023 Sherwood

Forest SAD renewal, handled by Amanda Kelly; and

2. My May 1, 2026 FOIA request concerning records authorizing the 2024

Sherwood Forest SAD charges, handled by Ivars Steins, for which the City’s

acknowledgment stated that the response would be granted, denied, or granted in

part and denied in part on or before May 25, 2026.

No FOIA request number was provided to me in either acknowledgment. I am

therefore identifying these matters by date, subject, assigned handler, and record

category.

This correspondence seeks final action on the City records necessary to establish the

legal and administrative authority for the 2023 Sherwood Forest SAD renewal and the

2024 Sherwood Forest SAD billing and collection. The records include, but are not

limited to:

1. The official parcel-by-parcel 51% land-area verification worksheet;

2. The petition summary showing total district land area, valid signed land area,

and percentage of land receiving signatures;

3. Records identifying excluded, duplicate, invalid, non-record-owner, no-authority,

or unverifiable signatures;

4. Signature collector certifications;

5. Deficiency notices, cure records, or supplemental petitions;

6. Administering Department report verifying petition validity;

7. Tentative assessment roll;

8. City Council confirmation of the special assessment roll;

9. Clerk endorsement of the confirmed roll;

10. Delivery or transmission of the confirmed roll to the Board of Assessors,

Treasurer, and DNIO;

11. Treasurer records authorizing the 2024 $250 Summer and $50 Winter Sherwood

Forest SAD charges;

12. Any assessment roll extract, parcel-level data, tax-system output, billing table,

internal directive, email, memorandum, or communication relied upon to bill and

collect the 2024 charges.

The Clerk’s Office has already indicated that the archive records located consisted of

the Notice of Public Hearing and a resolution with roll call. Those records do not

resolve the missing statutory authority records identified above.

Please provide a final written FOIA determination for each missing record category.

For each category, please state whether the City’s position is that the record:

A. exists and will be produced;

B. exists but is held by another City department or office, identifying that department

or office;

C. exists but cannot be located;

D. existed but was destroyed, transferred, or otherwise disposed of, identifying the

date and authority for disposition if known;

E. was never created; or

F. is being withheld, in whole or in part, with the specific FOIA exemption relied

upon.

If the City contends that any search remains incomplete after the expired response

deadline, please state the legal basis for withholding a final FOIA determination,

identify the department or office delaying production, and provide the date by which

the City will issue a final grant, denial, partial grant/denial, or no-records

determination.

If the City contends that a record already produced satisfies any category above,

please identify the specific record, the date it was produced, the producing

department, and the category it satisfies.

This clarification is necessary because the requested records are the records that

would establish the City’s legal authority to verify, approve, confirm, transmit, bill,

and collect the Sherwood Forest SAD assessment. Public-hearing notices, publication

materials, and combined resolution materials do not substitute for the official 51%

land-area verification worksheet, Administering Department report, tentative

assessment roll, confirmed roll, Clerk endorsement, or Treasurer billing authority.

Please treat this email as a request for final written FOIA determinations sufficient to

permit administrative appeal or judicial review if the City is not producing the

requested records.

I reserve all rights and remedies available under Michigan FOIA, MCL 15.231 et

seq., and any other applicable law.
