RE:

Wetland Delineation, 1687 Rosedale,

West Bloomfield, Michigan

Dear Mr. Rosemeyer:

Brooks Williamson and Associates,

Inc. (BWA),

in cooperation with PEA Group

(PEA), has completed a wetland delineation on 1687 Rosedale and the parce! to the

north; Parcel Nos, 18-03-104-14 and 18-03-104-025.

The purpose of this work was

to determine the location of wetlands on the property that are subject to Part 303,

Wetland

Protection

(Part

303),

of

the

Natural

Resources

and

Environmental

Protection

Act (NREPA),

as amended.

The

property was

also

inspected

for additional

regulated

natural

resources

including

lakes,

ponds

or

streams that may be s

Watland A is a forested wetland with a substantial understory growth and occupies

the majority of the north parcel. Predominant vegetation is silver maple, cottonwood,

American elm are

in the tree stratum with common buckthorn, silky dogwood, lake

sedge, and tussock sedge

in the shrub and understory levels,

Soils are mainly

organic

in nature and extend below 21

inches. These soils are saturated

at the

surface with ponding anticipated

in the winter and spring months as suggested by

water-stained leaves and water marks on some trunks.

The remainder of the land within the properly boun

fied as upland. The

majority of the site is maintained lawn with a residence

present.

Edge areas near the

wetland show a transition to upland in the vegetation. The shrub and ground layer

communities of vegetation are dominated by plants that are typically (95% of the

time) considered upland. These include honeysuckle, black walnut, Virginia creeper,

and poison ivy.

Q

Wetland Regulation by the State of Michivan

In Michigan, wetlands are regulated by the Michigan Department of Environment, Great

Lakes, and Energy (EGLE) under Part 303

if the wetland fits the criteria listed in the

wetland definition and methodology section of this report.

Page 11

Rosemever, 1687 Rosedale Road,

West Bloomfield Township

Under Part 301 an inland lake or stream means either of the following:

.

(i) An artificial or natural lake, pond, or impoundment that is a water of the United

States as that term is used in section 502(7) of

the federal water pollution control

act, 33 USC 1362.

(ily A natural or artificial fake, pond, or impoundment;

a river, stream, or creek

which may or may not be serving as a drain as defined by the drain code of

1956, 1956 PA 40, MCL 280.1

to 280.630; or any other body of water that has

definite banks,

a bed, and visible evidence

of

a continued flow or continued

occurrence of water, including the St. Mary's, St. Clair, and Detroit Rivers,

The August 16, 2022,

site inspection revealed both parcels are directly adjacent to

canals connected to Cass Lake. Cass Lake is a natural inland lake in excess of 5 acres

in size. Therafore, both the lake and canals are

subject to regulation under Part 301.

Regulation by West Bloomfield Township

West Bloomfield Township has

a wetland ordinance.

The regulatory criteria

for

wetlands for the Township are similar to the Stale of Michigan except the Township

regulates all wellands with no size

limitation. In our opinion, Wetland A is regulated

due to the fact that

it

is contiguous to Cass Lake. Permits are required for work

within the wetland area.

The Township also requires a Natural Features Setback (NFS) of 25-est adjacent to

any regulated wetland. Permits/approvals are required for any activities within the

NFS.

Confirmation by Regulatory Agencies

Numerous

natural environmental

factors and human

induced changes may cause

changes in the extent of wetland on a parcel over a period of time. The aquatic natural

resources identified on the subject property represent what we believe the EGLE and

the Township would consider to be wetland given the condition of the site at the time of

inspection and recent reguiatory policies and atiifudes.

in BWA’s and PEA's opinion, any regulated activities conducted within Wetland A will

require a permit from the EGLE and the Township. Please note that EGLE and the
