BRYAN BATTJES,

Petitioner,

v

MTT Docket No. 26-000350

MICHIGAN DEPARTMENT OF TREASURY,

Respondent.

/

BASIS OF RESPONDENT MICHIGAN DEPARTMENT OF TREASURY'S

ANSWER TO THE PETITION

The subject property is located in the East Lansing City, Ingham County. Petitioner filed

a petition in the Small Claims Division of the Michigan Tax Tribunal regarding the denial

of a qualified principal residence exemption from tax levied by the local school district for

school operating purposes as provided for by Section 7cc of the General Property Tax

Act. MCL 211.7cc.

FACTS

Petitioner's Principal Residence Exemption (PRE) on 1149 W saginaw known as Parcel

No. 33200112312015 was denied by the Michigan Department of Treasury (Department)

on October 24, 2025, for the 2022, 2023, 2024, and 2025 tax years.

A copy of the PRE

denial notice is attached as Exhibit 1 and incorporated herein by reference.

Petitioner

filed an untimely appeal with the Hearings Division

of the Michigan Department of

Treasury (Department). As a result, on February 26, 2026, Dave Matelski, Director of the

Bureau of Tax Policy, issued a Denial of Request for Informal Conference. A copy of the

Denial of Request for Informal Conference is attached as Exhibit 2 and incorporated

herein by reference. Thereafter, Petitioner filed a timely appeal with the Michigan Tax

Tribunal refuting the Department's final determination.

Page 8

Bryan Battjes v MI Department of Treasury

MTT Docket No. 26-000350

ARGUMENT AND ANALYSIS

To qualify for

a Principal Residence Exemption (PRE) on

a dwelling, MCL 211.7cc

requires that the property be:

(1) owned

by

a qualified owner as defined by MCL

211.7dd(a); (2) occupied as a principal residence by that owner of the property; (3) none

of the disqualifying factors listed in MCL 211.7cc(3) apply; and (4) claimed by the owner

of the property by filing an affidavit with the local tax collecting unit in which the property

is located.

Regarding Petitioners (Bryan Battjes & Kimberly Battjes):

In the present matter, Petitioner is not claiming entitlement to the principal residence

exemption. Petitioner is asserting that June Battjes should qualify for the PRE per the

Petition submitted to the Michigan Tax Tribunal. As such, the denial should be upheld as

issued for Bryan & Kimberly Battjes.

Regarding June Battjes:

I

Petitioner did not occupy the subject property as her principal residence

during the 2022, 2023, 2024, and 2025 tax years.

A sufficient amount of evidence linking a person to the address she claims as her principal

residence is required to prove eligibility to obtain a qualified principal residence exemption

from tax levied by the local school district for school operating purposes as provided for

by Section 7cc of the General Property Tax Act. No one document alone is dispositive.

A. No Evidence Provided

In the present matter, Petitioner did not provide any documents to prove the petitioner

occupied the property as her principal residence during the 2022, 2023, 2024, and 2025

tax years. As a result, petitioner failed to meet her burden of proof to substantiate that

she occupied the subject property as her “principal residence”.

B. Resided at 2340 Twin Lakes Ln, 4948 Algonquin Way, and/or 816 Clover St

as her Principal Residence

MTT Docket No. 26-000350

An application for an operator's or chauffeur's license must be made

in a

manner prescribed by the secretary of state and must contain all of the

following:

(a) The applicant's full legal name, date of birth, residence address, height,

sex,

eye

information required or permitted on the license under this chapter, and,

only to the extent required to comply with federal law, the applicant's Social

Security number. The applicant may provide a mailing address if the

applicant receives mail

at an address different from

his

or her

residence address. [Emphasis added]

Relative to the "Residence Address” on a Michigan Driver's License, in accordance

with MCL 257.50(a), "residence address” means the place that is the settled home

or domicile

at which

a person legally resides as defined

in section

11

of the

Michigan election law, 1954 PA 116, MCL 168.11. As defined

in MCL 168.11,

"Residence" ...means that place at which a person habitually sleeps, keeps his or

her personal effects, and has a

. MCL 257.901(1) provides with respect to a driver's

license application that, "it is a misdemeanor for a person to violate this act, unless

that violation is by this act or other law of this state declared to be a felony or a civil

infraction. [Emphasis added].

As a result, when Petitioner obtained her Michigan Driver's license, under penaity of law,

Petitioner indicated that her settled home where she legally resides and habitually sleeps

is 2340 Twin Lakes Ln, and not the subject property.

Also, a Lexis Nexis Voter Registration search indicates that Petitioner was registered to

vote at 4948 Algonquin Way as Petitioner's principal residence and not the subject

property. In addition, Petitioner even voted in the November 5, 2024, elections at a polling

location allocated to the 4948 Algonquin Way address, which is not the subject property.

MCL 168.509r of the Michigan Election Law states:

A person whose name does not otherwise appear in the qualified voter file shall be

placed in the qualified voter file only if the person signs under penalty of perjury an

Page 10

Bryan Battjies v MI Department of Treasury

MTT Docket No. 26-000350

c)

Is a resident of the city or township where the person's street address is

located. (Emphasis added.)

Here, Petitioner did sign and declare under penalty of perjury when she registered

to that she resided at 4948 Algonquin Way as her principal residence during the tax

year atissue. A copy of the Lexis Nexis Voter Registration search is attached hereto

as Exhibit 4.

Similarly,

Petitioner's

2022-2025

Michigan

Income

Tax

Returns

listed

4948

Algonquin Way, and/or 816 Clover St as her principal residence and not the subject

property. State of Michigan Income Tax Returns all require a Taxpayer Certification,

which

states,

"|

declare under perjury that the information

in

this

return and

attachments is true and complete to the best of my knowledge.” Therefore, when

Petitioner filed Michigan Income Tax Returns with the Michigan Department of

Treasury, Petitioner signed and certified under penalty of perjury that her principal

residence was

at 4948 Algonquin Way, and/or 816 Clover

St as. Copies

of

Petitioner's Michigan Tax Returns are attached as Exhibit 5.

Further evidence indicating the subject property was not Petitioner's principal

residence

is the fact that the subject property was occupied by a non-owner.

In

particular, Non-owner, Brittany Pleiness-Knapp resided at the subject property for

the tax years at issue per Lexis Nexis and 2023-2024 Michigan income Tax Return

Searches which are attached as Exhibit 6.

Given the undisputed facts that Petitioner's failed to introduce any evidence of occupancy,

Petitioner's Michigan Driver's License, Voter Registration, and Michigan tax returns

indicate that Petitioner's home at 2340 Twin Lakes Ln, 4948 Algonquin Way, and/or 816

Clover St constituted her principal residence and a non-owner resided at the subject

property, Petitioner did not satisfy her burden of proving entitlement to the principal

residence exemption in MCL 211.7cc for the 2022, 2023, 2024, and 2025 tax years. As a

result, the record evidence does not substantiate Petitioner's claim and the principal

residence exemption on the subject property should be denied for the 2022, 2023, 2024,

and 2025 tax years.
