19. Petitioner Requests the Following Relief: Petitioner respectfully requests that the Michigan Tax Tribunal reduce the 2025 True Cash Value (TCV) of the subject property to $500,000, with a corresponding State Equalized Value (SEV) of $250,000 and Taxable Value (TV) of $250,000. This request is based on the actual condition of the property as of Tax Day, December 31, 2024, and is supported by extensive physical and economic evidence indicating a substantial overassessment. The 2025 TCV established by the local assessing unit is $1,410,600, which is over double the true as-is market value of the property. The building suffers from widespread structural, mechanical, and environmental deterioration, all of which are well-documented in the attached April 2025 inspection report. These conditions include: • Structural movement and block displacement that require engineering evaluation. • Roof ponding, holes in roof metal decking, loose seams, missing drain covers, and signs of water intrusion throughout the building envelope. • Water damage, mold conditions, and corrosion of roof decking and interior framing. • Multiple deficiencies affecting functionality and safety, including inoperative electrical service in portions of the warehouse, deteriorated conduit, subpanel issues, and failing plumbing infrastructure. Critically, the property has received no capital improvements or permitted upgrades in over a decade. As of Tax Day, no renovation activity had commenced. A major tenant occupying a 10,000 SF structure on the parcel has paid no rent for over 14 months and is subject to ongoing eviction proceedings. The property generates little to no meaningful revenue, is currently unfit for occupancy under standard commercial leasing terms due to high triple net expenses, and would require major investment to stabilize. Petitioner requests equitable relief based on the fair, as-is market value of the asset as it existed on Tax Day. The requested valuation is realistic, conservative, and supported by direct documentation and real-world market logic.
Page 6
20. Separate and Specific Facts Supporting the Relief Requested: 1. Long-Term Deferred Maintenance and Lack of Permits: There have been no permitted improvements of any substance at this property in over a decade. The current condition is the result of prolonged physical and economic deterioration, not recent construction activity or market repositioning. 2. Non-Performing Tenancy: A 10,000 SF structure on the property is occupied by a tenant who has paid no rent for over 14 months and is now subject to eviction. This space generates zero rental income and contributes nothing to net operating income. 3. Structural Deficiencies: The building exhibits structural movement and block displacement across multiple facades. Inspection photos show deteriorated mortar joints, water infiltration points, and visible degradation of key building components. The damage is severe enough to warrant engineering review. 4. Roof and Water Intrusion Issues: Roof ponding, clogged drains, and missing covers have led to visible water stains, corrosion, and suspected mold on interior surfaces. These are active building envelope failures with ongoing impact. 5. Electrical and Plumbing Deficiencies: Portions of the warehouse are without electrical service. Deteriorated conduit, open subpanels, and non-functioning receptacles are present. Bathrooms and plumbing infrastructure are in disrepair, with water damage and insufficient pressure noted. 6. Unleasable Condition: In its current form, the building is not viable for commercial lease under any conventional structure. The deficiencies materially impair value and eliminate income potential. 7. Valuation Disconnect: The $1.41M TCV is completely detached from the reality of the asset’s physical and financial state. No rational buyer or investor would assign even half that value without deep capital expenditure and risk discounts. These conditions and facts are confirmed in the professional inspection report prepared by Fletcher Inspections, dated April 22, 2025, which is attached to this petition. The report offers full photographic and narrative documentation of the building’s compromised state. Petitioner asks the Tribunal to review that evidence and grant relief accordingly. The Petitioner thanks the Tribunal for its time in reviewing this case.
