STATEMENT OF PETITIONER’S CASE WITH DOCUMENTARY EVIDENCE

ATTACHED

This appeal involves Petitioner John Harris’ claim for a qualified agricultural exemption

on property he owns in Lee Township for tax years 2024 and 2025.1 Harris has three related appeal

pending: MTT Docket Nos. 24-003784, 24-003785, and 24-003786. Each of these parcels is

contiguous to one of Harris’ blueberry fields (i.e. fields upon which blueberries are grown), and

1 Pursuant to MCL 205.737(5), when “the tribunal has jurisdiction over a petition alleging

that the property is exempt from taxation, the appeal for each subsequent year for which an

assessment has been established shall be added automatically to the petition.”

each parcel contains one (1) or more living units licensed by the State of Michigan as a migrant

labor camp. Until tax year 2024, these parcels were classified as agricultural real property.

Beginning in tax year 2024, Lee Township classified the affected parcels as residential real

property. Harris reserves the right to use the documents attached hereto, as well as any documents

provided to the Tribunal by Respondent, at the hearing scheduled in this matter.

FACTS

Petitioner John Scott Harris (“Harris”) started Harris Blueberries in the late 1970’s with a

dream to develop a sustainable, full-time blueberry operation.2 Harris worked for a blueberry

farmer when Harris was just twelve (12) years old and started his own growing operation in 1978

with just two (2) acres of blueberries in Van Buren County. Today, Harris Blueberry Farms, LLC

has grown into a farm of over three hundred (300) acres. One hundred sixty-one (161) of those

acres are in Respondent, Lee Township. As such, farming blueberries has been Harris’ full-time

“job” for decades.

Harris Blueberry Farms is tucked in the heart of Michigan blueberry country in Allegan

County. Harris was recently quoted as saying, “we’re doing the best thing we can do for the future,

and for us that’s providing handpicked fresh fruit.” Harris Blueberries harvests about 1.5 million

pounds of blueberries annually for the fresh market; over 90% of those blueberries are handpicked.

That translates into roughly 1.3 million pounds of fresh blueberries handpicked yearly.

Thirty (30) years ago, there might have been a local market of labor to pick Harris’

blueberries, but that local labor market has disappeared. Now, Harris must look elsewhere for his

laborers. Harris’ workers migrate to Michigan (usually from Florida) to pick his blueberry crops

2 The facts described in this brief will be provided as evidence via testimony at the

scheduled hearing.

from mid-June through the end of the growing season in late August. If Harris did not have a place

for the migrant workers to stay while they are working on his farm, he would not get the workers,

and his blueberries would die in the fields.

Harris Blueberry Farms has 28 living units that are licensed by the State of Michigan to

house 253 migrant farmworkers. Eighteen of those units are in Lee Township. Each of those units

is licensed through Michigan’s Department of Agriculture and Rural Development, Migrant Labor

Housing Program. Each occupancy license authorizes occupation only between early to mid-June

through the end of August each year. These units are built strictly for seasonal migrant help and

do not contain heat sufficient to sustain living therein throughout a Michigan winter. For example,

while the units have air conditioning powered by 24,000 BTUs of energy, their heating is powered

with only 8,000 BTUs of energy. As such, the Agricultural Labor Camp Licenses for the properties

at issue in this group of appeals permit habitation therein only from June through August 31st of

each year. Pictures of a sample of one of these structures are attached hereto as Exhibit 1. At the

end of each growing season, the water is drained from the units, and they are closed until the next

growing season. In short, the structures are essential tools that are part of Scott’s farming operation

and nothing more.

719 50th Street, PPN 0312-013-007-00 – MTT Docket No. 24-003785

The parcel of property located at 719 50th Street (PPN 0312-013-007-00) (hereinafter “719

50th Street”) is contiguous to 32.4 acres of blueberry fields owned by Harris on PPN 0312-013-

006-10. See Allegan County GIS map of parcels, Exhibit 2. Harris has owned this blueberry field

for over thirty-five (35) years. Respondent submitted a GIS map of 719 50th Street alone with its

Answer to Harris’ Petition. See Exhibit 3. Evident on both Exhibit 2 and Exhibit 3 is that there are

two (2) structures located on 719 50th Street. While Respondent’s answer indicates that those

Page 4

4

structures include 1 residential building and an “outbuilding,” both structures are licensed migrant

laborer units: one is a “house,” and one is a “duplex.” See Agricultural Labor Camp Licenses for

719 50th Street issued by the Michigan Department of Agriculture and Rural Development, Exhibit

4. Note that these structures are licensed only from sometime in June through August 31 of each

respective year. These structures house twenty-five (25) migrant farm laborers and are closed at

the end of each growing season. BS&A property records for this parcel for tax year 2025 are

attached as Exhibit 5.

703 50th Street, PPN 0312-013-006-00 – MTT Docket No. 24-003786

The parcel of property located at 703 50th Street (PPN 0312-013-006-00) (hereinafter “703

50th Street”) is also contiguous to 32.4 acres of blueberry fields owned by Harris on PPN 0312-

013-006-10. See Allegan County GIS map of parcels, Exhibit 2. Respondent submitted a GIS map

of 703 50th Street alone with its Answer to Harris’ Petition. See Exhibit 6. Evident on both Exhibit

2 and Exhibit 5 is that there are three (3) structures located on 703 50th Street. Respondent’s answer

indicates that there are three (3) residential structures on this parcel and claims that there was no

permit taken out for the most recently added structure.

Again, all structures on this parcel are housing Harris’ farm workers. This parcel includes

an old house, a duplex and a mobile home. The old house and the duplex are licensed migrant

laborer units. See Agricultural Labor Camp Licenses for 719 50th Street issued by the Michigan

Department of Agriculture and Rural Development, Exhibit 7. Note that, again, these structures

are licensed only from sometime in June through August 31 of each respective year.3 The structures

3 The old house on this parcel originally had heat, and the licenses on it do not appear to

have timing restrictions for calendar years 2023 and 2024. However, this house has timing

restrictions as of calendar year 2025. Regardless, the water has been drained and the house has

been closed from September through June just as with all other migrant structures.

Page 5

5

on this parcel house twenty-six (26) migrant farm laborers and are closed at the end of each

growing season.

Although Respondent indicates that no permit was pulled for the most recent structure

added to this parcel, prior to adding the most recent structure on this parcel, Harris went to Lee

Township to inquire about a permit. At that time, Township officials told Harris that because these

structures were governed by the Michigan Department of Agriculture and Rural Development, he

did not need to any permits other than well and septic permits. He did pull those permits as directed.

The mobile home on this parcel houses one of Harris’ full-time farmhands and is lived in

year-round by that employee of the farm. A photo of this home is attached as Exhibit 8. Harris

provides this structure for him, and Harris pays for the propane, electricity and maintenance

thereon. BS&A property records for tax year 2025 for this parcel are attached as Exhibit 9.

745 58th Street, PPN 0312-017-014-11 – MTT Docket No. 24-003784

The parcel of property located at 745 58th Street (PPN 0312-017-014-11) (hereinafter “745 58th

Street”) is contiguous to 38.2 acres of blueberry fields owned by Harris on PPN 0312-017-014-00.

See Allegan County GIS map of parcels, Exhibit 10. Respondent submitted a GIS map of 745 58th

Street alone with its Answer to Harris’ Petition. See Exhibit 11. Evident on both Exhibit 10 and

Exhibit 11 is that there is one (1) structure located on 745 58th Street. That structure is a duplex

and is licensed as two (2)migrant laborer units. See Agricultural Labor Camp Licenses for 745 58th

Street issued by the Michigan Department of Agriculture and Rural Development, Exhibit 12.

Note that these structures are licensed only from sometime in June through August 31 of each

respective year. This structure houses twelve (12) migrant farm laborers and is closed at the end

of each growing season. BS&A property records for tax year 2025 for this parcel are attached as

Exhibit 13.

LAW AND ARGUMENT

Petitioner Harris seeks an exemption from the property tax levied by the local school

district for operating purposes under MCL 211.7ee(1) given that the subject property is “qualified

agricultural property.” Under Michigan law, "qualified agricultural property" means:

“…unoccupied property and related buildings classified as agricultural, or other

unoccupied property and related buildings located on that property devoted

primarily to agricultural use as defined in section 36101 of the natural resources

and environmental protection act, 1994 PA 451, MCL 324.36101. Related

buildings include a residence occupied by a person employed in or actively

involved in the agricultural use and who has not claimed a principal residence

exemption on other property.”

MCL 211.7dd(d). “Agricultural use” means:

“…the production of plants and animals useful to humans, including forages and

sod crops; grains, feed crops, and field crops; dairy and dairy products; poultry and

poultry products; livestock, including breeding and grazing of cattle, swine, captive

cervidae, and similar animals; berries; herbs; flowers; seeds; grasses; nursery stock;

fruits; vegetables; maple syrup production; Christmas trees; and other similar uses

and activities.”

MCL 324.36101(b).

This dispute centers on the correct interpretation of MCL 211.7dd(d) and whether the

growing of blueberries, which is clearly an “agricultural use,” must take place on the specific

parcel at issue in order for property to be considered “qualified agricultural property” under MCL

211.7dd. Proper construction of a statute ‘begins by reviewing the text of the statute at issue; if the

language is unambiguous, it is presumed that the Legislature intended the meaning plainly

expressed, and judicial construction of the statute is not permitted.’ ” President Inn Properties,

LLC v City of Grand Rapids, 291 Mich App 625, 632, 806 N.W.2d 342 (2011), quoting Paris

Meadows, LLC v Kentwood, 287 Mich App 136, 141, 783 N.W.2d 133 (2010). Courts may not

read anything “into a clear statute that is not within the manifest intent of the Legislature as derived

Page 7

7

from the words of the statute itself.” President Inn Properties, 291 Mich App at 632, 806 N.W.2d

342 (quotation marks and citation omitted).

Michigan courts must apply a statute’s plain language. “When the plain and ordinary

language of a statute is unambiguous, the Legislature’s intent is clear and judicial construction is

neither necessary nor permitted.” Moshier v Whitewater Twp, 277 Mich App 403, 407; 745 NW2d

523 (2007). While the STC may issue bulletins and guidance documents interpreting the laws it

administers, administrative interpretation “‘cannot be used to overcome the statute’s plain

meaning.’” Catalina Marketing Sales Corp v Dep’t of Treas, 470 Mich 13, 24; 678 NW2d 619

(2004); quoting Ludington Service Corp v Acting Ins Comm’r, 444 Mich 481, 505; 511 NW2d 661

(1994) (citation omitted). Nor can a department “create law or adopt rules conflicting with

applicable statutes and binding court decisions.” Catalina Marketing, 470 Mich at 21.

The plain language of MCL 211.7dd(d) expressly states that “unoccupied property and

related buildings located on that property devoted primarily to agricultural use” constitute qualified

agricultural property. Breaking the language down into its grammatical parts, the qualified

agricultural property includes “unoccupied property” and “related buildings.” The word

unoccupied is an adjective modifying “property” just as “related” is an adjective modifying

“buildings.” The next phrase “located on that property” is a participial phrase modifying the noun

that precedes it - “related buildings.” In other words, the “located on that property” relates to the

“related buildings.” Finally, “devoted primarily to agricultural use” is the final participial phrase

of the sentence and it also must modify a noun. The most logical interpretation, given its

placement, is that it relates to the “related buildings located on that property.” It is also possible

that it applies to both nouns – “unoccupied property” and “related buildings.” However, there is

Page 8

8

no proper interpretation of this phrase requires that agricultural production must take place on the

subject property.

As described above, Harris has only two options: use migrant workers to pick his

blueberries or allow his blueberries to go unharvested. In other words, Harris has no meaningful

choice. If Harris wants to continue farming, he must use migrant labor. Similarly, if Harris wants

to use migrant labor, he must provide adequate shelter licensed by the State of Michigan

Department of Agriculture and Rural Development. As Harris will testify in this matter, the

structures on the subject property are no different to him than a tractor – or even the land itself –

it is an essential tool in his farming operation of growing blueberries. Because “the production of

plants and animals useful to humans” is expressly included in MCL 324.36101(b), it is

inconceivable that one could find that these structures are not for “agricultural use.”

To the extent that the State Tax Commission has published any contradictory guidance, the

Court of Appeals – in a published decision – has recognized that the STC’s bulletins and guidance

documents are “not a properly promulgated administrative rule,” and represents only “the STC’s

interpretation of the law” and “does not have the force of law.” Moshier, 277 Mich App at 408,

n2. Similarly, in Catalina, the Department of Treasury, of which the STC is a part, conceded that

it "'may not, through the issuance of an [RAB], create law or adopt rules conflicting with applicable

statutes and binding court decisions.'" Catalina Marketing, 470 Mich at 21.

In Moshier, property was owned by a set of parents and their son as joint tenants. Moshier,

277 Mich App at 406. While the parents were original owners of the property, their son was not.

During the course of the joint tenancy, the father died, leaving only the mother and son as the

remaining joint tenants. Thereafter, the mother conveyed the property to her son. Id. The

son/petitioner, claimed that the conveyance was not a transfer of ownership under GPTA pursuant

Page 9

9

to MCL 211.27a(7)(i),4 which excludes certain conveyances creating or terminating a joint

tenancy. Nonetheless, the Township uncapped the property’s taxable value. The Township based

its uncapping on STC Bulletin 16 of 1996, which provides that the title of the property must vest

in an original owner in order to qualify under MCL 211.27a(7)(h). The Tax Tribunal upheld the

Township’s uncapping. Id.

The Court of Appeals reversed, finding that “[b]ecause the tribunal’s interpretation

…requiring that petitioner demonstrate that he is an ‘original owner’ of the property does not

comport with the legislative intent shown by the plain language of that statute, we reject its

interpretation.” Id. 409. The Court found that the Tribunal’s decision “impermissibly grafts onto

the statute a requirement not contemplated by the statute’s plain and unambiguous language.” Id.

at 410. The instant case involves an attempted grafting of a “business activity” requirement rather

than a “vesting in the original owner” requirement onto statutory language, but the outcome is no

less improper than the original outcome in Moshier.

Nothing in MCL 211.7dd(d)’s plain language mandates that cultivation of a farm product

must take place on the subject property to be considered “qualified agricultural property.” Rather,

that would be a new condition added to the statute. Creating such a condition is nothing more than

an improper attempt to graft an additional requirement onto the statutory language passed by the

Legislature. Accordingly, it must be rejected.

4 At the time of the Moshier decision, this statutory provision was found at MCL

211.27a(7)(h). While the citation of the exclusion has changed, the language of the exclusion is

the same.

Page 10

10

CONCLUSION

For the foregoing reasons and for the reasons presented at hearing in this matter, Petitioner

John Scott Harris requests that this Tribunal find that the subject property is qualified agricultural

property for tax years 2024 and 2025.

Scott,

Attached are the license(s) that you requested. Good luck ln your quest to eliminate the related property

taxes. You folks contribute plenty to the capitalist nature related to representation thru taxation!

FYI: Looks like2024licenses for Camp(s) #7 and #12had units not licensed due to critical corrections at

the time of licensing.

. Unfortunately, during the follow-up inspection(s) - we never added those units back into the 2024

licenses.

. That's my bad and is sometimes the result of pre-licensing in December and follow-up Compliance

Verification in June the following year.

Yes, I know that I'm fullof excuses, but lwill try and be befter in the future ensuring that all living units are

represented on the licenses AFTER critical's are verified. Please forgive my lack of organization and follow

thru.

Scott,

Attached are the license(s) that you requested. Good luck in your quest to eliminate the related property

taxes. you folks

"onlriOui"'plenty

to the capitalist nature related to representation thru taxation!

Fyl: Looks lit<e zoz+ lic"n=br foi camp(s) #7 and #12had units not licensed due to critical corrections at

the time of licensing.

. UnfortunateV]during the follow-up inspection(s) - we never added those units back into the 2024

licenses.

. That,s rny bad and is sometimes the result of pre-licensing in December and follow-up Compliance

Verification in June the following year.

yes, I f<now that I'm irif of excuses, U-ui iwin try and be better in the future ensuring that all living units a.re

represented on the licenses AFTER critical's are verified. Please forgive my lack of organization and follow

thru.

Scott,

Attached are the license(s) that you requested. Good luck in your quest to eliminate the related property

taxes. you folks *ntrinri.'plenty to the capitalist nature related to representation thru taxation!

Fyl: Looks like2}24licenses for camp(s) #7 and #12had units not licensed due to critical corrections at

the time of licensing.

. UnfortunateV]during the follow-up inspection(s) - we never added those units back into the 2024

licenses.

. That,s my bad and is sometimes the result of pre-licensing in December and follow-up Compliance

Verification in June the following year.

yes, I know that I'm tutt of excuses, U-ui Lwifl try and be better in the future ensuring that all living units are

represented on the licenses AFTER critical's are verified. Please forgive my lack of organization and follow

thru.
